AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS,
AMENDING ORDINANCE NO. 05-1604, PLANNED DEVELOPMENT-16
(PD-16), BY AMENDING THE PERMITTED LAND USES AND
DEVELOPMENT REGULATIONS FOR TRACT E OF THE CASCADES
DEVELOPMENT, BEING APPROXIMATELY 5.63 ACRES GENERALLY
LOCATED NORTH OF STATE HIGHWAY 121, EAST OF CASCADE
COURT AND SOUTH OF STONE CREEK DRIVE AND BEING MORE
PARTICULARLY DESCRIBED IN EXHIBIT "A," WHICH IS ATTACHED
HERETO AND INCORPORATED HEREIN, TO ALLOW FOR EXTENDED
STAY HOTEL USES AND PARKING REGULATIONS; PROVIDING FOR
THE APPROVAL OF THE DETAILED SITE PLAN FOR TWO (2) HOTEL
SITES, WHICH IS ATTACHED HERETO AS EXHIBIT "B"; PROVIDING
FOR THE APPROVAL OF THE DETAILED DEVELOPMENT PLAN,
BUILDING ELEVATIONS, AND CONCEPT PLAN, WHICH ARE
ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBITS
"C," "D," AND "E," RESPECTIVELY; PROVIDING A REPEALING
CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A
SAVINGS CLAUSE; PROVIDING A PENAL TY OF FINE NOT TO
EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR
EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council approved the Planned Development zoning for PD-16 on or
about July 29, 1999; and
WHEREAS, on or about July 25, 2005, the City Council approved Ordinance No. 05-
1604 which established the development regulations for Tract E of PD-16 in accordance with the
zoning ordinance; and,
WHEREAS, Ordinance No. 05-1604 did not permit hotels and/or extended stay hotels on
the property; and,
WHEREAS, the applicant has made a request for approval of amendments to the
permitted land uses and development regulations of Tract E to permit extended stay hotel uses and
parking regulations; and
WHEREAS, after discussion and consideration, the City Council has determined that the
Ordinance No. 05-1604 establishing permitted land uses and development regulations for PD-16,
Tract E, should be amended to allow for extended stay hotels and parking regulations.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS:

land described in a deed to MORNING STAR BLVD. (DALLAS) AlP In, L.L.P. as recorded in
Volume 4969, Page 1287, Real Property Records of Denton County, Texas, and being more
particularly described as follows:
BEGINNING, at a 112-inch iron rod with "Pacheco Koch" cap set at the southeast corner of said
100.645 acre tract and at the intersection of the northwest right-of-way line of State Highway 121 and
the southwest right-of-way line of Burlington Northern Railroad;
THENCE, South 61 degrees 19 minutes 26 seconds West with the southeast line of said 100.645 acre
tract and along the said northwest right-of-way line, a distance of 382.74 feet to a 1/2-inch iron rod
with "Pacheco Koch" cap set for comer;
