CITY OF THE COLONY, TEXAS
RESOLUTION NO. 2011- +9
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, AWARDING A BID AND AUTHORIZING THE CITY
MANAGER TO EXECUTE A CONTRACT WITH MUSCO LIGHTING
FOR THE REPLACEMENT OF WOODEN LIGHT POLES ON
ATHLETIC FIELDS; PROVIDING AN EFFECTIVE DATE
WHEREAS, the City Council of the City of The Colony has determined that it is in the
best interest of the city to award a bid and enter into a contract with Musco Lighting for the
replacement of wooden light poles on athletic fields.
WHEREAS, the City of The Colony is agreeing to pay the sum of Fifty Six Thousand
Seven Hundred Seventy Six dollars ($56,776.00) for such contract.
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
THE COLONY, TEXAS THAT:
Section 1. That this proposal, having been reviewed by the City Council of the City of The
Colony, Texas, and found to be acceptable and in the best interest of the city and its citizens, be,
and the same is hereby, in all things approved in the amount of Fifty Six Thousand Seven
Hundred Seventy Six dollars ($56,776.00) and the City Manager is hereby authorized to contract
with Musco Lighting for the replacement of wooden light poles on athletic fields on behalf of the
city of The Colony, Texas.
Section 2. That this Resolution shall take effect immediately from and after its adoption and it is
so resolved.
PASSED AND APPROVED, this the 19th day of July 2011.

Quotation Price-
The fee for services rendered including: Materials, Installation, & Freight as listed by options below---
Plus applicable sales tax.
This quote does not include prevailing wage rates. It is <Sold To's> responsibility to notify Musco if
prevailing wage applies to this project and to supply Musco with the applicable wage rates. If this project is
subject to prevailing wage requirements, Musco will provide a revised quotation which includes appropriate wage
rates.
Scope of Service
Musco proposes the following service:
• Bridge Park- Tennis (2) 40' sportspoles, Baseball (1) 70' sportspole- $12,398.00
Installation by NEMA III Electric- $8,250.00
• Little League Complex- Baseball (4) 60' sportspoles- $17,035.00
Installation by NEMA III Electric- $11,000.00
• Owens Park- Baseball- (2) 60' sportpoles- $10,541.00
Installation by NEMA III Electric- $5,500.00
Total Project if done in phases- $64,724.00
Pricing if all (3) Facilities are done at the same time:
Musco sportspoles as listed above: $36,670.00
NEMA III Installation: $19,800.00
Total project: $56,776.00
In connection with the Services, Musco will provide basic services as listed above. If additional time or materials
are needed to complete the Project, Musco will obtain Customer's consent before proceeding.
Notes
• Reasonable access to poles with construction-sized lift required.
• Labor for removal / installation per proposal from NEMA III Electric is included.
• Freight is included.
Payment Terms
Payment terms net 20 days from delivery. Late payment will be subject to service charges of 1 1/2% per
month (18% APR). Any additional materials required will be charged at an additional price. In addition,
Customer shall pay and be responsible for when due all local applicable sales, use, franchise, gross receipts, or
similar taxes relating to this Agreement. If any payment is not made when due, Customer will pay a delinquent
charge of 1-1/2% for each month or portion of a month, that a past due balance remains unpaid. Customer
agrees to pay all cost (including reasonable attorney's fees and court costs) associated with collecting any
delinquent amounts due. Freight Charges have been included in the above prices. Sales tax is NOT included as
part of this quote.

Licenses and Permits
MUSCO, a non-union organization, requires Customer to arrange and secure all licenses, permits and/or
applicable labor contracts with local authorities. MUSCO shall not be held responsible for local union labor and
any permits, if required.
NonliabilitV
Before Musco enters the Property to set up its equipment under this Agreement, Customer must notify Musco of
any landscaping or surface areas that are to be avoided by Musco in setting up its equipment. Absent Musco's
negligence or willful misconduct, Musco is not, at any time or to any extent, liable, responsible or in any way
accountable for any loss, injury, death or damage to persons or property, from any cause that at any time may be
suffered or sustained by Customer, or by any person on or about the Property arising out of the entry or activities
on the Property by Musco, or any person or persons permitted on the Property by Musco.
Prices are good for acceptance and delivery for 90 days only, unless such time is extended in writing. If you have
