HomeMy WebLinkAboutResolution No. 07-090 RESOLUTION NO. 07-090 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, DENYING A REQUEST FOR A SPECIAL EXCEPTION TO THE REQUIREMENTS OF SECTION 6-158, "STANDARDS FOR STORAGE BUILDINGS GREATER THAN 20 SQUARE FEET IN AREA OR GREATER THAN SIX FEET IN HEIGHT ACCESSORY TO RESIDENTIAL USE," SUBSECTION (c), "SETBACK FROM PRIMARY STRUCTURE," TO ALLOW A THREE (3') FOOT ENCROACHMENT IN THE REQUIRED SEPARATION FROM THE PRIMARY STRUCTURE ON PROPERTY LOCATED AT 3716 MEADOW RUN, THE COLONY, TEXAS, AND BEING MORE PARTICULARLY DESCRIBED IN EXHIBIT !lA," WHICH IS ATTACHED HERETO AND INCORPORATED HEREIN; AND PROVIDING AN EFFECTIVE DATE WHEREAS, an application was made for a building permit application for an accessory structure that will be seventy-seven (77') square feet in size and seven (7') feet in height; and WHEREAS, during the review process, the City determined that the proposed structure did not meet the requirements set forth in Section 6-158, subsection (c) of the Code of Ordinances which provides that storage buildings greater than 20 square feet in area or greater than six feet in height must maintain a three (3')-foot setback from the primary structure; and WHEREAS, the applicant is requesting a special exception to the requirements of Section 6-158, subsection (c) which would allow a three (3')- foot encroachment into the required separation from the primary structure; and WHEREAS, after review and consideration, the City Council finds that the request for a special exception to the requirements of Section 6-158, subsection (c), which would allow a three (3')- foot encroachment into the required separation from the primary structure should be denied. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS THAT: Section 1. The request for a special exception to the requirements of Section 6-158, subsection (c), which would allow a three (3')- foot encroachment into the required separation of the accessory structure from the primary structure on property located at 3716 Meadow Run, The Colony, Texas, and more particularly described on the attached Exhibit A, be, and the same is, hereby denied. Section 2. This Resolution shall become effective immediately from and after its passage, as the law and charter in such cases provides.
