HomeMy WebLinkAboutResolution No. 08-109 CITY OF THE COLONY, TEXAS RESOLUTION NO. 08-109 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, GRANTING A REQUEST FOR A SPECIAL EXCEPTION TO THE REQUIREMENTS OF SECTION 10A-800(C)(3), "PARKING," TO ALLOW A 90 DEGREE PARKING BETWEEN THE BUILDING AND THE STREET ON PROPERTY LOCATED WITHIN THE LIGHT COMMERCIAL ZONING DISTRICT AND GATEWAY OVERLAY DISTRICT ON PROPERTY LOCATED ON THE EAST SIDE OF MAIN STREET, NORTH OF EAST LAKE HIGHLANDS DRIVE, BEING DESCRIBED AS LOT 9R, BLOCK 3, GARZA LAKE ESTATES ADDITION, AND COMMONLY KNOWN AS 7528 MAIN STREET, THE COLONY, TEXAS; AND PROVIDING AN EFFECTIVE DATE WHEREAS, in accordance with 10A-500 of the Comprehensive Zoning Ordinance, an application was made for a special exception to Section lOA-800(C)(3) for a proposed retail center to be located at 7528 Main Street, The Colony, Texas; and WHEREAS, during the review process, the City determined that the special exception requested would not have any connectivity with adjacent sites and would not impact surrounding property owners or developments; and WHEREAS, it has further been determined that the development to the north has 90 degree angle parking; and WHEREAS, the applicant is requesting a special exception to the requirements of Section lOA-800, subsection (C)(3) which would allow the parking lot to be designed with 90 degree parking space in lieu of the required 45 degree; and WHEREAS, after review and consideration, the City Council finds that the request for a special exception to the requirements of Section lOA-800, subsection (C)(3), to allow the parking between the building and street to be designed with 90 degree parking space versus the required 45 degree parking space, should be granted. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS THAT: Section 1. The request for a special exception to the requirements of Section lOA-800, subsection (C)(3), to allow the parking between the building and street to be designed with 90 degree parking space versus the required 45 degree parking space on property located within the Light Commercial zoning district and Gateway Overlay District on property located on the east side of Main Street, north of East Lake Highlands Drive, being described as Lot 9R, Block 3, Page 1 TM 32637.76.000 Garza Lake Estates Addition, and commonly known as 7528 Main Street, The Colony, Texas, be, and the same is, hereby granted. Section 2. This Resolution shall become effective immediately from and after its passage, as the law and charter in such cases provides.
