HomeMy WebLinkAboutOrdinance No. 08-1752 CITY OF THE COLONY, TEXAS ORDINANCE NO. 08-1752 AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING SECTION 14-6(3) OF CHAPTER 14, PARKS AND RECREATION, OF THE CITY OF THE COLONY'S CODE OF ORDINANCES TO PROVIDE AN EXCEPTION PERMITTING THE PROHIBITED CONDUCT ON A LIMITED BASIS THROUGH A LICENSE AGREEMENT APPROVED BY CITY COUNCIL; AND PROVIDING A REPEALING CLAUSE, A SEVERABILITY CLAUSE, AND AN EFFECTIVE DATE. WHEREAS, the City Council for the City of The Colony desires to include an exception to the prohibition against the carrying or discharge of any firearm, airgun, BB gun, bow and arrow, slingshot, firework, firecrackers, rocket, or torpedo in City parks to permit such prohibited conduct on a limited basis for a particular event; and WHEREAS, the City Council wishes to guard the health, safety, and welfare of the citizens of the City of the Colony by requiring the use and operation of appropriate safety precautions, procedures, and protections. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That Chapter 14, Section 14-6 (3) of the City of The Colony Code of Ordinances be, and the same is, hereby amended by adding an exception permitting prohibited conduct through a License Agreement approved by the City Council, which shall read as follows: "Sec. 14-6. Unlawful acts. (3) . . . and/or slingshots, unless such conduct is specifically permitted on a limited basis in a license agreement approved by the City Council that provides appropriate safety precautions, procedures, and protections to ensure the health, safety, and welfare of the citizens of the City of The Colony. " SECTION 2. That if any section, article paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any persons or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it Page 1 of 2 would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. SECTION 3: That all provisions of the Ordinances of the City of The Colony, Texas, in conflict with the provisions of this ordinance be and the same are hereby amended, repealed, and all other provisions of the Ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 4. This Ordinance shall become effective from and after its date of passage in accordance with law.
