HomeMy WebLinkAboutOrdinance No. 08-1751 CITY OF THE COLONY, TEXAS ORDINANCE NO. 08-1751 AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS AMENDING CHAPTER 19 TRAFFIC OF THE CODE OF ORDINANCES BY AMENDING SECTION 19-10 SPEED LIMITS - GENERALLY; BY AMENDING SECTION 19-10 (b) RELATING TO SPEED LIMITS; PROVIDING FOR A PENAL TY OF A FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE WHEREAS, the safety and welfare of the citizens of The Colony is always of the highest priority; WHEREAS, it is the recommendation of the Police Chief, City Engineer and Public Works Director that the 20 mph speed limit on most streets in the Eastvale Subdivision be removed except in designated areas. WHEREAS, after due deliberations and consideration the City Council of the City of The Colony finds it is in the public interest to amend Chapter 19 of the Code of Ordinances to establish the maximum prima facie speed limit for most streets in the Eastvale Subdivision, as more fully described herein, in the City and further finds that such regulations will promote the health, safety and general welfare of the city; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That Chapter 19, Traffic, subsection 19-1O(b) of the Code of Ordinances be, and the same is hereby amended, to establish the maximum prima facie speed limit for the following streets, which shall read as follows: "Section 19-10. Speed limits -Generally. (a).. ... (b)..... Street Extent Speed (mph) Anderlan Dr. Prom Haven Hills to Sunset Cir. 20 Lebanon Road Prom the east city limits westward 10,000 feet 40 Prom its intersection with State Highway 121, northerly a 45 Main St. (PM 423) distance of 2.4 miles, approximately to the point 440 ft. north of its intersection with Overlake Dr. Main St. (PM423) Prom the point approximately 440' north of the centerline of 55 Overlake Dr. continuing north to the north city limits line Memorial Drive Prom Standridge Drive to Main Street (PM 423) 40 Memorial Drive Prom Main Street (PM 423) to Blair Oaks Drive 35 North Colony Prom Ethridge to the eastern dead end 35 Boulevard North Colony Prom Ethridge west to Stewart Creek Park Rd. 30 Boulevard Oak St. All parts of Oak St. within the corporate limits of the city 20 Paige Road Prom its intersecting point with North Colony Boulevard to its 25 intersecting point with A very Ln Paige Road Prom its intersecting point with A very Ln to its intersecting 40 point with State Highway 121 Piano Parkway Prom its intersection with State Highway 121 to a point 45 approximately 1500 ft. south of that intersection Prom a point approximately 1500 ft. south of its intersection 50 PIano Parkway with State Highway 121 to The Colony southern city limits as it intersects with PIano Parkway South Colony All of South Colony Boulevard 35 Boulevard State Highway 121 All parts of State Highway 121 within the corporate limits of 55 the city Stewart's Creek Park Road which begins at North Colony Boulevard and ends at 20 (roads) Lewisville Lake All other roads within 10 Stewart's Creek Park Sunset Cir. Prom Haven Hills to Anderlan Dr. 20 Windhaven Parkway All of Windhaven within the city limits 40 (c) .. ... Section 2. That the Traffic Administrator shall cause to be erected appropriate signage giving notice of the speed limits established herein. Section 3. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be subject to a fine in accordance with the general provisions of the Code of Ordinances. Section 4. If any section or provision of this ordinance, or application of that section or provision to any person, firm, corporation, situation or circumstance is for any reason judged invalid, the adjudication shall not affect any other section or provision of this ordinance or the application of any other section or provision to any other person, firm, corporation, situation or circumstance, and the City Council declares that it would have adopted the valid portions of the Ordinance without the invalid parts and to this end the provisions of this ordinance shall remain in full force and effect. Section 5. That this ordinance shall take effect immediately from and after its passage and the publication of the caption, as the law and charter in such cases provide; however the speed limit established herein shall not take effect until the appropriate signage giving notice of such speed limit has been erected.
