AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING ORDINANCE
NUMBER 9, SECTION 1, BY ADOPTING THE UNIFORM FIRE CODE, 1979 EDITION;
REPEALING SECTION 1 OF ORDINANCE NUMBER 60; ADOPTING THE UNIFORM PLUMBING
CODE, 1979 EDITION, OF THE INTERNATIONAL ASSOCIATION OF PLUMBING AND
MECHANICAL OFFICIALS; REPEALING SECTION 3 OF ORDINANCE NUMBER 60;
ADOPTING THE UNIFORM MECHANICAL CODE, 1979 EDITION, OF THE INTERNATIONAL
ASSOCIATION OF PLUMBING AND MECHANICAL OFFICIALS; AMENDING SECTION 4 OF
ORDINANCE NUMBER 60 BY PROVIDING FOR PERMIT AND INSPECTION FEES FOR
ELECTRICAL WORK; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY
OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH
OFFENSE; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS:
SECTION 1. That Ordinance Number 9, Section 1, of the City of The
Colony be, and the same is hereby, amended to read as follows:
"Section 1. Adoption of the Uniform Fire Code.
There is hereby adopted by the City Council of the City of The
Colony, Denton County, Texas, for the purpose of prescribing regula-
tions governing conditions hazardous to life and property from fire
or explosion, that certain Code known as the Uniform Fire Code,
recommended by the Western Fire Chiefs' Association and the Interna-
tional Conference of Building Officials, 1979 Edition, save and
except such portions as are hereinafter deleted, modified or
amended. Said Code is attached hereto as Exhibit "A" and made a
part hereof for all purposes the same as if fully set out at length
herein. A true and correct copy of such Code as amended hereby
shall be on file in the office of the City Secretary and available
for inspection by any person at any time during regular business
hours."
SECTION 2. That Section 1 of Ordinance Number 60 of the City of
The Colony is hereby repealed. That the Uniform Plumbing Code, 1979
Edition, of the International Association of Plumbing and Mechanical
Officials, is hereby adopted as the Plumbing Code of the City of The
Colony. A true copy of the Code is attached hereto as Exhibit "B" and
made a part hereof for all purposes. Additional copies shall be .
available in the office o the City Secretary for inspection by any
person at any time during regular business hours.
SECTION 3. That Section 3 of Ordinance Number 60 of the City of
The Colony is hereby repe led. That the Uniform Mechanical Code, 1979
Edition, of the International Association of Plumbing and Mechanical
Officials, is hereby adopted as the Mechanical Code of the City of The
Colony. A true copy of the Code is attached hereto as Exhibit "C" and
made a part hereof for all. purposes. Additional copies shall be availa-
ble in the office of the ity Secretary for inspection by any person at
any time during regular b siness hours.
SECTION 4. That the fees for electrical permits and inspections for
construction within the City of The Colony shall be as set out below.
All permits shall include three (3) inspections of the work performed
under such permit. All reinspections in excess of the three (3) original
inspections will be charged to the permit holder at Ten Dollars ($10.00)
for each inspection. Should any electrical work be commenced for which
a permit is required under the provisions of the National Electrical Code
without a permit having been obtained, the applicant will be charged twice
the fee set forth hereafter. Such permit fees shall be as follows:

SECTION 5. Should any section, paragraph, sentence, clause or
phrase of this ordinance be held invalid or unconstitutional for any
reason, such holding shall not affect the remaining portions of this
ordinance, which are declared to be severable.
SECTION 6. Any person, firm or corporation violating any of the
provisions of this ordinance or of the Codes adopted hereby, shall be
deemed guilty of a misdemeanor, and, upon conviction in the Municipal
Court of the City of The Colony, Texas, shall be fined in an amount not
to exceed the sum of Two Hundred Dollars ($200.00) for each offense
and each and every day any such offense shall continue shall be deemed
to constitute a separate offense.
SECTION 7. This ordinance shall take effect immediately from and
after its passage and the publication of the caption as the law and
charter in such cases provide.
