HomeMy WebLinkAboutResolution No. 2012-027 CITY OF THE COLONY, TEXAS RESOLUTION NO. 2012- L` v4 A RESOLUTION OF THE CITY OF THE COLONY, TEXAS, AWARDING A BID AND AUTHORIZING THE CITY MANAGER TO ENTER INTO AN ANNUAL CONTRACT WITH OLDCASTLE APG WEST, INC. FOR THE PURPOSE OF PURCHASE AND DELIVERY OF CONCRETE FOR STREET AND SIDEWALK REPAIR FOR THE PUBLIC WORKS DEPARTMENT; APPROVING TWO OPTIONAL ONE YEAR EXTENSIONS; ADDING THE APPROVED FORM OF CONTRACT AS EXHIBIT A; PROVIDING AN EFFECTIVE DATE NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That the City Council of the City of The Colony, Texas, hereby approves awarding an annual bid to OLDCASTLE APG WEST, INC. for the purchase and delivery of concrete for street and sidewalk repairs. Section 2. That the City Council hereby approves the option of extending the contract for two one year terms. Section 3. That a true and correct copy of the bid sheet is attached hereto and incorporated herein. Section 4. That the city manager is authorized to enter into contracts and issue purchase orders as provided herein. Section 5. That this resolution shall take effect immediately from and after its passage. A. Contractor hereby agrees to provide custom mixed concrete according to the specifications set out in Bid No. 90-12-02-CONCRETE. B. Contractor shall provide proof of insurance in V.A.C.S. requirements. C. Contractor agrees to defend, indemnify and hold harmless the city from all damages, costs, expenses, and attorney fees for all claims and suits including claims and suits for death, personal injury, and property damage, arising out of, or connected with, the work performed under this contract D. All material is guaranteed to be as specified, and the above work is to tbrformed in accordance with the specifications submitted for above work and completed in a substantial workmanlike manner. E.
