HomeMy WebLinkAbout01/23/07 P&Z I MINUTES CITY OF THE COLONY PLANNING AND ZONING COMMISSION January 23, 2007 After determining that a quorum was present, the Planning and Zoning Commission of the City of The Colony, Texas convened into regular session which was held on January 23, 2007 at 6:30 p.m. in the City Council Chambers located in City Hall, 6800 Main Street, The Colony, Texas, at which time the following items were addressed: All Commissioners were present except Commissioner Milsak. 11.0 I CALL REGULAR SESSION TO ORDER 12.0 I DISPOSITION OF MINUTES 2.1 Consider approval of the minutes of the January 9,2007 Regular Session. Commissioner Morrison moved to approve the minutes. Seconded by Commissioner Barrett. Motion carried (6-0). I 13.0 3.1 I CONSENT AGENDA Consider approval ofa Final Plat for Oak Wood Village West Lots 1-5 Block A being 20.937 acres in the B.B.B. & C.R.R. Survey, Abstract No. 173 and the J.B. Shipps Survey, Abstract No. 1227, and the Thomas Wilson Survey, Abstract No. 1352. The property is generally located at the northeast comer of SH 121 and Blair Oaks Road and the southeast comer of Memorial Drive and Blair Oaks Road (FP06-0013, Oak Wood Village West). Commissioner Hames moved to approve item 3.1 as presented by staff. Seconded by Commissioner Hubbard. Motion carried (6-0). 14.0 I PUBLIC HEARING 4.1 I Conduct a public hearing and consider making a recommendation to the City Council regarding an amendment to the development plan for Planned Development 18 "PD-18" zoning district to allow for a reduction in the minimum required wattage for street lights and to allow for specialized street signage and fixtures. The area is commonly known as Wynnwood Peninsula and is in the northwest portion of the city south of future extension of Lebanon Road. The Development Plan is for a subdivision to be named The Tribute (Z06-0012 Tribute PD Amendment). Wes Morrison, City Planner, reviewed history of plan and provided an overview of the applicants request. Commissioner Villarreal asked staff to clarify what the reduction of wattage was based on and difference between high pressure sodium and metal halide lighting. Steve Eubanks, Director of Public Works, clarified the difference between sodium lighting versus metal halide lighting. He explained the difference is 100 I Planning and Zoning Commission January 23, 2007 watt metal halide lights give better lighting conditions than 100 watt high pressure sodium. The developer indicated they intend on placing the higher wattage metal halide light on Lebanon Rd. Commissioner Hames asked if the light fixture distance would be the same distance as the standard for the city. Mr. Eubanks responded the distance would meet the intent of the ordinance adding that some may be closer or farther away due to intersections. Commissioner Barrett asked if there were any issues with the Police and Fire Department to view addresses on homes. Mr. Eubanks stated the Fire and Police Departments were given copies of the proposal and that both departments approved the requested amendments. Commissioner Villarreal asked if there was a difference on the spacing on arterial streets versus residential roads. Mr. Eubanks stated that the Subdivision Ordinance requires street lights to be placed at intervals of 200 to 300 hundred feet on major arterials and 200 to 400 on residential streets. Commissioner Morrison asked if there will not be lights every 200 to 300 ft. on Lebanon. Mr. Eubanks clarified there will not be lights every 200 to 300 ft along Lebanon Road, except where Lebanon intersects with residential streets. Commissioner Wade opened up the public hearing. Applicant Kristian Teleki - Wynnewood Peninsula, 1660 South Stemmons Suite 100, gave a presentation of the Planned Development and clarified concerns of lighting on Lebanon. Also presented signage and fixtures. Commissioner Villarreal voiced concern as to how one determines they are in The Colony, since Little Elm Elementary school is on the right. Mr. Teleki stated they were not opposed to adding signage stating that the development was located within The Colony, emphasizing they were proud to be in The Colony. Commissioner Hubbard asked staff how much of the peninsula would carry the standard street signage. Mr. Eubanks responded the majority of the peninsula was under the ownership of the developer therefore the proposed street signage would be used over the majority of the peninsula. Commissioner Hames questioned if this development will be done all at once or in segments. Mr. Teleki confirmed it will be done in phases. Commissioner Hames asked if lights will be installed on Lebanon Rd. before this is completely built out. Mr. Eubanks stated that negotiations with the County during the planning stages of Lebanon Road the City requested street lighting but the request was denied by the County. Commissioner Hames asked if it was a priority of the City to install lighting on Lebanon Road, Mr. Eubanks stated it was not a high priority at this time. He continued that once the school is built and more development comes into the area the City would look at it a little closer. Commissioner Villarreal asked what the spacing would be. I I f Planning and Zoning Commission January 23, 2007 I Mr. Eubanks answered that the spacing must be a minimum of 200 feet no further than 400 feet and it is left up to the developer to choose where the lights will be placed. Commissioner Morrison asked if the street signs could have a sign on top of the original sign with possibly the sail boat saying The Colony, which would indicate that one has arrived in The Colony. Mr. Teleki verified that there is not a plan to have an additional sign on top, however, that information can be requested through the designers and that they were willing to research that more. Commissioner Wade asked if there was anyone else from the public that wished to speak in favor or against the request. Being none, Chairman Wade closed the public hearing and asked the Commission for any discussion. Commissioner Villarreal stated that it may be best to table the request until more information can be brought forward by the applicant regarding identifying the City more throughout the development. The applicant stated that due to time constraints with ordering the signage and lighting and the desire of the construction for the roads and infrastructure that the Commission move forward with their recommendation. Commissioner Hubbard asked staff if the lamp post with the ability to put banners up complied with the City's sign ordinance. Mr. Morrison stated that the banners shown would be used for special events and therefore be approved with the Special Event Permit. Commissioner Wade moved to approve the request as presented by the applicant. Seconded by Commissioner Hubbard. Motion carried (4-2). In Favor: Wade, Hubbard, Villarreal, Hames.
