HomeMy WebLinkAboutResolution No. 2010-026 CITY OF THE COLONY, TEXAS RESOLUTION NO. 2010-026 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS APPROVING THE GUARANTEED MAXIMUM PRICE (GMP) OF $5,525,716.00 AND AMENDMENT NO. 2 OF DOCUMENT A121 FOR THE POLICE, COURT AND JAIL FACILITY EXPANSION (PHASES 1 & 1A) AS SUBMITTED BY SEDALCO, INC.; PROVIDING FOR A CONTINGENCY FUND; PROVIDING FOR OTHER COSTS; THAT AMENDMENT NO. 2 IS ATTACHED AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO. 2; PROVIDING AN EFFECTIVE DATE WHEREAS, Sedalco, Inc., Construction Manager, has submitted Amendment No. 2 of Document A121 for the purpose of establishing a Guaranteed Maximum Price of $5,525,716.00 for the costs associated with expansion of the Police, Court and Jail facility, Phases 1 & 1A; and, WHEREAS, the City Council has determined it to be in the city's best interest to authorize the city manager to execute Amendment No. 2 of Document A121 for the purpose of expanding the Police Court and Jail facility located at 5151 North Colony Boulevard; and, WHEREAS, the City Council has determined it to be in the city's best interest to authorize a project contingency fund of $276,285.00; and, WHEREAS, the City Council has determined it to be in the city's best interest to authorize $135,000.00 for other costs to include materials testing, HVAC testing, radio communications, IT telecom and data, and furniture. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That the City Council of the City of The Colony, Texas hereby approves the Guaranteed Maximum Price of $5,525,716.00 and Amendment No. 2 of Document A121 with Sedalco, Inc. for the purpose of expanding the Police, Court, and Jail facility located at 5151 North Colony Boulevard. Section 2. That the city manager is authorized to execute Amendment No. 2 attached as Exhibit "A". Section 3. That the City Council hereby approves a project contingency fund of $276,285.00. Section 4. That the City Council hereby approves funding of $135,000.00 for other costs associated with the expansion project. Section 5. That this resolution shall take effect immediately from and after its passage. (the Construction Manager) for Additions and Remodel to the Police, Court and Jail Facility (the Project), the Owner and Construction Manager establish a Guaranteed Maximum Price and Contract Time for the Work as set forth below. ARTICLE I GUARANTEED MAXIMUM PRICE The Construction Manager's Guaranteed Maximum Price for the Work, including the estimated Cost of the Work as defined in Article 6 and the Construction Manager's Fee as defined in Article 5, is Five Million Five Hundred Twenty Five Thousand Seven Hundred Sixteen Dollars ($5,525,716.00). This Price is for the performance of the Work in accordance with the Contract Documents listed and attached to this Amendment and marked Exhibits A through F, as follows: Exhibit A Drawings, Specifications, Addenda, and General, Supplementary and other Conditions of the Contract on which the Guaranteed Maximum Price is based, pages 1 through 3, dated March 22, 2010. Additions and Remodel to Police, Court and Jail Facility Initials: SEDALCQ Project No. 09374 Exhibit "B" to Amendment No. Two (2) March 22, 2010 Allowances The following Allowances are included and referenced herein: Allowance No. 1 Landscape and Irrigation $ 120,000 Allowance No. 2 Monument Sign and Interior Signage $ 20,000 Allowance No. 3 Utility Company Charges $ 25,000 Allowance No. 4 Pier Casings/Adjustments $ 45,000 Allowance No. 5 Storm and Sanitary Sewer Management $ 35,000 Additions and Remodel to Police, Court and Jail Facility Initials: SEDALCO Project No. 09374 4 Exhibit "C" to Amendment No. Two (2) March 22, 2010 Assumptions and Clarifications made in preparing the Guaranteed Maximum Price: Clarifications and Assumptions Based on the construction documents noted in our budget estimate, we forward the following clarifications to the Guaranteed Maximum Price: 1.01 It is our suggestion that the Owner carry an allowance for revisions that may occur during the construction of the project. Items included in this allowance would be changes in the program requirements to accommodate the owner's needs, and change orders that would be generated from scope revisions occurring during the construction of the project. We would recommend that the Owner carry a 5% Allowance for this purpose. 1.02 We have included a 5% Construction Manager's Contingency for the project. 1.03 Our budget is based on a sixteen month construction schedule. 1.04 Construction projects typically include certain items that are the Owner's responsibility. We have excluded the following items for the project and suggest that the Owner make provisions to include appropriate allowances for each in the overall project budget. 1. Material and Remodel Tax. We assume the Owner has tax-exempt status. 2. Utility Company charges and fees. 3. Pre-Construction and Construction Blueprints 4. City Fees incl. Building Permit and Impact Fees 5. Owners Protective Liability Insurance. We can provide this for you at an additional cost. 6. Construction Material Testing and Inspections (by Owner, per Section 01410). 7. HVAC Testing and Balancing (by Owner, per Section 15950). 8. Owner's Fixtures, Furniture, and Equipment (FFE) including audio/visual equipment. 9. Environmental / Hazardous Material Assessments. 1.05 The following General Conditions items are included in our budget: 1. Payment and Performance Bonds 2. General Liability Insurance 3. Umbrella Liability Insurance 4. Trade Association Fees 5. Builders Risk Property Insurance for Construction Value only. 1.06 We have established a number of allowances for items that are not defined and/or not quantifiable based on the status of the documents to date. We have identified these in the Budget Summary section. 1.07 With the exception of interior renovations specifically identified on Construction Drawings and minor cutting and patching as may be required for installation of fire protection systems, the estimate excludes all work within the existing building. Additions and Remodel to Police, Court and Jail Facility Initials: SEDALCO Project No. 09374 Exhibit "C" to Amendment No. Two (2) March 22, 2010 1.08 This proposal does not include any requirements as a result of the Texas Accessibility Review currently in progress. 1.09 Our proposal is based on an anticipated start date of March 23, 2010. 2.01 The estimate includes an allowance of $120,000 for all landscape and irrigation work. This allowance would be inclusive of any topsoil, importing of required topsoil, or spreading of same. 2.02 Our proposal does not include the relocation of existing trees as noted on sheet L1.1. 3.01 The estimate includes uncased drilled piers with belled bottoms, based on an estimated drilling depth per the construction documents. 3.02 We have prepared the building pad at the slab-on-grade at the sally port area in accordance with the amended recommendations provided by Rone Engineering dated 12/14/2009. This recommendation includes 3 passes of water injection; additional passes will be $2500/pass. 5.01 There are no provisions included to shore up the existing structure to accommodate new structure tie-ins or potential new roof top equipment. 10.01 The estimate includes an allowance of $20,000 for all components of all interior & exterior signage, per Section 01210. 11.01 The estimate excludes the undefined item in Room 1-195, Jewels/Cash.. 11.02 The estimate excludes vending equipment and other beverage service equipment. The estimate also excludes projection screens. 12.01 Except as specifically included herein, the construction estimate excludes furniture, fixtures and equipment. 15.01 We have anticipated removal and reinstallation of existing lay-in ceiling panels and miscellaneous patch and repair of drywall systems as required in association with fire sprinkler and electrical service work at existing building. 17.02 We have not included any provisions for relocation of communications equipment and the communications tower. We have included some additional structural supports at antenna location as detailed by WHJ.
