HomeMy WebLinkAboutOrdinance No. 06-1665 THE CITY OF THE COLONY, T,Ew XA ORDINANCE NO.06- I AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING ITS ANNEXATION PLAN, AS PREVIOUSLY AMENDED, TO PROVIDE FOR THE INCLUSION OF ALL OF THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF THE COLONY, TEXAS; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to Section 43.052 of the TEXAS LOCAL GOVERNMENT CODE, the City of The Colony, Texas, has previously enacted an annexation plan, Ordinance No. 99-1162, as amended by Ordinance No. 00-1203; and WHEREAS, the City desires to consider the annexation of all of its extraterritorial jurisdiction beginning on the third anniversary date of the adoption of the annexation plan, as amended, and as amended herein; and WHEREAS, the City finds that it is in its best interest to amend such plan to include all of the extraterritorial jurisdiction of the City. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That all of the extraterritorial jurisdiction as reflected on Exhibit "A," which is attached hereto and incorporated herein by reference as set forth in full, is hereby adopted as territory which the City of The Colony may annex on the third (3rd) anniversary date of any previously adopted ordinance, as amended, being ordinance numbers 99-1162 and 00- 1203 and as amended herein. SECTION 2. That nothing contained in this Ordinance shall be construed to prohibit any annexation exempt from the provisions of Section 43.052 of the TEXAS LOCAL GOVERNMENT CODE, as amended. SECTION 3. That the City Manager or designee shall make inventory of any and all public entities that may be included in any such extraterritorial jurisdiction and is authorized to compile a comprehensive inventory of service and facilities provided by any such inventory as prescribed by state law. SECTION 4. If any section, article paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any persons or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining 1 67302 portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. SECTION 5. This Ordinance shall become effective from and after its date of passage in accordance with law.
