MINUTES
CITY OF THE COLONY
PLANNING AND ZONING COMMISSION
February 13, 2007
After determining that a quorum was present, the Planning and Zoning Commission
of the City of The Colony, Texas convened into regular session which was held on
February 13, 2007 at 6:30 p.m. in the City Council Chambers located in City Hall,
6800 Main Street, The Colony, Texas, at which time the following items were
addressed:

Absent: Brian Wade, Michael Barrett, Debbie Morrison
Staff Present: Donna Bateman, Wes Morrison, Pat Dominguez
Vice-Chairman Hubbard called the meeting to order at 6:30 pm.

2.1 Consider approval of the minutes of the January 23, 2007 Regular Session.

Commissioner Milsak motioned to approval of minutes for January 2300 minutes,
seconded b Commissioner Hubbard. Motion carried (4-0).
ITEMS FOR CONSIDERATION
Discuss and consider making a recommendation to the City Council on a
site plan for D&R Floors. The 0.207 -acre tract is located on Elm Street
(SP06-0010, D&R Floors).
Wes Morrison, City Planner, presented the staff report and recommended
approval of request.
Commissioner Villarreal inquired about the location of the dumpster.
Mr. Morrison stated that while is it not an ideal location, due to the site
constraints on the property it was the most practical place.
Commissioner Villarreal questioned the seven parking spaces, and how the
calculations of the parking spaces were estimated. Ms. Bateman verified that
when staff met with applicant the parking was reviewed and met guidelines.
Commissioner Hubbard inquired about the color of the brick and the metal roof
building.
John Klingenberg, representing the applicant gave colors of brick which is
metallic silver.
Ms. Bateman stated that this property is currently located within the Gateway
Overlay District but the application was made prior to this property being
incorporated into the Overlay District, therefore it was not required that they
comply with the Overlay regulations.
Commissioner Villarreal motioned to approve. Commissioner Milsak seconded.
Motioned carried (4-0).

PUBLIC HEARING
Conduct a public hearing, discuss and consider making a recommendation
to the City Council regarding a development plan and site plan for Hidden
Cove Marina and Resort. The 407.88-acre tract is located in the northwest
portion of the city with access off of Hackberry Road. The proposed uses
include hotels, campsites, marinas, boat storage, cabins, recreational vehicle
parking, restaurant, and retail uses. (Z06-0010, Hidden Cove Development
Plan).
Wes Morrison, City Planner presented the staff report and provided the
Commission with a brief history of the application.
Ottis Lee, Civil Works Engineering, representing the applicant stated that had
nothing further to add and were open to questions.
Commissioner Hubbard opened the public hearing and asked for anyone wanting
to speak in favor and in opposition.
No one came forward.
Commissioner Hubbard closed the public hearing.
Commissioner Hubbard requested clarification on attachments in the backup and
what was before them for approval. Mr. Morrison clarified that Attachment 2 in
the backup was the Concept Plan that Council had already approved and
provided as a reference to the Commission.
Commissioner Hames questioned which of the building materials did not comply
with city ordinance. Mr. Morrison verified that all materials have been approved
by council and the materials shown on the elevations provided by the applicant
complied with the approved Concept Plan.
Commissioner Villarreal motioned to approved, seconded by Commissioner
Milsak. Motion Carried (4-0)
Conduct a public hearing, discuss and consider making a recommendation
to the City Council regarding a rezoning request to amend the required
rear yard setback in PD-12 for property located at the northeast
intersection of West Lake Highlands Drive and Lake Park Drive, commonly
known as 4617 West Lake Highland Drive. (Z06-0005, 4617 West Lake
Highlands Drive).
Wes Morrison, City Planner provided a history of the applicants request and
presented the staff report. The Development Review Committee recommended
approval of the request with the condition that the rear yard setback remain 12 Yz
feet instead of the 5 ft being requested by the applicant.
Commissioner Hubbard opened the public hearing and asked for to speak in
favor, and in opposition.
Jerry Latham, is in favor of 12 Yz ft and is opposed to 5 ft being built.
Commissioner Villarreal asked what the difference would be if this was a
commercial property versus residential property. Donna Bateman clarified that
there is no set back at all; it would have to maintain a building code standard and

a wall would have to be created.
Commissioner Villarreal motioned to approval, Seconded by Hames.
Motion Carried (4-0)
