Home My WebLink AboutResolution No. 2011-044 CITY OF THE COLONY, TEXAS RESOLUTION NO. 2011-044 A RESOLUTION OF THE CITY OF THE COLONY, TEXAS, APPROVING EASEMENT MODIFICATION AGREEMENTS WITH ONCOR ELECTRIC DELIVERY, LLC FOR REMOVAL AND REPLACEMENT OF EXISTING ELECTRIC TRANMISSION LINES AND POLES; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENTS; PROVIDING AN EFFECTIVE DATE WHEREAS, it is the desire of Oncor Electric Delivery, LLC to remove the existing electric delivery lines and wooden poles and install improved electric delivery lines using single steel or concrete poles as supporting structures located from Squires Drive on the north, Highway 121/Market Street on the south, and from Windhaven/Josey Lane on the west, and Windhaven to Plano Parkway on the east in the City of The Colony, Texas; and, WHEREAS,, it is determined that approving the Easement Modification Agreements for the following easements is hereby in the best interest of the City of The Colony: 1. Easement #109114 2. Easement #109110 3. Easement #109349 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That the City Council of the City of The Colony, Texas hereby approves the Easement Modification Agreements with Oncor Electric Delivery, LLC for removal of the existing wooden electric delivery poles and lines, and the installation of improved electric delivery lines using single steel or concrete poles as supporting structures. Section 2. That the City Manager is hereby authorized to execute the Agreements. Section 3. That this resolution shall take effect immediately from and after its passage. Section 4. That a copy of the Agreements are attached as Exhibit A. Section 5. That a copy of the location map is attached as Exhibit B. Box 970, Fort Worth, Texas 76101-0970, successor to Texas Power & Light Company of Dallas, Texas, the right to remove the electric transmission line currently existing on the property described in the Easement and Right-of-Way and to erect, construct, reconstruct, inspect, repair, maintain, improve, operate, and remove an electric transmission line, with all necessary appurtenances, including multiple circuits and single steel or concrete poles as supporting structures, on the property described in the Easement and Right-of-Way. All other rights granted in the Easement and Right-of-Way which are not in conflict with the terms of this Easement Modification Agreement continue in full force and effect.
