CITY OF THE COLONY, TEXAS
ORDINANCE NO. 09-1817
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS,
AMENDING THE CODE OF ORDINANCES, BY AMENDING
APPENDIX D, COMPREHENSIVE PLAN, SECTION 4, THE COLONY:
TRANSPORTATION SYSTEM, BY ADDING PROVISIONS FOR PUBLIC
TRANSIT WITHIN THE COLONY; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A
REPEALER CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, on or about July 2, 2007, the City of The Colony passed Ordinance No. 1723
which provided for the adoption of the Comprehensive Plan (hereinafter, the "Plan") for the City,
codified in the Code of Ordinances as Appendix D to the Code; and
WHEREAS, Section 4 of the Plan provides for the Transportation System and Street
Sections; and
WHEREAS, the City Council desires to amend Section 4 of Appendix D to provide for
public transit within the City.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS:
SECTION 1. That the City of The Colony, Texas Code of Ordinances, Appendix D,
Comprehensive Plan, Section 4, The Colony Transportation System, by adding provisions related
to public transit within The Colony, which shall read as follows:
"SECTION 4. The Colony: Transportation System
Public Transit within The Colony
The North Central Texas Council of Governments (NCTCOG) Regional Rail Corridor Study
indicates the City would provide an attractive location for the development of a commuter rail
station in the future. Further, one additional station is planned immediately east of our city limits
near Memorial Drive. As displayed in Figure 4-1, these potential rail stations would be located
along the Burlington Northern (BNSF) line at Windhaven Parkway and just north of SH 121 at
Memorial Drive. Rail stations located within The Colony would not only serve the citizens of
The Colony but due to the proposed locations of these stations they would easily serve
surrounding communities which achieves the overall goal of providing an effective regional rail
transportation system for the state of Texas.

The station proposed near Windhaven Parkway will provide a regional transit location for not
only citizens of The Colony but surrounding communities as well. This location is surrounded
by two major thoroughfares, Plano Parkway and Windhaven Parkway and is easily accessed by
the Bike and Trail Master Plan, which is currently under construction; in addition, the location is
within a mile of the City's major employment centers which is home to Pizza Inn and Edward
Don headquarters; within a 1/z mile to Austin Ranch, a growing mixed use development that
contains over 2400 multi-family units and over 27,900 square feet of retail, office and restaurant
space; within a 1/2 mile to a regional nature preserve and several hundred single-family residences
located in surrounding communities. See Figure 4-2 for an overview of the Windhaven Parkway
location.

The transit center located at Memorial Drive, just north of SH 121 is another location that is
adjacent to a variety of uses that would serve a regional area. Within a half-mile radius, uses
range from light industrial, office and warehousing, to a hotel conference center and future
restaurant pad sites. A mixture of multi-family, single-family attached and detached are also
located within close proximity of the proposed site; along with a newly constructed elderly
housing development. The location of the proposed station would not only benefit the citizens of
The Colony but also citizens in adjacent communities. This site may also be able to
accommodate more of a "park and ride" function for the transit center in addition an actual rail
station due to the amount of developable land in the area. This area is also served by the City's
Bike and Trail Master plan, making pedestrian access even more accommodating. See Figure 4-
3 for an overview of the Memorial Drive location.

SECTION 2. If any section, article paragraph, sentence, clause, phrase or word in this
ordinance, or application thereto any persons or circumstances is held invalid or unconstitutional by
a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions
of this ordinance; and the City Council hereby declares it would have passed such remaining
portions of this Ordinance despite such invalidity, which remaining portions shall remain in full
force and effect.
SECTION 3. That the Comprehensive Plan of the City of The Colony, Texas, as
amended, shall remain in full force and effect, save and except as amended by this ordinance.
SECTION 4. That all provisions of the Ordinances of the City of The Colony, Texas, in
conflict with the provisions of this ordinance be, and the same are hereby amended, repealed, and all
other provisions of the Ordinances of the City not in conflict with the provisions of this ordinance
shall remain in full force and effect.
SECTION 5. This Ordinance shall become effective from and after its date of passage
in accordance with law.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS THIS 20th day of July, 2009.
