HomeMy WebLinkAbout10/11/2011 P&Z MINUTES CITY OF THE COLONY PLANNING AND ZONING COMMISSION OCTOBER 11, 2011 After determining that a quorum was present, the Planning and Zoning Commission of the City of The Colony, Texas convened into regular session which was held on Tuesday, October 11, 2011 at 6:30pm in the City Council Chambers located in City Hall, 6800 Main Street, The Colony, Texas, at which time the following items were addressed: Board Members Present: Brian Wade, Chairman; Eddie McCormick, Vice Chairman; Karen Hames; Richard Bambury and Shannon Hebb. Board Members Absent: Cesar Molina Jr. and Debbie Morrison Staff Present: Mike Joyce, AICP, Development Services Director; Brooks Wilson, AICP, Senior Planner; Felicia Koppang, Development Services Coordinator; Gordon Scruggs, Director of Engineering; Keri Samford, Economic Development Director; Tod Maurina, Executive Director of Operations; Tim Miller, Executive Director of Administration; Troy Powell, City Manager; Joe McCourry, Mayor and Jeff Moore, City Attorney. 1.0 CALL REGULAR SESSION TO ORDER Chairman Wade called the meeting to order at 6:31 Pm. 1.2 Citizen Input No citizen input was received. 2.0 CONSENT AGENDA 2.1 Consider approval of the minutes of the September 13, 2011 Regular Session. 2.2 FP 11-0002 - Aberdeen at Tribute, Phase 2. Consider approval of a final plat for Lots 25-31, Block A; Lots 19-31, Block C; Lots 1-30, Block D; and Lots 1-15, Block E of the Aberdeen at Tribute Addition, Phase 2, a total of 67 residential lots on 10.95 acres, located on the west side of Lebanon Road on the Tribute Peninsula. 2.3 FP 11-0003 - Balmerino at Tribute, Phase 2. Consider approval of a final plat for Lots 1-17, Block A; Lots 1-7, Block B; Lots 1-5, Block C; Lots 1-10, Block D; Lot 2A, Block D and Lot 5A, Block H of the Balmerino at Tribute Addition, Phase 2, a total of 39 residential lots on 13.55 acres, located on the east side of Lebanon Road on the Tribute Peninsula. It was moved by Commissioner Hames to approve Items 2.1, 2.2 and 2.3, seconded by Commissioner Hebb. Motion carried (5-0), with Vice Chairman McCormick abstaining from Item 2.1. Minutes of the Planning and Zoning Commission October 11, 2011 Page 2 of 3 3.0 DISCUSSION ITEM 3.1 SI I I -0018 -Tattoo Parlor Use Amendment. Discuss and review proposed ordinance to be considered by City Council regarding amendments to Section 10-100, Schedule of Uses by District, and Section 10-300, Definitions and Explanations Applicable to the Use Schedule, of Appendix A, Zoning Ordinance, to add tattoo parlors and/or body art studios to the allowed uses within the City of The Colony. Mrs. Wilson presented the staff report. Commissioner Bambury stated that he believed that the Tattoo as a Secondary Use was to have the same restrictions as a Tattoo Parlor. Mrs. Wilson responded that staff would listen to the minutes of the meeting on September 13, 2011 to verify that the final motions by the Commission are noted. 4.0 ITEMS FOR INDIVIDUAL CONSIDERATION 4.1 S11 1-0022 - 2010-2011 Planning and Zoning Commission Annual Report. Review and consider forwarding the 2010-2011 Planning and Zoning Commission Annual Report to City Council for their review. Mrs. Wilson presented the staff report. Commissioner Bambury stated that his name was not included on page 1 of the Annual Report. It was moved by Vice Chairman McCormick to approve Item 4.1 with the amendment to add Commissioner Bambury to the list of commissioners on page 1 of the Annual Report, seconded by Commissioner Bambury. Motion carried (5-0). 5.0 EXECUTIVE SESSION 5.1 The Planning and Zoning Commission shall convene into a closed executive session pursuant to Section 551.087 of the TEXAS GOVERNMENT CODE to deliberate commercial or financial information the city has received from a business prospect, and to deliberate the offer of a financial or other incentive to a business prospect, and receive legal advice from city attorney pursuant to Section 551.071 of the TEXAS GOVERNMENT CODE regarding economic development laws and possible incentives. The Planning and Zoning Commission convened into Executive Session at 6:44 p.m. The Planning and Zoning Commission reconvened into Regular Session at 7:10 with no action taken. There being no further questions or discussion, Chairman Wade adjourned the meeting at 7:11 pm.
