HomeMy WebLinkAboutResolution No. 09-035 CITY OF THE COLONY, /TEXAS RESOLUTION NO. 09- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF A CONSTRUCTION SERVICES CONTRACT BY AND BETWEEN THE CITY OF THE COLONY AND HENKLE DRILLING AND SUPPLY FOR CONSTRUCTION OF A WATER WELL #4, WHICH IS ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City and Consultant have entered into an agreement such that the Consultant is to provide the following services: CONSTRUCTION OF WATER WELL #4 (ITEM NO. 1 OF THE BID); and WHEREAS, the City has determined that it is in the best interest of the City to enter into the Contract with HENKLE DRILLING AND SUPPLY, which is attached hereto and incorporated herein by reference as Exhibit "A," under the terms and conditions provided therein. WHEREAS, with this Construction Services Contract the City of The Colony is agreeing to pay the sum not to exceed $1,631,625.00 for such work. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS THAT: Section 1. The Construction Services Contract, which is attached and incorporated hereto as Exhibit "A", having been reviewed by the City Council of the City of The Colony, Texas, and found to be acceptable and in the best interest of the City and its citizens, be, and the same is hereby, in all things approved in the amount of $1,553,625.00 as the base amount, plus a $78,000.00 contingency amount for a total not to exceed $1,631,625.00, and the City Manager is hereby authorized to execute the Contract on behalf of the City of The Colony, Texas. Section 2. That this Resolution shall take effect immediately from and after its adoption and it is so resolved. PASSED, APPROVED and EFFECTIVE this 4th day of MAY, 2009. WTTNESSETH: That for and in consideration of the payments and agreements hereinafter mentioned, to be made and performed by the Party of the First Part (Purchaser) to commence and complete the construction of certain improvements described as follows: The City of The Colony Well Construction Services and all extra work in connection therewith, under the terms as stated in the General Conditions of the Agreement and at his (or their) own proper cost and expense to furnish all the materials, supplies, machinery, equipment, tools, superintendence, labor, insurance, and other accessories and services necessary to complete the said construction, in accordance with the conditions and prices stated in the Proposal attached hereto, and in accordance with the Instruction to Bidders, General and Special Conditions of Agreement, Specifications, Addenda, Plans and other drawings, and printed or written explanatory matter thereof, all of which has been identified by the Contractor, together with the Contractor's written Proposal and the Performance, Maintenance and Payment Bonds hereto attached, all of which are made a part hereof and collectively evidence and constitute the entire contract. The Colony - Well Construction Services Page 10-1 The Purchaser and Contractor agree that completion of the well and furnishing and installation of pumping equipment (Bid Items 1 and 2) will be completed within 240 calendar days of the date the Contractor indicates in his Bid Proposal that he will mobilize drilling equipment on site or within 240 calendar days after the date of the written notice to commence work, whichever is later. If the successful bidder is only awarded Bid Item 1 the work shall be completed within 180 calendar days of the date the Contractor indicates in his bid Proposal that he will mobilize drilling equipment on site or within 180 calendar days after the date of the written notice to commence work, whichever is later. The indicated project schedules are subject to any extensions of time as are provided by the General Conditions of these Contract Documents.
