RESOLUTION NO. 08-029
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, AUTHORIZING AN AUCTION SALE OF
PROPERTIES FROM THE T AX FORECLOSURE LIST; AND
PROVIDING AN EFFECTIVE DATE
WHEREAS, Cause No. 2002-0180-393 County of Denton vs. John McNatt et al was
filed in the District Court of Denton County, Texas to collect delinquent taxes on the following
described property, to wit:
Lots 30, 31, & 32, Block 2, Garza-Little Elm Lake Estates, City of The Colony,
Denton County, Texas being that property more particularly described in Volume
1382, page 738 of the Deed Records, Denton County, Texas
WHEREAS, the District Court of Denton County, Texas granted Judgment on
September 27,2005 in favor of the taxing jurisdictions of Denton County as follows:
County of Denton
City of The Colony
City of Eastvale
Lewisville ISD
$3,151.18
$7,723.86
$982.76
$13,358.85
Total Due $25,216.65
Market Value $25,920.00
(According to Denton Central Appraisal District)
WHEREAS, said judgment further provided as follows: The Court further finds that all
the material allegations pertaining to labor liens are true and correct and that the City of The
Colony should have judgment establishing its liens against the following property in the amount
indicated to wit:
Lots 30, 31 & 32, Block 2, Garza Little Elm Lake Estates, City of The Colony, Denton County,
Teas Account #R0008045, assessed in the name of McNatt John and described in Volume 1382,
Page 738 of the Deed Records, Denton County, Texas in the amount of $9,512.78.
The Court further finds that the foreclosure of the labor liens is second and inferior to the tax
liens and will be paid from the proceeds from the sale remaining after all court costs and taxes,
penalties and interests have been paid.

WHEREAS, said parcels of land were offered for sale on August 7, 2007 by the Sheriff
of Denton County at public auction pursuant to judgment of the District Court of Denton County,
Texas, for foreclosure of the tax liens securing payment of delinquent property taxes and accrued
penalties and interests; and
WHEREAS, said parcels of land did not receive a sufficient bid as set by law and were
struck off to the County of Denton, Trustee, in trust for itself, City of The Colony, City of
Eastvale and Lewisville Independent School District pursuant to Section 34.01(c) Property Tax
Code; and
WHEREAS, the taxing units involved desire to resell said parcels of land III an
expeditious manner pursuant to Section 34.05 Property Tax Code.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
THE COLONY, TEXAS THAT:
Section 1. The City Council hereby authorizes the Trustee to solicit from the public bids
on the said parcels of land or to request that the Sheriff of Denton County sell these properties
pursuant to Section 34.05(c) Property Tax Code, and does hereby consent to the sale of said
parcels of land to the highest bidder even if the bid tendered is less than the market value of the
land specified in the judgment of foreclosure or the total amount of the judgment against the
properties. The Council hereby authorizes to execute any deed necessary to convey the parcels
of land upon sale.
Section 2. This Resolution shall become effective immediately from and after its
passage, as the law and charter in such cases provides.
PASSED, APPROVED and EFFECTIVE this 3rd day of March. 2008.
