HomeMy WebLinkAbout10/13/09 P&Z MINUTES CITY OF THE COLONY PLANNING AND ZONING COMMISSION OCTOBER 13, 2009 After determining that a quorum was present, the Planning and Zoning Commission of the City of The Colony, Texas convened into regular session which was held on Tuesday October 13. 2009 at 6:30 p.m. in the City Council Chambers located in City Hall, 6800 Main Street, The Colony, Texas, at which time the following items were addressed: Commissioners Present: Karen Hames; Deville Hubbard; Eddie McCormick; Debbie Morrison; Helene Parker; David Terre; and Brian Wade. Staff Present: Kimberly Lafferty; Attorney, Carl McMurphy; Fire Marshall, Wes Morrison; City Planner, Gordon Scruggs; Director of Engineering, Tracey Sherman; Administrative Assistant, Greg Vick; Interim Assistant City Manager. 1.0 CALL REGULAR SESSION TO ORDER Chairperson Hames called the meeting to order at 6:30 pm. 1.1 Citizen Input No citizen input. 2.0 CONSENT AGENDA 2.1 Consider approval of the minutes of the September 15, 2009 Regular Session. It was moved by Commissioner Wade to approve Item 2.1, seconded by Commissioner Hubbard and unanimously carried (7-0). 3.0 PUBLIC HEARINGS 3.1 Conduct a public hearing, discuss, and consider making a recommendation to City Council regarding Text Change Amendment to the Code of Ordinances by adding a new Section to Appendix A, Section 20-200 to provide for establishment of nonconforming structures and improvements on property acquired as a result or threat of eminent domain. (S109, 0016, Non Conforming Structures Amendment) Mr. Morrison presented the staff report. Commissioner Wade asked if this ordinance would be geared more towards parking requirements than the building requirements. Mr. Morrison stated the right of way acquisition would not affect actual buildings. The major items affected by this ordinance would be parking, landscaping and building setbacks. Gordon Scruggs stated no buildings would be affected by the acquisition. Commissioner Parker asked how this ordinance would affect properties that go through the zoning change process. Mr.Morrison stated properties that have a change in zoning or use would be exempt from this ordinance. Planning and Zoning Commission October 13, 2009 Page 2 of 3 Commissioner Parker asked if the zoning ordinance already had nonconforming provisions. Mr. Morrison stated yes. Commissioner Wade made a motion to approve item 3.1 seconded by Commissioner Terre and unanimously carried (7-0). 3.2 Continue a public hearing, discuss, and consider making a recommendation to City Council regarding an amendment to Section IOB - Regulations and Design Guidelines for Accessory Structures regarding the use of accessory structures regardless of the zoning district for municipal properties only. (SI09-0014, Accessory Structures Amendment) Mr. Morrison presented the staff report. Commissioner Hubbard stated the proposed ordinance did not identify the type of structure. Staff responded that if the commission desired to regulate type that could be added. Commissioner Wade asked if the site plan would require a licensed engineer to draw the design. Mr.Morrison stated yes, the site plan would have to meet all site plan submittal requirements. Chairperson Haines asked if a city staff member would design the site plans. Mr. Morrison stated the city does not have a qualified staff member. The city would hire a consultant. Chairperson Haines asked who would incur the cost. Mr. Morrison stated the individual departments would incur the cost out of their budget. Commissioner Terre asked the cost the city would incur. Mr. Scruggs stated to have a survey done on a property would be approximately $1600.00, however once the survey has been completed the city could always go back to the original survey and update. A lot of city facilities do not have a site plan but they are in the process of obtaining them. Chairperson Haines commended the Fire Department for coming forward and applying for a permit. Commissioner Terre stated this ordinance does permit checks and balances but does not handicap management of vital city functions. Commissioner McCormick made a motion to approve item 3.2 with the amendment to add the type to the accessory structure statement. Seconded by Commissioner Wade and the motion carried (6-1).
