ORDINANCE NO. 07-1744
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, AMENDING THE CODE OF ORDINANCES BY
AMENDING CHAPTER 16, ARTICLE I, BY REPEALING AND
RESERVING FOR FUTURE USE SECTION 16-5, "CHIEF OF
POLICE; APPOINTMENT; TERM," AND BY ADDING A NEW
ARTICLE IV, "POLICE DEPARTMENT"; PROVIDING FOR THE
ESTABLISHMENT; PROVIDING FOR THE CHIEF OF
POLICE; PROVIDING FOR MEMBERS; PROVIDING FOR
DEPARTMENT RULES; PROVIDING FOR THE DUTY OF
POLICE DEPARTMENT; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Chapter 16, Article I, Section 16-5 of the Code of Ordinances
currently provides for the appointment of the Chief of Police; and
WHEREAS, the City Council desires to amend Chapter 16 by repealing Section
16-5 of Article I in its entirety and by adding Article IV, Police Department, to provide
for the establishment of the Police Department as provided herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY, TEXAS:
SECTION 1. That the Code of Ordinances be, and the same is, hereby amended by
amending Chapter 16, Article I, by repealing and reserving for future use Section 16-5,
"Chief of police; appointment; term," and by adding a new Article IV, "POLICE
DEPARTMENT", which shall read as follows:
"ARTICLE I. IN GENERAL
Sec. 16-5. Reserved for future use.
Secs. 16-44 -16-49. Reserved.
ARTICLE IV. POLICE DEPARTMENT
Sec. 16-50. Establishment of police department.
There shall be a police department for the City of The Colony, the head of
which shall be a chief of police.
Sec. 16-51. Chief of police.
The chief of police of the City of The Colony shall be appointed and serve
at the pleasure of the City Manager.
Sec. 16-52. Members.
The police department shall be composed of the chief of police and such
other officers, patrolmen and other employees as may from time to time be
authorized and appointed under the authority of the City Manager.
Sec. 16-53. Department rules.
The chief of police shall be authorized to establish rules and regulations
governing the policies and personnel of the police department.
Sec. 16-54. Duty of police department.
It shall be the duty of the police department to enforce the ordinances of
the City of The Colony, the state laws, and any other laws subject to
enforcement."
SECTION 2. If any section, article paragraph, sentence, clause, phrase or word in this
ordinance, or application thereto any persons or circumstances is held invalid or unconstitutional by
a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions
of this ordinance; and the City Council hereby declares it would have passed such remaining
portions of this Ordinance despite such invalidity, which remaining portions shall remain in full
force and effect.
SECTION 3. That all provisions of the Ordinances of the City of The Colony, Texas, in
conflict with the provisions of this ordinance be, and the same are hereby amended, repealed, and all
other provisions of the Ordinances of the City not in conflict with the provisions of this ordinance
shall remain in full force and effect.
SECTION 4. This Ordinance shall become effective from and after its date of passage in
accordance with law.
