MINUTES
CITY OF THE COLONY
PLANNING AND ZONING COMMISSION
MAY 12, 2009
After determining that a quorum was present, the Planning and Zoning Commission of the City of
The Colony, Texas convened into regular session which was held on Tuesday May 12, 2009 at 6:30
p.m. in the City Council Chambers located in City Hall, 6800 Main Street, The Colony, Texas, at
which time the following items were addressed:
Commissioners Present: Karen Harries; Chairperson; Deville Hubbard; Eddie McCormick; Debbie
Morrison; Helene Parker David Terre; and Brian Wade.
Staff Present: Wes Morrison, City Planner; Kimberly Lafferty, City Attorney; and Tracey Sherman,
Administrative Assistant.
Meeting was called to order at 6:30pm.
1.0 CALL REGULAR SESSION TO ORDER
1.1 Citizen Input
No citizen input received.
2.0 CONSENT AGENDA
2.1 Consider approval of the minutes of the April 14, 2009 Regular Session.
Commissioner Wade requested Item 2.2 be pulled for discussion.
It was moved by Commissioner Morrison to approve the 2.1, seconded by Commissioner
McCormick and unanimously carried (7-0).
2.2 Consider approval of a final plat of Lot 1 Block A of the Legacy Day School at
Morningstar being 1.763 acres in the BBB & CRR Survey, Abstract No 174, located
north of SH 121 on the west side of Morning Star Drive. (FP09-0002, Legacy Day
School at Morningstar)
Commissioner Wade inquired about the 1005 mutual access easement on the southeastern side of
the property. Mr. Scruggs stated the mutual access easement is for the curb return that is
encroaching on the property to the south.
It was moved by Commissioner Wade to approve Item 2.2 as stated, seconded by Commissioner
Morrison and unanimously carried (7-0).
3.0 PUBLIC HEARING
3.1 Conduct a public hearing, discuss, and consider making a recommendation to City
Council regarding a Specific Use Permit to allow for a day care with educational classes
for children to be located north of SH 121 on the west side of Morning Star Drive.

Mr. Morrison presented the staff report.
Commissioner Terre asked how many children would be onsite at the day care. Architect, Steve
Johnson stated Texas State regulations limit the day care to only allow 120 children ranging in ages
from 6 weeks to 5 years of age.
Commissioner Wade asked if having the one access point for the entrance would create a problem
for traffic. Mr. Morrison stated all departments are confident this would not be a problem.
Commissioner Wade asked if the distance from the liquor store to the daycare met the City
Ordinance. Mr. Morrison stated yes, the ordinance required a minimum of 300 feet and the site was
over 700 feet from an existing liquor store.
No one was present to speak in favor or in opposition of the request.
It was moved by Commissioner Terre to approve Item 3.1 as stated, seconded by Commissioner
Wade and unanimously carried (7-0).
3.2 Conduct a public hearing, discuss, and consider making a recommendation to City
Council regarding an amendment to Section 10A, Gateway Overlay Regulations of the
Zoning Ordinance. (SI09-0005, GWY Overlay Regulations)
This item was tabled and will be brought back at a later date. _
4.0 ITEMS FOR INDIVIDUAL CONSIDERATION
4.1 Discuss and consider making a recommendation to City Council regarding a site plan
for Lot 1 Block A of the Legacy Day School at Morning Star, being 1.763 acres, located
north of SH 121 on the west side of Morning Star Drive. (SP09-0001, Legacy Day
School at Morningstar)
Mr. Morrison presented the staff report.
Commissioner Wade asked if the drainage needed to be in an easement; Mr. Scruggs stated they are
private lines and are the applicant's responsibility; therefore an easement is not required.
Commissioner Wade asked why the existing drainage channels would be expanded. Mr. Scruggs
stated the channel was built before this site was platted. Since the drainage easement is being
dedicated to the City there are changes that need to be made.
Commissioner Wade asked where the HVAC would be located. Mr. Johnson stated its proposed
location would be located up against the building, fenced in and covered with landscaping.
Commissioner Terre asked how many staff members the day care would employ. Mr. Johnson
stated 8- 10.
Commissioner Morrison asked if there would be any adjustments to the median so a u- turn would
not be required on Morningstar. Mr. Scruggs stated once the lot to the south develops, the mutual
access easement will be constructed to reduce the number of u-turns at Crescent and Morningstar.

It was moved by Commissioner Wade to approve Item 4.1 as stated, seconded by Commissioner
Parker and unanimously carried (7-0).
