OF THE COLONY, TEXAS, ADOPTING THE UNIFORM BUILDING CODE, 1979 EDITION, OF THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS; REPEALING ORDINANCE NUMBER 21 AND ALL OTHER. ORDINANCES IN CONFLICT; PROVIDING INSPECTION FEES FOR: SINGLE-FAMILY RESIDENCES; PROVIDING THAT INSPECTION FEES MAY BE CHANGED BY RESOLUTION OF THE CITY COUNCIL; PROVIDING FOR. A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; PROVIDINC A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE, TEXAS: BE FT'ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY SECTION 1. That the Uniform Building Code, 1979 Edition, of the International Conference of Building Officials, is hereby adopted by reference as the Building Corle of the City of The Colony, Texas, with the amendments hereafter specified. Said 1979 Edition of the Uniform Building Code is made a part hereof for all purposes and attached hereto as Exhibit "A". A true and correct copy of said Uniform Building Code shall be kept in the Office of the City Secretary and be made available for inspection during regular business hours. SECTION 2. The permit and inspection fees provided in Chapter 3 shall be applicable to all construction or work except Single -Family Residential construction. There shall be a flat inspection and permit fee for Single Family Residential construction of Two Hundred and Fifty Dollars ($250.00) per unit. Sucb fee and the other fees provided in Chapter 3 of the Code may hereafter be adjusted from time to time by resolution of the City Council of the City of The Colony. SECTION 3. Ordinance Number 21 and all ordinances in conflict with the provisions of this ordinance are hereby repealed. r SECTION 4. Section 205 of the 1979 Edition of the Uniform Building Code is amended to provide for a fine of not more than Two Hundred Dollars ($200.00) for each and every day or portion thereof during which any violation of any of the provisions of the Code is committed, continued, or permitted. Section 205 is further amended to delete any reference to imprisonment or fine and imprisonment. SECTION 5. If any section, subsection, sentence, clause, or phrase of this ordinance or of the Uniform Building Code, 1979 Edition, as adopted, is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance or of the Uniform Building, Code, 1979 Edition, as adopted, and the provisions of this ordinance and of. the 1979 Edition of the Uniform Building Code are hereby declared to be severable. SECTION 6. This ordinance shall take effect from and after its passage and publication of the caption as the law and charter in such cases provides.
