HomeMy WebLinkAboutOrdinance No. 2012-1957 CITY OF THE COLONY, TEXAS ORDINANCE NO. 2012-1957 ZONING ORDINANCE AMENDMENT DUE TO A SCRIVNER ERROR SECTION 13-103 (2) and (3), PARKING REGULATIONS AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, APPROVING AN AMENDMENT TO THE CODE OF ORDINANCES, APPENDIX A, ZONING ORDINANCE, SECTION 13-103 SPECIAL OFF-STREET PARKING REGULATIONS, BY REPLACING SECTION 13-103 (3) AND (3) [sic] WITH A NEW SECTION 13-103 (2) AND (3); PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALER CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of The Colony, Texas, in compliance with the laws of the State of Texas, and the Code of Ordinances of the City of The Colony, Texas, the City Council of the City of The Colony, Texas, is of the opinion and finds that the proposed amendment to the Code of Ordinances, Appendix A, Zoning Ordinance, Section 13-103 (3) and (3) [sic] shall be replaced with Section 13-103 (2) and (3) due to a scrivener error. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That the findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2. That the City Council of the City of The Colony, Texas, does hereby approve proposed amendment to the Code of Ordinances. SECTION 3. That the Code of Ordinances, Appendix A, Zoning Ordinance, Section 13- 103 (2) and (3) shall read as follows: " (2) In the SF-1, SF-2, SF-3, SF-4, D, TH, MF-1, MF-2, MF-3, MF-4, MH, 0-1, 0-2, or NS districts, no parking space, garage or carport or other automobile storage space or structure shall be used for the storage of any truck or trailer except a panel or pickup truck not exceeding one (1) ton capacity. (Ord. No. 448, § Z 9-29-1986) (3) In the SF-1, SF-2, SF-3, SF-4, D, TH, MF-1, MF-2, MF-3 and MF-4 districts, a boat or recreational vehicle, including a motor home or travel trailer, may be parked or stored on the residential premises of the owner provided that such boat, recreational vehicle, motor home, or travel trailer may be parked or stored only within that portion of the residential lot which is located in the side or rear yard upon an improved surface, or on a designated front entry driveway. (Ord. No. 2011-1885 § Z 2-15-2011)" I SECTION 4. That it is hereby declared to be the intention of the City Council of the City of The Colony, Texas, that the phrases, clauses, sentences, paragraphs and sections of this Ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation of this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. That any provision of any prior ordinance of the City whether codified or uncodifled, which are in conflict with any provision of this Ordinance, are hereby repealed to the extent of the conflict, but all other provisions of the ordinances of the City whether codified or uncodifled, which are not in conflict with the provisions of this Ordinance, shall remain in full force and effect. SECTION 6. That this Ordinance shall become effective immediately upon its passage.
