HomeMy WebLinkAboutResolution No. 07-025 ~ RESOLUTION NO. 07- O:t6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF THE ENGINEERING SERVICES CONTRACT BY AND BETWEEN THE CITY OF THE COLONY AND FREESE AND NICHOLS, INC. FOR DESIGN OF AN EMERGENCY GENERATOR AT THE OFFICE CREEK PUMP STATION, WHICH IS ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City and Consultant have entered into an agreement such that the Consultant is to provide the following services: DESIGN OF AN EMERGENCY GENERATOR AT THE OFFICE CREEK PUMP STATION; and WHEREAS, the City has determined that it is in the best interest ofthe City to enter into the Contract with FREESE AND NICHOLS, INC., which is attached hereto and incorporated herein by reference as Exhibit "A," under the terms and conditions provided therein. WHEREAS, with this Contract the City of The Colony is agreeing to pay the sum not to exceed $70,000.00 for such work. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS THAT: Section 1. The Engineering Services Contract, which is attached and incorporated hereto as Exhibit "A", having been reviewed by the City Council of the City of The Colony, Texas, and found to be acceptable and in the best interest of the City and its citizens, be, and the same is hereby, in all things approved in the amount of $64,350.00 as the base amount, plus a $5,650.00 contingency amount for a total not to exceed $70,000.00, and the City Manager is hereby authorized to execute the Contract on behalf of the City of The Colony, Texas. Section 2. That this Resolution shall take effect immediately from and after its adoption and it is so resolved. PASSED, APPROVED and EFFECTIVE this 5th day of March. 2007. Dear Mr. Scruggs: Freese and Nichols is pleased to submit the attached Task Order to the City to provide a set of plans and specifications for public bid to install an emergency generator at the Office Creek Pump Station and requests Authorization to Proceed in accordance with our General Agreement for Professional Services dated November 6, 2001. The work described in this Task Order involves providing a design to modifY the Office Creek Pump Station electrical feed to include a permanent on-site generator for emergency power. The purpose of the design will be to allow Office Creek Pump Station the ability to pump water when utility power is not available. FREESE AND NICHOLS, INC. ~::.tz2~ Principal CITY OF THE COLONY Attachments ,-~ A I ~ ~ cf€c AT t\Jn-- NCS~ ~ Signature ~~J.07 Date SCOPE OF SERVICES Office Creek Pump Station Emergency Power Improvements BASIC SERVICES: Freese and Nichols, Inc., (hereinafter "FNI") shall render the following professional services in connection with the development of this Task Order: TASK DESCRIPTION This Task Order consists of professional engineering services for the City of The Colony (hereinafter "OWNER") for the following items: Prepare detailed design (plans and specifications) for the construction of the Office Creek Pump Station emergency generator installation as outlined below: 1. The generator will be sized to operate one 1 OOHP pump and one 250HP pump. The horsepower ofthe pumps will be verified with the current water system master plan. 2. Include Automatic Transfer Switch (ATS) position on SCADA. 3. The design will not include separate power panels (one for normal power, one for emergency power). The ATS will switch between utility power and generator power to feed the existing switchgear. 4. FNI will attend a total of two (2) meetings/site visits during design phase. a. Kick off meeting b. 90% review meeting 5. The following information will be delivered to the Owner a. Site plan showing location of generator and ATS b. Loop diagrams and descriptions. c. SpecifY I/O summary d. Specifications for equipment and materials 6. The Owner shall provide FNI as-built drawings of the Office Creek Pump Station. Upon completion of the project, FNI shall provide record drawings of the installation to the Owner. 7. Review of shop drawings as necessary for the Office Creek Pump Station components (generator, electrical components, A TS, SCADA). If contractor submittals for components exceed two per component, additional services will be requested. 8. FNI will provide advertisement and construction phase services on the project. Plans shall be prepared as half-size. FNI will be responsible for: a. Bid document distribution b. Response to Contractor questions c. Pre-bid conference (if required) d. Bid tabulation and recommendation of award e. Review up to seven shop drawings f. Answer up to ten RFI's g. Review up to ten PCM's h. Providing representation through the scheduled construction deadline as defined in the bid documents. Review pay requests 1 ;/// FNIfIe- OWNER l. 9. Site visits during construction (2 maximum). a. Pre construction b. Final Punch list Additional construction phase and design phase meetings shall be considered an additional service. TIME OF COMPLETION: FNI is authorized to commence work on performing these services upon execution of this AGREEMENT and agrees to complete design within 90 calendar days of Notice- To-Proceed. IF FNl's services are delayed or suspended in whole or in part by OWNER for more than 30 days through no fault of FNI, FNI shall be entitled to equitable adjustment of rates and amounts of compensation. RESPONSmILITIES OF OWNER: OWNER shall perform the following in a timely manner so as not to delay the services of FNI: 1. Designate in writing a person to act as OWNER's representative with respect to the services to be rendered under this AGREEMENT. Such person shall have contract authority to transmit instructions, receive information, interpret and define OWNER's policies and decisions with respect to FNl's services for the Project. 2. Assist FNI by placing at FNl's disposal all available information pertinent to the services provided including previous reports and any other data relative to the work performed 3. Examine all studies, reports, sketches, drawings, specifications, proposals and other documents presented by FNI, obtain advice of an attorney, insurance counselor and other consultants as OWNER deems appropriate for such examination and render in writing decisions pertaining thereto within a reasonable time so as not to delay the services of FNI. 4. Furnish approvals and permits from all governmental authorities having jurisdiction over the Project and such approvals and consents from others as may be necessary for completion of the Project. 5. Give prompt written notice to FNI whenever OWNER observes or otherwise becomes aware of any development that affects the scope or timing of FNl's services. 6. Bear all costs incident to compliance with the requirements of the Responsibilities of OWNER. The total fee for this Task Order shall be computed on the basis of Attachment CO for the lump sum fee of $64,350. If FNI sees the Scope of Services changing so that Additional Services are needed, FNI will notifY OWNER for OWNER's approval before proceeding. Basic Services: Compensation to FNI for the Basic Services shall be the lump sum fee of Sixty Four Thousand, Three Hundred Fifty Dollars ($64,350.00). If FNI sees the Scope of Services changing so that additional services are needed, including but not limited to those services described as Additional Services, FNI will notify OWNER for approval before proceeding. Additional Services shall be computed based on the Schedule of Charges. B.
