HomeMy WebLinkAboutOrdinance No. 2011-1899 CITY OF THE COLONY, TEXAS ORDINANCE NO. 2011-1899 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, AMENDING THE CODE OF ORDINANCES, BY AMENDING CHAPTER 2, ARTICLE II, ENTITLED "BOARDS AND COMMISSIONS," BY ADDING A NEW DIVISION 8, ENTITLED "KEEP THE COLONY BEAUTIFUL;" ESTABLISHING THE COMPOSITION, QUALIFICATIONS, DUTIES AND RESPONSIBILITIES OF KEEP THE COLONY BEAUTIFUL BOARD; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of The Colony, Texas, finds and determines it is in the best interest of the City to establish the Keep The Colony Beautiful Board for the purpose of advising, assisting, sponsoring, and promoting activities that bolster beautification efforts throughout the City of The Colony, Texas. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That the findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2. That the Code of Ordinances of the City of The Colony, Texas be, and the same is, hereby amended by amending Chapter 2, Article II, entitled "Boards and Commissions", by adding a new division 8, entitled "Keep The Colony Beautiful Board," which shall read as follows: "DIVISION 8. KEEP THE COLONY BEAUTIFUL BOARD Sec. 2-295. Advisory board created; purpose. There is hereby created the Keep The Colony Beautiful advisory board. The board shall act in an advisory capacity to the city council with respect to matters concerning regulations for adoption by the city council and recommendations for beautification efforts throughout the city. Sec. 2-296. Composition; qualifications. The board shall consist of the seven (7) members of the community image advisory board. Members shall be persons who have a diverse interest in and knowledge about the city, business and various familiarities with the Code of Ordinances. Sec. 2-297. Duties, operational rules and procedures. The board shall have the following powers and perform the following duties. (1) To advise and assist the city council in activities related to Keep The Colony Beautiful, including the sponsoring and promotion of activities that bolster beautification efforts throughout the city; i (2) To advise and assist the city council in activities related to the neighborhood partnership, including the review of grant applications; (3) To assist city administration and city council in reducing litter and associated problems; (4) To detern-iine and recommend to the city council and the city administration program priorities on a city-wide basis; (5) To recommend enforcement and additional program alternatives; and (6) To carry out such other tasks as the city council and city administration may designate. Secs. 2-298 - 2.300. Reserved." SECTION 3. If any section, article paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any persons or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. SECTION 4. That all provisions of the Ordinances of the City of The Colony, Texas, in conflict with the provisions of this ordinance be, and the same are hereby amended, repealed, and all other provisions of the Ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 5. This Ordinance shall become effective from and after its date of passage in accordance with law.
