AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, ESTABLISHING A COMMUNITY IMAGE
DEPARTMENT; ESTABLISHING THE DUTIES AND
RESPONSIBILITIES OF THE COMMUNITY IMAGE DEPARTMENT;
ESTABLISHING THE DUTIES AND RESPONSIBILITIES OF THE
DIRECTOR OF THE COMMUNITY IMAGE DEPARTMENT;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALER
CLAUSE; AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE.
WHEREAS, Section 3.07 of the City of The Colony, Texas, Home-Rule Charter provides
that "[t]here shall be such administrative departments as may be established by the council. The
council may establish the duties and responsibilities of each such department. The council may
combine one or more departments created by it and may assign or transfer duties of any
department of the city from one department to another, or create additional departments;" and
WHEREAS, the City Council of the City of The Colony, Texas, finds and determines it
is in the best interest of the City of The Colony, Texas, to establish a Community Image
Department, and to establish the duties and responsibilities of said department.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS:
SECTION 1. The findings set forth above are incorporated into the body of this Ordinance
as if fully set forth herein.
SECTION 2. Pursuant to Section 3.07 of the City of The Colony, Texas, Home-Rule
Charter, there is hereby established a Community Image Department within the City of The Colony,
Texas. The Department shall combine the duties of the Code Enforcement Official and other
such duties as may be assigned the Director of Community Image Department, and said
Department by the City Manager.
SECTION 3. The Director of the Community Image Department shall have the following
responsibilities:
(1) Shall be the Chief Code Enforcement Official for the City for the following items:
(a) the enforcement of any public nuisances within the City, including, tall grass
and weed violations; and abandoned and junked vehicles;
(b) any public health inspections within the City, including, the inspection of
food establishments, and public swimming pools;
(c) the enforcement of the City's sign ordinance; and
(d) the enforcement of the City's rental property registration and inspection
program.
(2) Shall perform such other duties as may be assigned to the Community Image
Department by the City Manager.
SECTION 4. If any section, article paragraph, sentence, clause, phrase or word in this
ordinance, or application thereto any persons or circumstances is held invalid or unconstitutional by
a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions
of this ordinance; and the City Council hereby declares it would have passed such remaining
portions of this Ordinance despite such invalidity, which remaining portions shall remain in full
force and effect.
SECTION 5. That all provisions of the Ordinances of the City of The Colony, Texas, in
conflict with the provisions of this ordinance be, and the same are hereby amended, repealed, and all
other provisions of the Ordinances of the City not in conflict with the provisions of this ordinance
shall remain in full force and effect.
SECTION 6. This Ordinance shall become effective from and after its date of passage in
accordance with law.
