ORDINANCE NO. 08-1772
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS,
AMENDING THE COMPREHENSIVE ZONING ORDINANCE AND MAP
OF THE CITY OF THE COLONY, TEXAS, AS HERETOFORE
AMENDED, BY REPEALING AND GRANTING A CHANGE IN ZONING
FROM PLANNED DEVELOPMENT-10 (PD-10), PLANNED
DEVELOPMENT-12 (PD-12), AND PLANNED DEVELOPMENT-13 (PD-
13) TO PLANNED DEVELOPMENT-22 (PD) FOR THE PURPOSE OF
COMBINING THREE EXISTING PLANNED DEVELOPMENT
DISTRICTS INTO ONE AND INCORPORATE THE RECENTLY
ANNEXED AND DISANNEXED PROPERTY FOR 894.78+ ACRES
LOCATED ON THE EAST AND WEST SIDES OF PLANO PARKWAY,
SOUTH OF SH 121, AND NORTH AND SOUTH OF WINDHAVEN
PARKWAY AND BEING MORE PARTICULARLY DESCRIBED IN
EXHIBIT "A" AND DEPICTED ON EXHIBIT "B," WHICH ARE
ATTACHED HERETO AND INCORPORATED HEREIN; PROVIDING
FOR DEVELOPMENT REGULATIONS, WHICH ARE ATTACHED
HERETO AND INCORPORATED HEREIN AS EXHIBIT "C";
PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY
OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS
($2,000.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City Planning and Zoning Commission and the governing body of the
City of The Colony, Texas, in compliance with the laws of the State of Texas and pursuant to the
Comprehensive Zoning Ordinance of the City of The Colony, have given requisite notices by
publication and otherwise, and after holding due hearings and affording a full and fair hearing to
all property owners generally, and to all persons interested and situated in the affected area and
in the vicinity thereof, the said governing body is of the opinion that Zoning Application No.
Z07-0007 should be approved, and in the exercise of legislative discretion have concluded that
the Comprehensive Zoning Ordinance and Map should be amended.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY, TEXAS:
SECTION 1. That the Comprehensive Zoning Ordinance and Map of the City of The
Colony, Texas, duly passed by the governing body of the City of The Colony, Texas, as
heretofore amended, be and the same is hereby amended to repeal and grant a change in zoning
from Planned Development-10 (PD-10), Planned Development-12 (PD-12), and Planned
Development-13 (PD-13) to Planned Development-22 (PD) for the purpose of combining three
existing planned development districts into one and incorporate the recently annexed and
disannexed property for a total of 894.78+ acres located on the east and west sides of Plano
Parkway, south of SH 121, and north and south of Windhaven Parkway, and being more

Parkway, south of SH 121, and north and south of Windhaven Parkway, and being more
particularly described in Exhibit "A" and depicted on Exhibit "B," which are attached hereto and
incorporated herein into a new Planned Development as provided herein.
SECTION 2. That the above property shall be developed and used in compliance with
the minimum development standards and regulations, which are attached hereto and incorporated
herein as Exhibit "C".
SECTION 3. That all provisions of the Ordinances of the City of The Colony, Texas, in
conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other
provisions not in conflict with the provisions of this ordinance shall remain in full force and
effect.
SECTION 4. That should any sentence, paragraph, subdivision, clause, phrase or
section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same
shall not affect the validity of this ordinance as a whole, or any part or provision thereof other
than the part so decided to be unconstitutional, illegal or invalid, and shall not affect the validity
of the Comprehensive Zoning Ordinance as a whole.
SECTION 5. An offense committed before the effective date of this ordinance is
governed by prior law and the provisions of the Comprehensive Zoning Ordinance, as amended,
in effect when the offense was committed and the former law is continued in effect for this
purpose.
SECTION 6. That any person, firm or corporation violating any of the provisions or
terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive
Zoning Ordinance of the City of The Colony, as heretofore amended, and upon conviction shall
be punished by a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each
offense; and each and every day such violation shall continue shall be deemed to constitute a
separate offense.
SECTION 7. That this ordinance shall take effect immediately from and after its
passage and the publication of its caption, as the law and charter in such cases provide.
DULY PASSED by the City Council of the City of The Colony, Texas, this the 5'h day
of January, 2009.

I. Land Uses
a The land use allocation for the 894.776 acres, as shown in Exhibits Al and A2, requires a minimum
of 160.803 acres (18.0%) to be Multifamily (MP3), 279.186 acres (31.2%) to be Business Park (HP),
and the remaining 454-787 acres (50.8%) may be MM or BP, all of which may be shifted to any
location within the boundary of the PD. The Business Park classsiffwAtion allows for the following
uses high-rise and low-rise office buildings, clean manufacturing and processin& warehouses
(assembly or storage), retail buildings, and related support facilities such as retail establishments
within a building, parking garages and restaurants.
b. Land uses not addressed in ExhoNt 8 shall require. a planned development amendment, as
outlined in The Colony Code of Ordinances.
IL Design Standards for All Prop"
a. Thoroughfare and Road Construction: The developer will be responsible for the construction of
all required roads & thoroughfares, and will comply with local, state or federal laws,
b. Parking- On-street parking within the street rights-of-way shall provide a maximum of ten (10%)
percent of the required off-street parking requirements for residential, commercial, re ail, or
mixed use-areas.
c. Antenna and Satellite Dishes: The locations of antenna and satellite dishes shall be reviewed at
the time of site plan approval and shall be screened, if practical, from street rights-of-way and
adjacent properties.
d. Setbacks -Arterial Roads: A 50-ft minimum building setback for all uses shall be required along
arterial roads, mainly Piano Parkway and Windhaven Parkway,
e. Setbacks - Residential and Collector Streets lot' Retail, Residential, and Mixed Use: A .5-ft
minimum building setback shall be required for all residential, retail, and mixed uses abutting
residential and collector streets-
t Setbacks - Collector Streets for Office and Industrial Uses: A 25-ft minimum building setback
shall be required for office and industrial uses along all local collector streets.
g. Setbacks - South of Windhaven, East and West of Saintsbury Drive. A minimum 15-ft building
setback shall be required for mixed-use, commercmi buildings, and signage on the south side of
Windhaven Parkway for 50-ft east and west of the intersection of Saintsbury [hive.

h. Setbacks - Side and Rear Yards: Side and rear yard setbacks for residential, retail and mixed uses
shall be 5-ft, unless defined more specifically within a specific section of this document,
i. 'town Centers - Building Height: Buildings in the Town Center areas shall not exceed five levels
with a maximum height of 70-ft. Residential uses shall be permitted on four of the five levels.
j. Town Centers - L And Uses: The mixed-use area in Town Center I will incorporate approximately
21 acres of residential and commercial uses as indicated on Exh" C. The mixed-use area in
Town Center U will incorporate approximately 3D acres of residential and commercial uses as
indicated on Exhrbif D. Tables and chairs shall be permitted within the street rights-of-way
(between the back of curb and property line), adjacent to and serving adjacent commercial uses,
except along the frontage of Wtndhaven parkway. The table and chair areas shall be permitted
without fences or screening, provided that a minimum 5-ft clear circulation area is maintained
through the seating area or within the building setback,
k. Sidewalks- Sidewalks located along major thoroughfares may be located within the building
setback area instead of the right-of-way. In three cases, Sidewalks shall be continuous for a
minimum of three blocks and must connect at both ends to future sidewalks. A public pedestrian
easement must be granted in these sidewalks.
1, free removal shall comply with the City's tree removal ordinance.
M. Landscapin$/Public Art within Rights-of-Way: I.Andscaptng within the street rights-of-way will
be provided at the time property adjacent to public streets is developed, Landscaping within the
rights-of-ways will be subject to site plan approval and must comply with the following
provisions:
i. Provide for adequate visibility in accordance with the City's visibility standards.
ii. If landscaped, an irrigation systern shall be included that is equipped with rain
and freeze gauges,
iii. A maintenance agreement shall be signed by the Developer agreeing to maintain
all landscaping/ public art,
iv, An indemnity agreement, indemnifying the City of any responsibility associated
with landscaping/ public art located in rights-of-way as required by the City of
The Colony Code of Ordinances
v. The recommendation of the City that parkways within major thoroughfares (120-
ft right-of-way) should include a minimum of one large tree, 3 Ln&es in caliper at

the time of planting, every 75 ft; and parkways within all other streets include is
minimum of one large tree, 3 inches in caliper at the time of planting, every 50 fL
n. Landscaping . Irrigation: All landscaping shall be fully irrigated. Irrigation systems shall be
equipped with backflow prevention devices and freeze and rain gauges.
o. Height Restrictions - Southern Property Boundary: A 150-ft wide strip (zone A) along the
southern boundary of the Neighborhoods of Austin Ranch, as indicated in Exhibit C, will
accommodate structures with a maxinnum height of 70-ft memsured to the mid-point of sloping
roofs as defined ivy city zoning ordinance. Additional height allows for podium parking with
four (4) levels of residential use overlooking the park, Detailed site and building design will be
provided at site plan approval.
p. Utility Locations: All on site utilities and utility connections shall be located underground,:
including electrical, telephone, and television cable wires. The visual impact of transformers or
the utility company apparatus shall be buffered by landscaping, or screening within the
guidelines of the affected utility company. In the event the affected utility company does not
have screening standards, the following standards shall apply:
L A solid living screen or wall 6-ft in height shall be provided on all sides visible
from the public right-of-way. Plantings used to create the wall shall be from the
permitted plant list.
q. Transportation Improvements: The developer shall be responsible for providing transportation
improvements in Austin Ranch, as needed, for private development.
i. The City will evaluate the need for signalized intersections on Windhaven
Parkway and may require installation at the time of development in accordance
with said traffic impact analysis-
ii, Turn lanes shall be provided at the time of development for the north and south
legs of collector streets that connect to Windhaven Parkway, in accordance with
said traffic impact analysis.
r. Village Green- The streets around the village green shall be built per the layout shown in
Exhiiuf E.
s. lighting: [.fighting located along rights-of-way and/or that is to be conveyed to the City of The
Colony shall be installed in accordance with the City's lighting standards. fixteriar lighting
fixtures on private property, whether attached to a building or freestanding, shall be of a

harmonious design on all buildings either individually or jointly owned within abutting lots
within a tract,
i. All exterior light fixtures regardless of type or location shwll be of down tight or
Indirect cut off type of design w that the lamps are not directly visible.
ii. Fixtures located adjacent to residential use districts may be mounted on the
building less than 124t above average grade in the area. If desired to be
mounted greater than 12-ft above grade, they shall be mounted at the property
litre on appropriately colored poles and directed so as not to shine toward
adjacent homes.
iii. The Atlanta Series lighting fixtures dr poles will be used throughout Austin
Ranch as indicated in Exhibits FI - p3.
It. All developments shall comply with the most recently adopted codes, including building, fire,
mechanical, electrical, and locally adopted amendments, unless said codes are in conflict with
this PD, Fire department access & prevention will be evaluated for each project and
accommodated by design, appropriate means. Design criteria and other requirements established
in this PD shall take precedence in the case of conflicts,
u. Final engineering plans for civil improvements shall be submitted and approved in accordance
with the City's Engineering Design Manual, unless said criteria is in conflict with this PD. Design
criteria and other requirements established in this PD shall take precedence in the case of
conflicts.
U1. Design Standards for Multifamily
a. Density: The maximum allowable density of multi-family development shall be 24.0 units
per gross acre, less right-of-way dedication.
b. Roof Slope. A minimuni 4:12 roof slope shall be provided on a minimum of 80 percent of the
footprint projection of the total unit roof areas of each individual structure,
c- Masonry Requirements: When main buildings are two stories or less. 754E of the entire main
structure shall be constructed of stone, brick, tile, cementitious siding, or similar materials,
however, when the main building Is three or more stories in height, only the first floor is
required to have a minimum of 75% of iN exterior to be constructed of brick, tile, stone, or
similar materials.
d. building Height. All exclusively residential areas will be lunited to a height of 45-ft,
measured to the mid-point of slope of the roofs as defined in the City Zoning Ordinance.

Where the topographic changes permit it, four levels of residential use will be allowed within
the 95-ft height which, in this case will be counted from the highest point off the ground
surrounding the building. A maximum of 25% of the residential buildings will be allowed
four levels,
e. Parking - Ratim The off-street parking requirement for multifamily land uses shall be 1.7
parking spaces per dwelling unit.
f. Parking - Tandem. A maximum of one tandem parking space will be counted toward the
parking requirement outside each garage parking spam
g_ Parking - Placement- All surface parking lots shall be screened from view of all adjacent
public streets. The screening shall extend along the entire street frontage of the surface
parking lot, exclusive of driveways, access ways and visibility triangles. In addition, the
screen must be at a minimum height of 3-ft and shall consist of any of the following.
i, Earthen berm planted with turf grass or ground cover with a slope not to exceed
3:1 (width: height); or
ii. Evergreen shrubs which must provide a solid visual harrier, a minimum of 3-ft in
height within three years of initial planting; or
iii, A retainivg wall that must comply with all city standards.
h RasidentUl Unit -Size A maximum often (10%) of the total residential units built in each
phase will be a minimum of five hundred (500) square feet of living anew, provided that ifire
average unit size for the total phase is a minimum of eight hundred (800) square fee.
TV. Design Standards for Single Family Attached &i: Detached
a. Density: The maximum allowable density of single-family attached development shall be
ISO units per gross acre, less right-of-way dedication. The maximum allowable density of
single-family detached development shall be 12.0 units per gross acre, less right-of--way
dedication
h. i.andwcaptng. The front yard of each lot in single family attached and detached shall have a
minimum of one (1) 3" caliper tree from the city's recommended tree list. Trees planted
within the parkway shall be credited toward the landscaping requirement.
c Parking: Each single family dwelling shall have two (2) off-street parking spaces.
d. Property Accessibihty: Where garage doors face the street carriage style garage doors shall
be utilized in lieu of standard garage doors,
e. Screen Walls: No masonry screen walls shall be required at the perimeter or within areas of
single-family development. All walls and fencing to be of landscaping, iron, or wood.

f Exterior Materials; 100% of the dwelling units shall be any combination of brick, painted
brick, stone, stucco (excluding EIPS), or cementitious fiber-board.

a. Signage may be permitted within public rights-of-way through an encroachment agreement

VIII. Trails
a. Trails and sidewalks may becombined into one path for use by pede irians and bicyclists
through the use of identifiable markers to define the respective paths of travel. Trails shall be
built according to The Colony's adopted 2004 Trail Master Phan
