HomeMy WebLinkAbout07/14/09 P&Z MINUTES CITY OF THE COLONY PLANNING AND ZONING COMMISSION JULY 14, 2009 After determining that a quorum was present, the Planning and Zoning Commission of the City of The Colony, Texas convened into regular session which was held on Tuesday July 14. 2009 at 6:30 p.m. in the City Council Chambers located in City Hall, 6800 Main Street, The Colony, Texas, at which time the following items were addressed: Commissioners Present: Karen Hames; Deville Hubbard; Eddie McCormick; David Terre; and Brian Wade. Commissioners Absent: Debbie Morrison; Helene Parker Staff Present: Wes Morrison, City Planner; Ron Hartline; Senior Engineer; and Tracey Sherman, Administrative Assistant. 1.0 CALL REGULAR SESSION TO ORDER Chairperson Hames called the meeting to order at 6:30 pm. 1.1 Citizen Input No citizen input received. 2.0 CONSENT AGENDA 2.1 Consider approval of the minutes of the June 23, 2009 Regular Session. It was moved by Commissioner Wade to approve the Consent Agenda, seconded by Commissioner McCormick and carried (4-0). Commissioners Hames abstained. Due to an oversight by staff, the Commission needs to approve the minutes of June 23, 2009 again. 3.0 PUBLIC HEARING 3.1 Conduct a public hearing, discuss, and consider making a recommendation to City Council regarding an amendment to ordinance # 09-1802 to add and include approximately 40.29 acres by rezoning the subject property from Agricultural to Planned Development. The property is located north of Lebanon Road and west of FM423. (Z09, 0006, Tribute North - 40.29 Acres Mr. Morrison present the staff report. Commissioner Terre asked if the property backs up to the Army Corp of Engineers property. Mr. Morrison stated yes. Planning and Zoning Commission July 14, 2009 Page 2 of 3 Commissioner Wade asked why was the portion located north of Lebanon Road and west of FM423 not included in the original PD23. Mr. Morrison stated the property was not located in the city limits; therefore they didn't have the authority to zone the property. It was moved by Commissioner Terre to approve Item 3.1 as stated seconded by Commissioner Wade and unanimously carried (5-0). 3.2 Conduct a public hearing, discuss, and consider making a recommendation to City Council regarding an amendment to ordinance # 09-1802 to add and include approximately 4.872 acres by rezoning the subject property from Agricultural to Planned Development. The property is located north of Lebanon Road and west of FM423. (Z09-0007, Tribute North - 4.87 Acres) Mr. Morrison presented the staff report. It was moved by Commissioner Wade to approve Item 3.2 as stated seconded by Commissioner Hames and unanimously carried (5-0). 3.3 Conduct a public hearing, discuss, and consider making a recommendation to City Council regarding an amendment to the Comprehensive Plan adopted under Ordinance No. 07-1773, to modify the provisions related to The Colony Transportation System. (SI09-0007, Comp Plan Amendment - Public Transit) Mr. Morrison presented the staff report. Commissioner Wade asked about the specific locations of the transit centers. Mr. Morrison stated the Council of Governments studies identified anywhere between 121 and Memorial Drive. Chairman Haines asked if the owner of the rail lines and Council of Governments had a good working relationship. Mr. Morrison stated they have worked together in the past and they will either share the rail that is there or build another one to run parallel. It was moved by Commissioner Terre to approve Item 3.3 as stated seconded by Commissioner Wade and unanimously carried (5-0) 4.0 ITEMS FOR CONSIDERATION 4.1 Discuss and consider making a recommendation to City Council regarding an amendment to the site plan related to fencing and landscaping for Lot 31R Block 1, Garza Little-Elm Estates commonly known at 7319 Elm Street. (SP09-0006, Colony Car Care) Mr. Morrison presented the staff report. Chairperson Hames asked if on the original site plan the applicant identified the landscaping. Mr. Morrison stated yes. Chairperson Haines asked if the applicant, would have to remove the landscaping. Mr. Morrison stated no, the applicant had not planted anything yet. Planning and Zoning Commission July 14, 2009 Page 3 of 3 Chairperson Hames asked if staff had heard from the residence next to the building. Mr. Morrison stated this was not a public hearing therefore no notices were sent out. Commissioner Terre stated the landscaping would not provide the privacy needed. Commissioner Wade stated planting more trees could possibly inhibit the water flow from the drainage easement. Commissioner Wade asked if the applicant would meet the landscaping ordinance. Mr. Morrison stated yes, the applicant also added landscaping around the dumpster. It was moved by Commissioner Hubbard to approve Item 4.1 as stated seconded by Commissioner Terre and unanimously carried (5-0) Meeting adjourned at 7:03 pm, Kare Hames, Chairperson r 1 7 Tracey Sherm n, Recording Secretary
