HomeMy WebLinkAboutResolution No. 2011-032 CITY OF THE COLONY, TEXAS RESOLUTION NO. 2011- A RESOLUTION OF THE CITY OF THE COLONY, TEXAS, APPROVING THE GUARANTEED MAXIMUM PRICE OF A CONSTRUCTION SERVICES CONTRACT BY AND BETWEEN THE CITY OF THE COLONY AND POGUE CONSTRUCTION, WHICH IS ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO EXECUTE SAID CONTRACT; PROVIDING AN EFFECTIVE DATE WHEREAS, on November 16, 2010 the City Council of the City of The Colony, Texas authorized city staff to proceed with contract negotiations with Pogue Construction for Construction Manager at Risk services for the Public Services Complex; and, WHEREAS, the City Council has determined that it is in the best interest of the citizens to execute a contract with Pogue Construction establishing the Guaranteed Maximum Price of $2,364,762.00 with a contingency of $31,981.00 for construction of the Public Services Complex, which is attached hereto and incorporated herein as Exhibit "A„ NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, THAT: Section 1. The City Council of the City of The Colony, Texas hereby approves the Guaranteed Maximum Price of $2,364,762.00 with a contingency amount of $31,981.00 for the Public Services Complex. Section 2. The City Manager is authorized to execute a contract with Pogue Construction establishing the Guaranteed Maximum Price of $2,364,762.00 with a contingency of $31,981.00 for construction of the Public Services Complex, which is attached hereto and incorporated herein as Exhibit "A". Section 3. This resolution shall take effect immediately from and after its passage.
