AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF THE COLONY SO.AS 'TO CHANGE THE PROPERTY DESCRIBED AS A 1.838 ACRE TRACT OF LAND AT THE CORNER OF 'PAIGE ROAD AND KISOR DRIVE TO OFFICE DISTRICT ONE CLAS- STFICATION; PROVIDING FOR THE AMENDMENT OF THE ZONING DISTRICT MAP; PROVIDING FOR SPECIAL CONDITIONS; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission of the City of The Colony, and the City Council of the City of The Colony, in compli- ance with the laws of the State of Texas, and with the provisions of the Comprehensive Zoning Ordinance of the City of The Colony, have given requisite notices by publication and otherwise and have held due hearings and afforded a full and fair hearing to all property owners generally and to the persons interested and situated in the affected area and in the vicinity thereof, and after such hearings, the City Council of the City of The Colony has reached the conclu- sion that the zoning change requested should be granted, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That the Comprehensive Zoning Ordinance of the City of The Colony, Texas, be and the same is hereby, amended by amending the Zoning District Map of the City of The Colony so as to change the following described property to "0-1" Office District One Classification. That said property is described as follows, to -wit: Being a tract of land situated in The City of The Colony, Denton County, Texas and being part of The Colony No. 11, an addition to Denton County, Texas as recorded in Vol. 14, Page 41, Records of Denton County, Texas and being more particularly described as follows: BEGINNING at the intersection of the west line of Paige Road (100' R.O.W.) and the south line of Kisor Drive (50' R.O.W.); THENCE in a southerly direction with a curve to the left, said curve having a central angle of 16 deg. 28' 0311, a radius of 579.42 and a chord bearing of S 07 deg. 56' 07" W, for; an .arc. distance of 166.53 feet; THENCE S 0 deg. 17' 55" E, 58.31 feet THENCE S 89 deg. 42' 05" W, 346.49 feet; THENCE N 25 deg. 21' 06" E, 360.90 feet; THENCE S 64 deg. 38' 54" E, 237.43 feet to the Place of Beginning,and containing 1.838 acres of land. SECTION 2. That the herein described property shall be used only in the manner and for the purposes provided by the Comprehen- sive Zoning Ordinance of the City of The Colony as amended herein, subject to the following special condition: Prior to the issuance of any building permit for any building on the property described herein the developer or owner or applicant for a building permit shall appear before the City Council for approval of the proposed final site plan. SECTION 3. That all ordinances of the City of The Colony in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other provisions of the ordinances of the City of The Colony not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 4. Should -any section, paragraph, sentence, clause or phrase of this ordinance be declared or be determined uncon- stitutional, such declaration or holding shall not effect the remaining portions of this ordinance, which are declared to be severable. SECTION 5. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City of The Colony, and, upon conviction in the Municipal Court of the City of The Colony shall be punished by a fine not to exceed the sum of Two Hundred Dollars ($200.00) for each offense, and each and every day such offense shall continue shall be deemed to constitute a separate offense. SECTION 6. This ordinance shall take effect immediately from and after its passage and the publication of the caption as the law and charter in such cases provide. THIS ORDINANCE WAS READ IN OPEN MEETING OF THE CITY COUNCIL ON THE DAY OF 1980. THIS ORDINANCE WAS DULY PASSED ON SECOND READING ON THEgih( DAY OF 1980. APPROVED: MAYOR T m m P.
