AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF.THE CITY OF THE COLONY SO AS TO CHANGE THE PROPERTY DESCRIBED AS 2.00 ACRES OF LAND OUT OF THE BBB & CRR COMPANY SURVEY, ABSTRACT 172, DENTON COUNTY, TEXAS AND BEING THE SAME PROPERTY CONVEYED TO J. Y. EBERHART AND VERA M. EBERHART BY DEED DATED FEBRUARY 21, 1978, RECORDED IN VOLUME 876, PAGE 25, OF THE DEED RECORDS OF DENTON COUNTY, TEXAS TO "GR" GENERAL RETAIL DISTRICT CLASSIFICATION; PROVIDING FOR SPECIAL CONDITIONS;,PROVIDING FOR THE AMENDMENT OF THE ZONING DISTRICT MAP; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission of the City of The Colony, and the City Council of the City of The Colony, in compliance with the laws of the State of Texas, and with the provisions of the Comprehensive Zoning Ordinance of the City of The Colony, have given requisite notices by publication and otherwise and have held due hearings and afforded a full and fair hearing to all property owners generally and to the persons interested and situated in the affected area and in the vicinity thereof, and after such hearings, the City Council of the City of The Colony has reached the conclusion that the zoning change requested should be granted, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That the Comprehensive Zoning Ordinance of the City of The Colony, Texas, be and the same is hereby, amended by amending the Zoning District Map of the City of The Colony so as to change the following described property to "GR" General Retail District Classification. That said property is described as follows, to -wit: All that certain lot, tract or parcel of land lying and being situated in the City of The Colony, County of Denton, State of Texas, and being a part of a certain First Tract of 156.5 acres of land conveyed by deed dated September 7, 1950, from John A. Griffin and wife, Jennie Griffin, to John A. Griffin, Jr. and wife, Dorothy Griffin, Trustees, as shown of record in Vol. 375, Page,256, of the. Deed Records of Denton County, Texas; being out of the BBB & CRR Company Survey, A-172, and being more particularly described as follows: BEGINNING at a fence corner post in the West Boundary Line of the past mentioned First Tract of 156.5 acres of land, and being in the North Boundary Line of an East and West public road whose width is 40 feet; said point of beginning also being 20 feet North of the Southwest Corner of the past mentioned First Tract, and being 20 feet North of the Southwest Corner of the past mentioned First Tract, and being 20 feet North of the Southwest Corner of the BBB & CRR Company Survey, A-172; THENCE North along the West boundary Line of the above mentioned First Tract, and along existing fenceline, 295.19 feet, to a steel pin for the Northwest Corner of tract herein described; THENCE South 89 deg. 10' East, and parallel to the South Boundary Line of said 156.5 acre tract, 295.19 feet, to a steel pin for corner; THENCE South, and parallel to the West Boundary Line of said 156.5 acre tract, 295.19 feet, to a steel pin for corner in the North Boundary Line.of the past mentioned East and West public road; THENCE North 89 deg. 10' West, and being 20 feet North of and parallel to the South Boundary Line of said 156.5 acre tract, same being along the North Boundary Line of public road, 295.19 feet, to point of beginning, and containing 2.00 acres of land. SECTION 2. That the herein described property shall be used only in the manner and for the purposes provided by the Comprehensive Zoning Ordinance of the City.of The Colony as amended herein; subject to the following special condition; prior to the issuance of any building permit for any building on the property described herein the developer or owner or applicant for a building permit shall appear before the City Council for approval of the proposed final site plan. SECTION 3. That all ordinances of the City of The Colony in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other provisions of the ordinances of the City of The Colony not in conflict with the provisions of this ordi- nance shall remain in full force and effect. SECTION 4. Should any section, paragraph, sentence, clause or phrase of this ordinance be declared or be determined unconstitu- tional, such declaration or holding shall not effect the remaining portions of this ordinance, which are declared to be severable. SECTION 5. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City of,The Colony, and, upon conviction in the Municipal Court of the City of The Colony shall be punished by a fine not to exceed the sum of Two Hundred Dollars ($200.00) for each offense„ and each and 'every -day such offense shall continue shall be deemed to constitute a separate offense. SECTION 6. This ordinance shall take effect immediately from and after its passage and the publication of the caption as the law and charter in such cases provide. THIS 0 _INANCE WAS IN AN OPEN MEETING OF THE CITY COUNCIL ON THE DAY OF 1980. THIS DICE WAS DULY PASSED ON SECOND READING ON THE DAY OF 1980.
