RESOLUTION NO. 08-101
A RESOLUTION OF THE CITY OF THE COLONY, TEXAS,
APPROVING THE TERMS AND CONDITIONS OF THE
ENGINEERING SERIVCES CONTRACT BY AND BETWEEN
THE CITY OF THE COLONY AND HALFF ASSOCIATES FOR
ENGINEERING ASSISTANCE FOR REVIEW OF
DEVELOPMENT PLANS AND MISCELLANEOUS TASKS,
WHICH IS ATTACHED HERETO AND INCORPORATED
HEREIN AS EXHIBIT "A"; AUTHORIZING THE CITY
MANAGER TO EXECUTE THE CONTRACT; AND PROVIDING
AN EFFECTIVE DATE
WHEREAS, the City and Consultant have entered into a Contract such that the
Consultant is to provide engineering assistance for the review of development plans and
miscellaneous tasks; and
WHEREAS, the City has determined that it is in the best interest of the City to
enter into the Contract with Halff Associates, which is attached hereto and incorporated
herein as Exhibit "A", under the terms and conditions provided therein; and
WHEREAS, with this Contract the City of The Colony is agreeing to pay the
sum not to exceed $95,000 for such work.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF THE COLONY, TEXAS THAT:
Section 1. The Engineering Services Contract, which is attached hereto and
incorporated herein as Exhibit "A", having been reviewed by the City Council of the City
of The Colony, Texas, and found to be acceptable and in the best interest of the City and
its citizens, be, and the same is hereby, in all things approved in the amount not to exceed
$95,000.
Section 2. The City Manager is authorized to execute the Contract on behalf
of the City of The Colony, Texas.
Section 3.

This resolution shall take effect immediately from and after its
PASSED AND APPROVED by the City Council of the City of The Colony,
Texas, this 20th day of October. 2008.

ENGINEERING ASSISTANCE FOR
SUBDIVSION REVIEWS AND MISCELLANOUS TASKS
SCOPE OF WORK
A. General Description:
Halff will provide assistancc for review of new subdivisions and telr miscellaneous engineering
tasks to be detennined by the City. Meetings and coordination will bc on a weekly basis on a
specific day to be detennined by the Owner. Review services and miscellaneous tasks will be
furnished on a work order basis. An individual work order will be issued tor each project.
Each request for engineering assistance from the City will be confinned by the Consultant in a
brief message to the City sent via email (see attached example). The email message will
contain a description of services, a maximum fee, and a schedule. Am email response from the
City will constitute approval of the request. Both the City Engineer and his designee will be
authorized to approve work orders.
B. Personnel to be Committed:
I. Meetings and Coordination - A registered professional engineer from Halff Associates will
work in The Colony Offices one day per week for the period of the contract. The Halff
engineer will meet with and coordinate the efforts of Halff for review of subdivisions and
the execution of miscellaneous work orders. The particular day to meet shall be chosen by
the City.
2. Drainage Reviews and Miscellaneous Tasks - Halff will commit additional staff (estimated
to be 16 hours per week) to perform reviews and miscellaneous tasks. Additional staff may
include engineers, surveyors, and CADD technicians with clerical support.
C. Scope of Services:
1. Subdivision Reviews - In the review of new subdivisions Halff will perform the following
tasks:
a. Check the grading plans for compatibility with previously established and natural
drainage patterns.
b. Check the grading plan compatibility with proposed drainage areas.
c. Review paving plans to determine if they meet City minimum horizontal and vertical
control criteria.
d. Determine if typical street sections meet Cit):: criteria.
e. Check drainage areas delineations.

f. Check "C" factors and times of concentration. Detennine that COITect design storm
frequencies are used.
g. Check inlet computations and spread of water calculations.
h. Detennine the adequacy of downstream receiving channels and stann drains.
I. Check hydraulic grade line computations.
J Determine erosion potential at outt~dls.
k. Check water and sewer line sizing with respect to the Master Plans,
I. Check valve and fire hydrant locations.
m. Check sanitary sewer sizing and manhole locations
n. Determine adequacy of erosion control plans
o. Check the compatibility of plans with standard City details, specifications and general
notes.
p. Check plats against the plans for adequacy, size and location of easements.
2. Miscellaneous Tasks - Other miscellaneous engineering assigmnents will be performed.
When requested, Halff will prepare a simple work order request with scope, estimated fee,
and schedule and transmit this to the City Engineer or his designee via email (see example).
When the work order is accepted via email, the Consultant will commence work. Upon
completion of the task, the Consultant will transmit deliverables with a written transmittal
letter.
3. Items to be furnished by the City - The City will fumish copies of record drawings, studies
and reports needed by the Consultant in the performance of the work. For meetings and
coordination the City will furnish a work space and computer for use by the Consultant's
registered professional engineer for the one day per week he will be working at the City.
D. Documentation:
The Consultant will prepare and maintain a project status report, in a format approved by the
City that will detail the status of each drainage review and work order as well a the total fee
remaining in the agreement. The status report will be updated on a weekly basis and
transmitted to the City via email.

BASIS OF COMPENSATION AND SCHEDULE
A. Basis of Compensation:
1. Meeting and Coordination - Meetings and coordination will be billed hourly on the basis
of 2.30 times salary cost of the personnel assigned to meetings and coordination.
2. Miscellaneous Tasks - Miscellaneous tasks will be billed hourly up to the maximum
agreed upon fee on the basis of2.30 times salary cost of the personnel assigned to the
task.
Salary cost is defined as the cost of salaries for time directly chargeable to the project
plus social security contributions; unemployment and payroll taxes; unemployment
compensation insurance, retirement benefits; medical and dental insurance benefits; sick
leave, vacation; and holidays.
3. Direct Costs - Printing and reproductions costs, tIling fees, etc. are charged at actual
invoice cost plus 10%.
4. Services will be billed monthly. Invoices will be separated into charges for meetings and
coordination and for miscellaneous tasks.
B. Term of the Contract:
The period ofthe contract shall be from October 1,2008 until September 30,2009.
C. Maximum Fee:
The maximum fee for the period of the contract shall be $95,000.
