HomeMy WebLinkAboutOrdinance No. 07-1733CITY OF THE COLONY, TEXAS ORDINANCE NO. 07- .-7 3.3 AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS AMENDING CHAPTER 19 TRAFFIC OF THE CODE OF ORDINANCES BY AMENDING SECTION 19-10 SPEED LIMITS - GENERALLY; BY AMENDING SECTION 19-10 (b) RELATING TO SPEED LIMITS ON PAIGE ROAD BETWEEN AVERY LANE AND NORTH COLONY BOULEVARD; PROVIDING FOR A PENALTY OF A FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE OR11GINA WHEREAS, the safety and welfare of the citizens of The Colony is always of the highest priority; WHEREAS, it is anticipated that the construction on Paige Road between Avery Lane and North Colony Boulevard will continue for a period of at least one year; and WHEREAS, it is the recommendation of the Police Chief, City Engineer and Public Works Director that the speed limits on Paige Road be lowered for the duration of the construction period. WHEREAS, after due deliberations and consideration the City Council of the City of The Colony finds it is in the public interest to amend Chapter 19 of the Code of Ordinances to establish the maximum prima facie speed limit for Paige Road from its intersecting point with North Colony Boulevard to its intersecting point with Avery Lane, as more fully described herein, in the City and further finds that such regulations will promote the health, safety and general welfare of the city; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That Chapter 19, Traffic, subsection 19-10(b) of the Code of Ordinances be, and the same is hereby amended, to establish the maximum prima facie speed limit for Paige Road, which shall read as follows: "Section 19-10. Speed limits —Generally. (a)..... (b)..... Street Extent Speed (mph) Paige Road From its intersecting point 25 with North Colony Boulevard to its intersecting point with Avery Lane Paige Road " Section 2. That the Traffic Administrator shall cause to be erected appropriate signage giving notice of the speed limits established herein. Section 3. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be subject to a fine in accordance with the general provisions of the Code of Ordinances. Section 4. If any section or provision of this ordinance, or application of that section or provision to any person, firm, corporation, situation or circumstance is for any reason judged invalid, the adjudication shall not affect any other section or provision of this ordinance or the application of any other section or provision to any other person, firm, corporation, situation or circumstance, and the City Council declares that it would have adopted the valid portions of the Ordinance without the invalid parts and to this end the provisions of this ordinance shall remain in full force and effect. Section 5. That this ordinance shall take effect immediately from and after its passage and the publication of the caption, as the law and charter in such cases provide; however the speed limit established herein shall not take effect until the appropriate signage giving notice of such speed limit has been erected.
