HomeMy WebLinkAboutOrdinance No. 09-1816 CITY OF THE COLONY TEXAS 1 1 ~V ORDINANCE NO. 09-1816 AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING OF THE CODE OF ORDINANCES, CHAPTER 2, ADMINISTRATION, ARTICLE I, IN GENERAL, BY ADDING A NEW SECTION 2-7. CITY ATTORNEY; PROVIDING FOR THE APPOINTMENT OF THE CITY ATTORNEY; PROVIDING FOR THE COUNCIL TO SOLICIT REQUESTS FOR PROPOSALS EVERY THREE (3) YEARS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Home Rule Charter of the City of The Colony provides for the appointment of a city attorney by majority vote of the City Council; and WHEREAS, it is the City Council's desire to incorporate said Charter provisions into the Code of Ordinances as well as to provide an opportunity for the city council to solicit requests for proposals every three (3) years to determine whether to reappoint the current city attorney or to appoint a new city attorney; and WHEREAS, the City Council hereby finds that the provisions of the Home Rule Charter concerning the city attorney should be incorporated into the Code of Ordinances by amending Chapter 2, Article I, by adding Section 2-7, City Attorney, as provided herein NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY: SECTION 1. That the Code of Ordinances shall be and the same is hereby amended by amending Chapter 2, ADMINISTRATION, ARTICLE I, IN GENERAL, by adding a new Section 2-7. City Attorney, to provide for the appointment of the city attorney, which shall read as follows: "Chapter 2 ADMINISTRATION ARTICLE I. IN GENERAL Sec. 2-7. City attorney. (a) The City Council shall appoint a city attorney as provided in the Home Rule Charter for an indefinite term and shall serve at the pleasure of the city council. The city attorney shall receive such compensation as the city council may fix. Page 1 TM 37741.76.000 (b) The city council may, every three (3) years, solicit requests for proposal for the office of city attorney and may consider reappointment or the appointment of new counsel as the city council may determine in the best interests of the city. Secs. 2-8 - 2-9. Reserved. SECTION 2. This Ordinance shall become effective from and after its date of passage in accordance with law.
