MINUTES OF THE PLANNING AND ZONING COMMISSION
MEETING HELD ON AUGUST 27, 2002
The Regular Session of the Planning and Zoning Commission of the City of The Colony,
Texas was called to order at 6:30 p.m. on the 27th day of August, 2002 at City Hall with
the following members present:

With five (5) members present, a quorum was established and the following items were
addressed:
2.0 DISPOSITION OF MINUTES
2.1 Approval and/or correction of Planning and Zoning Commission Minutes for
the meeting held on August 13, 2002.
Motion to approve the minutes of the meeting held on August 13, 2002,
Commissioner Jamme; second, Commissioner Snider. Motion carried 5-0.
3.0 CITIZEN INPUT
Mr. Persaud introduced the new City Engineer, Mr. Robert Barker.
4.0 ITEMS FOR CONSIDERATION

4.1 Consider a request for approval of a final plat for Windhaven Parkway
Right-of-Way Dedication Phase II being .8379-acres situated in the S. B.
Evans Survey, Abstract NO. 397, located in the City of The Colony, Denton
County, Texas. (2002-FP007)
Mr. Spencer presented the staff report regarding a request for approval of a final plat for
Windhaven Parkway Right-of-Way located in Austin Ranch, west of Plano Parkway.
Staff recommends approval with one staff stipulation.
Motion for approval of a final plat for Windhaven Parkway Right-of-Way
Dedication Phase II being .8379-acres situated in the S. B. Evans Survey, Abstract
NO. 397, located in the City of The Colony, Denton County, Texas. (2002-FP007)
with staff stipulation, Commissioner Mikulec; second, Commissioner Snider.
Motion carried 5-0.
5.0 PUBLIC HEARING
5.1 Hold a public hearing and consider making a recommendation regarding a
request for a change in zoning from Office-1 "O-1" zoning district
classification to Shopping Center "SC" zoning district classification to allow
for an anticipated QuikTrip gas station and convenience store on a tract of
1.4721 acres, located along the west side of Main Street and south of the
Trinity Medical Center, in the City of The Colony, Denton County, Texas. --

Chairman Hubbard opened the public hearing at 6:44 P.M.
Mr. Spencer presented the staff report regarding a request for a change in zoning from
Office-1 "O-1" zoning district classification to Shopping Center "SC" zoning district
classification west of Main Street and south of Trinity Medical Center. There were ten
notification letters mailed. Two in opposition had been returned.
Mr. Steve Walker of QuikTrip, 14450 Trinity Boulevard, #300, Fort Worth, Texas 76155,
explained the history of QuikTrip and their desire to offer exceptional customer service at
a competitive price. He also furnished the Commission with a survey done by Sullivan
Survey of Atlanta regarding the advantages of a QuikTrip gas/convenience store,
landscaping plans, site plans, customer letters, locations of QuikTrip stores in the
surrounding area and a conceptual drawing of this particular tract of land. QuikTrip has
many location throughout the metroplex that are adjacent to office building complexes.
Mr. Myron Domic, Attorney with Jenkens & Gilchrist, 1445 Ross Avenue, Suite 3200,
Dallas, Texas 75202, stated the rezoning and development of this property will make the
land viable for future development of office buildings on the surrounding tracts.

Mr. Don Reed of 4700 Brandenburg Drive, The Colony, Texas 75056, spoke out in
opposition:
1. There are 5 gas station/convenience stores in little over a mile radius.
That is a large concentration of existing establishments.
2. Lives across the street and concerned about 24 hour operation causing
noise and light pollution, increase in traffic, etc.
Mr. Howard Haull of 5952 Sandhill Circle, The Colony, Texas 75056, also spoke out in
opposition:
1. There are 9 gas stations and 4 major grocery chains within a 2 mile
radius, his concern is the economic viability. The possibility of
displacement of exiting business could become a major problem.
2. Also, the need for an Specific Use Permit for the sale of beer and wine
in order to be competitive with surrounding establishments.
Mr. Walker addressed these concerns. He stated The Colony has an increasing number of
commuters driving through The Colony from Frisco and Little Elm. Why not keep that
sales tax in the city? QuikTrip does plan to apply for a Specific Use Permit for the sale
of beer and wine at a later date. They will never add a liquor store to an existing store or
sell adult magazines. Their goal is great customer service with a high quality of value.
The Commissioners' greatest concern was the close proximity of residence to an
establishment with 24 hours of operation.
Chairman Hubbard closed the public hearing at 7:15 p.m.
Mr. Spencer reviewed a survey conducted by staff showing existing gas
station/convenience stores in The Colony and surrounding cities. He also stated there are
existing parcels available in The Colony that are zoned for this use.
Mr. Walker stated existing parcels are either under contract, have poor access, or the
tracts are too small. They want a quality store for The Colony and plan on giving the
best possible product to the citizens for 40 years not 4 quarters.
Mr. Persaud informed the Commission that there are many sites already zoned for gas
stations in The Colony. Without a site plan it is difficult to foresee future development of
this tract. The plan furnished by QuikTrip is only a "conceptual drawing" and holds no
guarantee for the future development of this tract. He pointed out that the Trinity
Medical Center may need to be expanded some time in the future. The City owns a 12
acre tract on the west side which may be used for a future City or civic building. His
major concern is the close proximity of homes to the site.
Motion not to approve a recommendation regarding a request for a change in
zoning from Office-1 "O-1" zoning district classification to Shopping Center "SC"
zoning district classification to allow for an anticipated QuikTrip gas station and

With no further business, the meeting adjourned at 7:30 p.m.
