CITY OF THE COLONY
PLANNING AND ZONING COMMISSION
February 27, 2007

After determining that a quorum was present, the Planning and Zoning Commission
of the City of The Colony, Texas convened into regular session which was held on
February 27, 2007 at 6:30 p.m. in the City Council Chambers located in City Hall,
6800 Main Street, The Colony, Texas, at which time the following items were
addressed:
PRESENT: Commissioner Wade, Commissioner Hubbard, Commissioner
Milsak, Commissioner Barrett, Commissioner Morrison and Commissioner
Hames
ABSENT: Commissioner Villarreal
11.0 I CALL REGULAR SESSION TO ORDER
12.0 I CONSENT AGENDA
2.1 Consider approval of the minutes of the February 5, 2007 Special Session.
2.2 Consider approval of the minutes for the February 13,2007 Regular Session.

Commissioner Morrison moved to approve both sets of minutes. Seconded by
Commissioner Milsak.
Motion carried 6-0
13.0 I ITEMS FOR CONSIDERATION
3.1 Review and discuss the Comprehensive Plan for the City of The Colony. The
purpose of the Comprehensive Plan will guide future development of the city.
Larry Reichhart, Spring Brook Planning Group, 2405 Mustang Drive,
Grapevine, TX 76051, presented the update to the Comprehensive Plan.
Don Blackwood, 5200 Paige Rd, The Colony, TX 75056, spoke in
opposition to any change that would limit his ability to develop the property
south of Trinity Medical.

I PUBLIC HEARING
Conduct a public hearing, discuss, and consider making a recommendation to the
City Council regarding the rezoning of Planned Development 9 (PD-9) to Ag.
The 300 +/- acre property is located east and west of Piano Parkway on the south
side of State Highway 121 (SI07-0001).
Wes Morrison, City Planner, presented a staff report regarding the
rezoning of Planned Development 9 (PD-9) to Ag. The 300 +/- acre property

Commissioner Wade asked if staff had asked the land owner why they have
not come up with anything in a year and a half.

Donna Bateman, Director of Development Services, stated that there have
been some conversations regarding the property; however, nothing has been
submitted.
David Humphreys, Maharishi Global Development Fund, 10210 Grogan's
Mill Road, The Woodlands, TX 77380, stated that he did not remember
ever being asked to. provide anything to staff.
Commissioner Hames asked why the property owner objected the changing
the zoning to agriculture.
Christopher Weil, 1601 Elm Street, Dallas, TX 75201, stated they do not
understand why the city wants to down zone the property. The property is
more marketable with a PD zoning than with an Agriculture zoning. It
seems that the city accomplishes nothing by down zoning the property. Mr.
Weil asked staff and the Commission two questions: What governmental or
economic purpose does down zoning serve? Will down zoning help the
owner to develop the tract either through sale or joint venture?
Commissioner Hames asked how long the property has been on the market.

Mr. Weil stated that the property has actively been on the market since
2000.
Commissioner Wade asked Ms. Bateman if she could answer the two
questions Mr. Weil asked.
Ms Bateman stated that zoning and the method of taxing are two different
things. The taxing of the property is based on the use of the property so
chances are that since the property is vacant with a few cattle it is already
being taxed as an Agriculture use. Staff believes that rezoning the property
to Agriculture allows the city to see that property is developed in
accordance with plans that are in place today not the plans that were in
place in 1994.
Don Blackwood, 5200 Paige Rd, The Colony, TX 75056, spoke neutral to
the item and presented staff and the Commission with past documentation
regarding the property. He stated that he is willing to provide the
Chairman with copies of the documentation.
David Dodd, City Attorney, stated that he feels the item should be tabled at
this time.

Jeff Connelly, 5829 Concord Lane, The Colony, TX 75056, spoke in favor
of the item. He stated that this PD does not fit the overlay regulations in
place today.

James DePiazza, 4317 Ireland Dr, The Colony, TX 75056, spoke in favor of
the item. He stated that it is the best interest of the city to rezone the
property so that when it is developed it will reflect the regulations that are
in place now.
Richard Kuether registered his vote in favor of this item. Though he did
not wish to speak.
Mr. Weil provided staff with a copy of a development plan.
The Commission recessed into executive session.
The Commission returned.
Mr. Blackwood stated that all his records are available to the Chairman at
any time.
Commissioner Hubbard moved to table item 4.1 until the March 13,2007 P&Z
meeting. Seconded by Commissioner Milsak.
Motion carried 6-0
