HomeMy WebLinkAbout10/25/2011 P&Z MINUTES CITY OF THE COLONY PLANNING AND ZONING COMMISSION OCTOBER 25, 2011 After determining that a quorum was present, the Planning and Zoning Commission of the City of The Colony, Texas convened into regular session which was held on Tuesday, October 25, 2011 at 6:30PM in the City Council Chambers located in City Hall, 6800 Main Street, The Colony, Texas, at which time the following items were addressed: Board Members Present: Brian Wade, Chairman; Eddie McCormick, Vice Chairman; Karen Hames; Richard Bambury; Debbie Morrison; Cesar Molina, Jr. and Shannon Hebb. Board Members Absent: None Staff Present: Mike Joyce, AICP, Development Services Director; Brooks Wilson, AICP, Senior Planner; Felicia Koppang, Development Services Coordinator; Gordon Scruggs, Director of Engineering and Jimmy Schnurr, City Attorney. 1.0 CALL REGULAR SESSION TO ORDER Chairman Wade called the meeting to order at 6:32 P1v1. 1.2 Citizen Input No citizen input was received. 2.0 CONSENT AGENDA 2.1 Consider approval of the minutes of the October 11, 2011 Regular Session. It was moved by Vice Chairman McCormick to approve Item 2.1, seconded by Commissioner Bambury. Motion carried (6-0-1), with Commissioner Morrison abstaining. 3.0 PUBLIC HEARINGS 3.1 S11 1-0024 - Planned Development District. Conduct a public hearing, discuss and consider making a recommendation to City Council regarding an amendment to the Code of Ordinances, Appendix A, Section 10-600, entitled "Planned Development District," by adding a new Section 10-614 providing for regulations for city-initiated planned development districts. Mrs. Wilson presented the staff report. Commissioner Hebb asked if the City has the authority to rezone private property without the agreement of the property owner or would the City consult the owner of a property prior to rezoning that property Mrs. Wilson responded the latter. She continued in stating that an example of when the city initiates a change in the zoning of a property when a property is annexed into the city, as in the recent Water's Edge annexation. That property, once annexed, is given the basic Agricultural Minutes of the Planning and Zoning Commission October 25, 2011 Page 2 of 2 Zoning and the city is initiating a zoning change to a planned development district to reflect the residential development and the home owners' association restrictions and covenants. Mr. Schnurr continued in stating that this is a clarification of the Ordinance and the City already has the authority to do this. It was moved by Commissioner Hames to approve Item 3.1 as stated, seconded by Commissioner Morrison. Motion carried (7-0). Mr. Joyce followed up in stating that the Commission will be having two meetings in November: the regularly scheduled meeting on November gth and a joint meeting with the City Council on November 15th. The joint meeting will begin at 6:00 p.m. There being no further questions or discussion, Chairman Wade adjourned the meeting at 6:37 p.m. Brian , Chairman 42k F ici Kopp Rye ding Secretary
