A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF
THE ENGINEERING SERVICES CONTRACT BY AND BETWEEN THE
CITY OF THE COLONY AND KIMLEY -HORN ASSOCIATES FOR
DESIGN SERVICES TO PROVIDE DISINFECTION FACILITIES FOR
POTABLE WATER SUPPLY AT WYNNWOOD PENINSULA PUMP
STATION, WHICH IS ATTACHED HERETO AND INCORPORATED
HEREIN AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO
EXECUTE THE CONTRACT; AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the City and Consultant have entered into an agreement such that the
Consultant is to provide the following services: SERVICES TO PROVIDE DISINFECTION
FACILITIES FOR POTABLE WATER SUPPLY AT WYNNWOOD PENINSULA PUMP
STATION; and
WHEREAS, the City has determined that it is in the best interest of the City to enter into
the Contract with KIMLEY-HORN ASSOCIATES, which is attached hereto and incorporated
herein by reference as Exhibit "A," under the terms and conditions provided therein.
WHEREAS, with this Contract the City of The Colony is agreeing to pay the sum not to
exceed $35,000.00 for such work.
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
THE COLONY, TEXAS THAT:
Section 1. The Engineering Services Contract, which is attached and incorporated hereto as
Exhibit "A", having been reviewed by the City Council ofthe City of The Colony, Texas, and found
to be acceptable and in the best interest of the City and its citizens, be, and the same is hereby, in all
things approved in the amount of $30,000.00 as the base amount, plus a $5,000.00 contingency
amount for a total not to exceed $35,000.00, and the City Manager is hereby authorized to execute
the Contract on behalf ofthe City of The Colony, Texas.
Section 2. That this Resolution shall take effect immediately from and after its adoption
and it is so resolved.

WITH
KIMLEY -HORN AND ASSOCIATES. INC.
PREAMBLE
Describing a specific agreement between KIMLEY-HORN AND ASSOCIATES, INC. (hereinafter,
"the Consultant"), and The City of The Colony, Texas (hereinafter "the Client") in accordance with the
terms of the Master Agreement for Continuing Professional Services dated September 9, 2002, which is
incorporated herein by reference.
SECTION 1
Identification of Project: Addition of disinfection facilities at Wynnwood Peninsula Pump Station.
SECTION 2
General Category of Services: Assist City Staff with Texas Commission on Environmental Quality
(TCEQ) approval, equipment selection and installation.
SECTION 3
Specific Scope of Basic Services: Kimley-Horn and Associates, Inc. will perform the following basic
scope of services under this lPO.
Task 1 - Plans and Specifications
The Consultant will prepare plans and technical specifications for a chloramines disinfection
installation similar to existing water sites within the City. The Consultant understands this
project will not be publicly bid. Plans and specifications will consist of information suitable for
construction by a contractor or City Staff.
The Consultant will review submittals provided by equipment suppliers for general conformance
to the plans and specifications. It is the Consultant's understanding the Client desires to purchase
a turnkey equipment package from an equipment supplier which includes a prefabricated
building, necessary chlorine and ammonia equipment and other miscellaneous items necessary for
a complete installation.
Task 2 - TCEQ Approval
The Consultant will prepare and send to the TCEQ the application form, plans, technical
specifications and engineering report sealed by a professional engineer in the State of Texas.
The Consultant will coordinate with TCEQ as required to obtain approval for the disinfection
installation.

Meetings:
· One Site visit
· One meeting with Client to review plans and technical specifications
· One meeting with Client to review engineering report and TCEQ application
Deliverables:
· Five (5) copies of plans and technical specifications
· Two (2) copies of engineering report and TCEQ application
Services Provided by Client:
· Provide information on existing disinfection installations
· Provide historical disinfection levels at Wynnwood Pump Station
· Provide any desired design criteria
· Review and comment on plans and technical specifications
· Review and approve engineering report and TCEQ application
SECTION 4
Additional Services:
Additional services to be performed if authorized by the Client, but which are not included in the above-
described Scope of Services, are as follows:
A. Preparation ofTCEQ Time of Concentration (TC) Study
B. Preparing documents for public bidding
C. Bidding phase services
D. Construction phase services
E. Accompanying the Client when meeting with the TCEQ, U.S. Environmental Protection Agency, or
other regulatory agencies during the course of the Project, beyond those meetings identified above.
The Consultant will assist the Client on an as-needed basis in preparing compliance schedules,
progress reports, and providing general technical support for the Client's compliance efforts.

F. Assisting Client or Contractor in the defense or prosecution of litigation in connection with or in
addition to those services contemplated by this Agreement. Such services, if any, will be fumished
by Consultant on a fee basis negotiated by the respective parties outside of and in addition to this
Agreement.
G. Sampling, testing, or analysis beyond that specifically included in the Scope of Services referenced
herein above.
H. Preparing applications and supporting documents for government grants, loans, or planning advances,
and providing data for detailed applications.
I. Appearing before regulatory agencies or courts as an expert witness in any litigation with third parties
or condemnation proceedings arising from the development or construction of the Project, including
the preparation of engineering data and reports for assistance to the Client.
J. Providing professional services associated with the discovery of any hazardous waste or materials in
the project site.
K. Additional meetings beyond those identified in the Scope of Services.
L. Preparation for and attendance to public meetings to discuss the project.
M. Any services not listed in the Scope of Services.
SECTION 5
Special Terms of Compensation:
Consultant will perform services on this project for a lump sum of Thirty Thousand Dollars ($30,000.00).
The lump sum fee includes labor costs and direct expenses identified in this contract, as well as items
such as in-house duplicating, blueprinting, facsimile, local mileage, telephone, postage, and computer
expense.

SECTION 6
Report(s) Generated: The Consultant agrees that any report(s) or data collection compiled by
Consultant pursuant to this Project Order shall be the property of the City.
