Home My WebLink AboutResolution No. 08-001 THE CITY OF THE COLONY, TEXAS RESOLUTION NO. 08-001 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, GRANTING A REQUEST FOR A SPECIAL EXCEPTION TO THE REQUIREMENTS OF SECTION lOA, GATEWAY OVERLAY DISTRICT, 10A-900(E), ROOF FORMS AND MATERIALS, SUBSECTION (l)(c), TO ALLOW ALTERNATIVE ROOFING MATERIALS, TO WIT: METAL ROOFING, ON APPROXIMATELY 2.981 ACRES OF LAND GENERALLY LOCATED WEST OF WESTPORT DRIVE, APPROXIMATELY 360 FEET WEST OF FM 423, AND BEING MORE P ARTICULARL Y DESCRIBED IN EXHIBIT "A," WHICH IS ATTACHED HERETO AND INCORPORATED HEREIN; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, an application for a special exception was made for alternative roofing materials (metal roofing) for a development located within the Gateway Overlay District; and WHEREAS, during the review process, the City determined that metal roofing is prohibited in the Gateway Overlay District without first having obtained approval during the site plan approval process; and WHEREAS, Section 10A-500 provides criteria for City Council consideration when reviewing a special exception application; and WHEREAS, after review and consideration, the City Council finds that the application meets the requirements of Section 10A-500 and that the request for a special exception to the requirements of Section lOA, Gateway Overlay District, lOA-900(E)(c), which would allow a metal roof a development located within the Gateway Overlay District should be granted. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS THAT: Section 1. The City Council finds that the application meets the requirements of Section 10A-500 of the Zoning Ordinance. Section 2. The request for a special exception to the requirements of Section lOA, Gateway Overlay District, 1 OA-900(E)( c), which would allow a metal roof constructed of gray sheen AEP-SP AN or similar product or material on the buildings in a development located within the Gateway Overlay District on approximately 2.981 acres of land generally located west of West port Drive, approximately 360 feet west ofFM 423, and being more particularly described on the attached Exhibit A, be, and the same is, hereby granted. Section 3. This Resolution shall become effective immediately from and after its passage, as the law and charter in such cases provides.
