RESOLUTION NO. 2011- CSC A
A RESOLUTION OF THE CITY OF THE COLONY, TEXAS,
REPEALING RESOLUTION NUMBER 08-105 IN ITS ENTIRETY,
CONCERNING THE LAKESIDE ARTS CENTER USE POLICY;
AUTHORIZING THE CITY MANAGER AND OR HIS DESIGNEE
TO SCHEDULE THE USE OF THE LAKESIDE ARTS CENTER
BUILDING; AND PROVIDING FOR AN IMMEDIATE
EFFECTIVE DATE.
WHEREAS, it is the desire of the City Council of the City of The Colony,
Texas, to provide direction as to the use of the Lakeside Arts Center building located at
6301B Main Street, The Colony, Texas; and
WHEREAS, on November 3, 2008, the City Council of the City of The Colony,
Texas, approved Resolution No. 08-105, which approved a Lakeside Arts Center Use
Policy; and
WHEREAS, City Council of the City of The Colony, Texas, finds and
determines that the use policy adopted in 2008 is in need of updating to ensure that all
uses of the Lakeside Arts Center are according to the City Council's desires.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF THE COLONY, TEXAS:
Section 1. That the findings set forth above are incorporated into the body of
this Resolution as if frilly set forth herein.
Section 2. That the City Council of the City of The Colony, Texas, does
hereby repeal in its entirety Resolution No. 08-105 concerning the Lakeside Arts Center
Use Policy, a copy of which is attached hereto as Exhibit A.
Section 3. That the City Council of the City of The Colony, Texas, does
hereby authorize the City Manager or his designee to schedule the use of the Lakeside
Arts Center building, located at 6301B Main Street, The Colony, Texas.
Section 4. That this Resolution shall take effect immediately from and after
its passage.
PASSED AND APPROVED by the City Council of the City of The Colony,
Texas, this the 4th day of January, 2011.

Lakeside Arts Center Use Policy
Amended November 2008
The Lakeside Arts Center (LAC) is provided primarily for arts-related activities and is administered
by the City of The Colony Cultural Arts Board (CAB). City of The Colony CAB activities have first
priority in scheduling of the Lakeside Arts Center.
1. USE BY OTHER GROUPS
A. Use of the LAC may be granted through a license agreement approved by CAB for cultural, art
and education-related activities which are not primarily profit-making, social, or religious
activities in their purpose.
Profit-making organizations sponsoring an educational program of a non-profit nature will be
permitted to use the LAC provided the programs are open to the public.
B. The CAB reserves the right and shall make the final determination whether a proposed use of
facilities is appropriate.
C. Attendance of such activities cannot be limited and must be open to the public regardless to
race, sex, religion, national origin, political affiliation, or disabilities.
D. Attendance is limited by the capacity requirements of local and state law.
E. License for use of such facility shall not, in any way, constitute an endorsement of the group,
its policies or activities by the CAB or by the City of The Colony.
F. The City Council authorizes use of the LAC by the organizations listed in Attachment A,
subject to scheduling by the Cultural Arts Board
II. APPLICATION FOR USE
A. Requests for use of the facility must be made by submitting a form to the CAB staff liaison.
Forms are available at The Colony Public Library. Forms are to be submitted at least eight (8)
calendar days prior to a scheduled CAB meeting, but no more than one year in advance of the
requested reservation. Please inquire about available times before proceeding with the
reservation request process.
1. The request must be made by an adult (18 years of age or over).
2. An application form shall be completed by the individual reserving the LAC, stating:
the name of the organization; the date, time, and purpose of the activity; the name and
phone number of the individual reserving the LAC; and the maximum number of
persons expected to attend.
B. No group shall assign its space or reservation to another group.

III. CANCELLATIONS
Notice of cancellation of an activity should be made to the CAB staff liaison as soon as possible,
but no later than 24 hours prior to the scheduled use.
IV. SCHEDULE
A. The LAC is available for use during the times agreed upon by the requester and the CAB.
Any change to predetermined schedule need to be agreed upon at least 72-hours in advance of
scheduled use with the CAB staff liaison.
B. Activities are scheduled with at least one half hour between the end of one activity and the
beginning of another. Exceptions will be made for activities requiring extended time for break
down, although this time will be accounted for as part of the reservation request.
C. The LAC may be used by The City of The Colony on the second Saturday of each May as a
polling location for city and Lewisville Independent School District elections, any other
government function, official election or any other government purposes This may stand as a
permanent reservation that has automatic priority over all other requests.
V. CHARGES
There are no fees required to license the facilities.
VI. PUBLICITY
A. The CAB does not handle publicity.
B. Copies of any publicity materials should be furnished to the CAB staff liaison.
C. In the event publicity concerning the activity is circulated which lists the LAC as the location,
this disclaimer must be included: "This event is not sponsored by The City of the Colony."
VII. FACILITIES
A. Comply with posted rules as adopted by The Colony City Council and/or City Manager.
B. Groups using the facility may bring a storage unit no larger than 6 (six) feet tall, 3 (three) feet
wide and 18 (eighteen) inches deep to use. Any unit or equipment larger than the specified
dimensions to be stored on site must be brought before the CAB for approval.
IX. SALES
Casual sales held in connection with an approved license granted under this policy are permitted.

X. SET UP / CLEAN UP
A. The CAB is not responsible for arranging furniture before or after activities.
1. No physical changes may be made in the LAC except for the rearrangement of
furniture. Items on display may not be disturbed without approval of the CAB.
2. The LAC must be left in its original condition and clear of trash and personal
belongings. Failure to do so may result in denial of future use.
B. Programs which may be hazardous to the LAC are not allowed.
XI. CLIMATE CONTROL
All thermostat settings will be left at 70°F in colder months and 78°F in warmer months when the
building is unoccupied.
XII. RESPONSIBILITY FOR EQUIPMENT AND DAMAGES
The individual signing the reservation form is responsible for any damage to the LAC or its
contents.
A. This individual or his or her representative must be present at the time of the agreed use.
B. Equipment may not be removed from the LAC without prior approval from the CAB.
C. Those leaving equipment at the LAC do so at their own risk.
D. Permission is required from the CAB for use of sound and lighting equipment. This
equipment is for use as-is.
E. Damaged equipment should be reported immediately to the staff liaison of the CAB.
F. Misuse of the facilities may result in denial of future use.
XIII. YOUTH OR CHILDREN'S ACTIVITIES
Youth or children's activities must be supervised by no less than one adult per 10 children
(persons under 18).
XIV. LIABILITY
A. The individual who signs the request-for-use application shall be responsible for any and all
loss, accident, neglect, injury or damage to person, life or property which may be the result of
or may be caused by the group's occupancy of the facility or premises.
B. Equipment, supplies or personal effects may not be stored or left in the LAC after agreement
period is over. Such equipment, etc., if left, is subject to being sold at public auction in
accordance with City of The Colony Ordinance No. 63.
XV. NON-PUBLIC AREAS OF THE LAC

Groups (or individuals from the group) shall not be permitted in the non-public areas of the LAC
(storage areas, work areas, offices, etc.).
XVL CAB MEMBER PRESENCE
The CAB reserves the right to have a member of CAB in attendance at any activity held within the
LAC.
XVII. REVOCATION OF PRIVILEGES
Failure to comply with any rule or regulation contained in this policy may result in loss of
privilege to use the facilities and may also result in other action deemed appropriate by the CAB
or the City of The Colony.
XVIII. EXCEPTIONS TO POLICY
A. Requests for exceptions to this policy must be submitted to the CAB staff liaison in writing at
least 30 days prior to the requested usage. Consideration of and subsequent decisions to such
requests shall be made by the CAB.
B. An unfavorable decision may be appealed to the CAB, City Manager, and finally to the City
Council.
