RESOLUTION NO. 08- OOd-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF
THE ENGINEERING SERVICES CONTRACT BY AND BETWEEN THE
CITY OF THE COLONY AND FREESE & NICHOLS FOR THE REVIEW
OF DEVELOPER'S CONSTRUCTION PLANS FOR THE AUSTIN
RANCH LIFT STATION, WHICH IS ATTACHED HERETO AND
INCORPORATED HEREIN AS EXHIBIT "A"; AUTHORIZING THE
CITY MANAGER TO EXECUTE THE CONTRACT; AND PROVIDING
AN EFFECTIVE DATE
WHEREAS, the City and Consultant have entered into an agreement such that the
Consultant is to provide the following services: REVIEW OF DEVELOPER'S
CONSTRUCTION PLANS FOR THE AUSTIN RANCH LIFT STATION; and
WHEREAS, the City has determined that it is in the best interest of the City to enter into
the Contract with FREESE & NICHOLS, which is attached hereto and incorporated herein by
reference as Exhibit "A," under the terms and conditions provided therein; and
WHEREAS, with this Contract the City of The Colony is agreeing to pay the sum not to
exceed $26,000 for such work.
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
THE COLONY, TEXAS THAT:
Section 1. The Engineering Services Contract, which is attached and incorporated hereto as
Exhibit "A", having been reviewed by the City Council of the City of The Colony, Texas, and found
to be acceptable and in the best interest of the City and its citizens, be, and the same is hereby, in all
things approved in the amount of $26,000 and the City Manager is hereby authorized to execute the
Contract on behalf of the City of The Colony, Texas.
Section 2. This Resolution shall take effect immediately from and after its adoption and
it is so resolved.
PASSED, APPROVED and EFFECTIVE this 7th day of Januarv. 2008.

Review of Construction Plans for the proposed Austin Ranch Addition Large Lift Station
Dear Mr. Scruggs:
Freese and Nichols is pleased to submit the attached Task Order to assist the City with the review of
developer plans for the Austin Ranch Large Lift Station and requests Authorization to Proceed in
accordance with our General Agreement for Professional Services dated November 6,2001.
The work described in this Task Order involves reviewing the proposed lift station plans and
specifications for materials and equipment and compliance with TCEQ requirements, the Wastewater
Master Plan and subsequent agreed on flow projections, providing written detailed comments. The
purpose of the comments will be to detail the various improvements necessary for the construction to
comply with all TCEQ requirements as well as meeting the short and long term needs of the City for the
service area south of SH 121. Shop drawing review and site visits during construction have been included
in the scope of work.
Please sign both copies of this letter and return one for our files as Authorization to Proceed and retain

SCOPE OF SERVICES
Austin Ranch Lift Stations Plan Review
BASIC SERVICES: Freese and Nichols, Inc., (hereinafter "FNI") shall render the following
professional services in connection with the development of this Task Order:
TASK DESCRIPTION
This Task Order consists of professional engineering services for the City of The Colony
(hereinafter "OWNER") for the following items: Review of plans and specifications for the lift
station associated with the Parks of Austin Ranch Addition Block B Lift Station and provide
written comments for incorporation into the plans. Capacity requirements will be compared with
the projected flows developed in the Wastewater Master Plan. Plan and specification compliance
with TCEQ requirements concerning lift stations will be determined and recommended changes
for non-compliance items will be provided. The review will compare the schedule of
improvements to the pumping capacity, wet well storage, electrical and SCADA improvements
necessary to provide the projected capacity. Force main alignments and sizing will be reviewed
and comments provided. It is anticipated that up to three reviews and three meetings may be
required. The following is the detailed scope of work for this Task Order:
I. Review of flow projections and sizing calculations for the pumps, force mains, and wet wells for
compliance with TCEQ requirements, anticipated staged construction, Wastewater Master Plan
projections subsequent agreed on flow projections, along with City maintenance operation
requirements. It is anticipated that larger lift station configuration will allow for some expansion
capabilities by adding/changing pumps and increasing wet well storage. Up to three reviews per
lift station will be made. Written comments will be provided on the following items:
a. Pumping unit sizes, ratings, staged construction
b. Wet well improvements for compliance with TCEQ regulations for storage and pump cycling,
and staged improvements
c. Power and Control Improvements
d. SCADA
e. Odor Control
f. Emergency power
g. Force main capacity and velocity improvements, and energy cost evaluations
2. Attend up to three meetings with the City and/or developer.
3. Provide ten copies of formal written comments for each review. An electronic file will be
provided as well.
4. Review of shop drawings as necessary for the lift station components (pumps and motors,
electrical controls, SCADA). If contractor submittals for components exceed two per
component, additional services will be requested.
5. No site visits are contemplated during construction. These can be provided as an additional
service if necessary.
TIME OF COMPLETION: FNI is authorized to commence work on performing these services upon
execution of this AGREEMENT and agrees to complete each review and provide comments within 30
days of receipt of the plans and specifications, and review of shop drawings within ] 4 calendar days of
receipt.

OWNER~
IF FNI's services are delayed or suspended in whole or in part by OWNER for more than 30 days through
no fault of FNI, FNI shall be entitled to equitable adjustment of rates and amounts of compensation.
RESPONSIBILITIES OF OWNER: OWNER shall perform the following in a timely manner so as not
to delay the services of FNI:
I. Designate in writing a person to act as OWNER's representative with respect to the services to be
rendered under this AGREEMENT. Such person shall have contract authority to transmit
instructions, receive information, interpret and define OWNER's policies and decisions with respect
to FNI's services for the Project.
2. Assist FNI by placing at FNI's disposal all available information pertinent to the services provided
including previous reports and any other data relative to the work performed
3. Examine all studies, reports, sketches, drawings, specifications, proposals and other documents
presented by FNI, obtain advice of an attorney, insurance counselor and other consultants as OWNER
deems appropriate for such examination and render in writing decisions pertaining thereto within a
reasonable time so as not to delay the services of FNI.
4. Furnish approvals and permits from all governmental authorities having jurisdiction over the Project
and such approvals and consents from others as may be necessary for completion of the Project.
5. Give prompt written notice to FNI whenever OWNER observes or otherwise becomes aware of any
development that affects the scope or timing of FNI's services.
6. Bear all costs incident to compliance with the requirements of the Responsibilities of OWNER.

COMPENSA TION: The total fee for this Task Order shall be computed on the basis of the Schedule of
Charges listed below but shall not exceed $24,750.
If FNI sees the Scope of Services changing so that Additiona] Services are needed, FNI will notify
OWNER for OWNER's approval before proceeding. Additional services shall be computed based on the
Schedule of Charges.

OTHER DIRECT EXPENSES
Other direct expenses are reimbursed at actual cost times multiplier of 1.15. They include outside printing and
reproduction expense, communication expense, travel, transportation and subsistence away from Dallas and other
miscellaneous expenses directly related to the work, including costs of laboratory analysis, tests, and other work
required to be done by independent persons other than staff members.
