RESOLUTION NO. 2010-077
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, DESIGNATING A PUBLIC INFORMATION
OFFICER FOR THE PURPOSES OF RECEIVING FAXED AND E-
MAILED PUBLIC INFORMATION ACT REQUESTS; DESIGNATING A
PLBLIC INFORMATION COORDINATOR FOR THE PURPOSES OF
RECEIVING TRAINING ON THE RESPONSIBILITIES OF THE PUBLIC
INFORMATION ACT FOR THE CITY OF THE COLONY, TEXAS; AND
PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE.
WHEREAS, the Public Information Act, as codified in the Texas Government Code,
Chapter 552, is the basis for the policy of open government, providing uniformity for citizens'
right to access public records; and,
WHEREAS, Section 552.301 of the Texas Government Code provides that the City of
The Colony, Texas, may designate a public information officer for the purposes of receiving
faxed or e-mailed public information requests; and
WHEREAS, the City Secretary, may receive faxed and emailed Public Information Act
requests; and
WHEREAS, Section 552.012 of the Texas Government Code requires public officials
and/or the public information officer to complete one (1) to two (2) hours of training on the
Public Information Act; and
WHEREAS, Section 552.012(c) of the Texas Government Code also provides that a
public official may designate a public information coordinator to satisfy the Public Information
Act training requirements for the public official if the public information coordinator is primarily
responsible for administering the responsibilities of the public official or governmental body
under the Public Information Act.
WHEREAS, the City Secretary is primarily responsible for administering the
responsibilities of the City Council regarding the Public Information Act; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY, TEXAS:
Section 1. That the foregoing recitals are hereby found to be true and correct legislative
findings of the City of The Colony, Texas, and are fully incorporated into the body of this
Resolution.
Section 2. That the City Secretary, is hereby designated as the public information officer for
the purposes of receiving faxed or e-mailed public information requests.
Section 3. That the City Secretary is hereby designated as the public information coordinator
for the purposes of receiving training on the responsibilities of the Public Information Act,
Chapter 552 of the Texas Government Code for the City of The Colony, Texas, and its boards
and commissions who are subject to the Public Information Act.
Section 4. This Resolution shall become effective from and after its passage.
DULY RESOLVED by the City Council of the City of The Colony, Texas, on this the
7th day of September, 2010.
