CITY OF THE COLONY, TEXAS
RESOLUTION NO. 2010-016
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, APPOINTING A HOME-RULE CHARTER
COMMISSION TO REVIEW THE CURRENT HOME-RULE CHARTER
AND PROPOSE AMENDMENTS TO THE SAME; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN IMMEDIATE
EFFECTIVE DATE.
WHEREAS, Section 9.004 of the Texas Local Government Code provides the authority
for the City Council of the City of The Colony, Texas (hereinafter referred to as the "City"), to
propose its own charter amendments to the City's qualified voters for their approval at an election,
and it also authorizes the City Council to appoint a home-rule charter commission to review the
City's current Home-Rule Charter and propose to the City Council amendments to the Home-Rule
Charter; and
WHEREAS, Section 12.08 of the City's Home-Rule Charter provides that amendments to
the home-rule charter may be formulated and submitted to the voters of the City in a manner
provided by state law; and
WHEREAS, the City Council has discussed and considered the appointment of a Home-
Rule Charter Commission, and finds and determines that it is in the best interest of the City to
appoint a home-rule charter commission to study and propose to the City Council amendments to
the Home-Rule Charter.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS, THAT:
SECTION 1. The City Council of the City of The Colony, Texas, does hereby establish
a Home-Rule Charter Commission for the purpose of reviewing the Home-Rule Charter, and
proposing amendments to the City Council concerning the Home-Rule Charter.
SECTION 2. The City Council of the City of The Colony, Texas, does hereby appoint
the following members to serve on the Home-Rule Charter Commission:
(1) Mayor Joe McCourry;
(2) Councilmember Jeff Connelly;
(3) Councilmember Perry Schrag;
(4) City Manager Tony Johnston;
(5) City Secretary Christie Wilson;
(6) Place 1 Representative Alisa Green;
(7) Place 2 Representative Matt Armstrong
(8) Place 4 Representative Nicholas Makarenko; and
(9) Place 6 Representative
SECTION 3. The Home-Rule Charter Commission shall be subject to the Texas Open
Meetings Act, Chapter 551 of the Texas Government Code, as amended, and shall post agendas and
keep minutes of its meetings in accordance with state law.
SECTION 4. If any section, article paragraph, sentence, clause, phrase or word in this
Resolution, or application thereto any persons or circumstances is held invalid or unconstitutional
by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining
portions of this Resolution; and the City Council hereby declares it would have passed such
remaining portions of this Resolution despite such invalidity, which remaining portions shall remain
in full force and effect.
SECTION 5. This Resolution shall become effective from and after its date of passage
in accordance with law.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, THIS 16'h day of February, 2010.
