HomeMy WebLinkAbout11/14/06 P&Z MINUTES CITY OF THE COLONY PLANNING AND ZONING COMMISSION November 14,2006 I After determining that a quorum was present, the Planning and Zoning Commission of the City of The Colony, Texas convened into a work session which was held on November 14, 2006 at 6:30 p.m. in the City Council Chambers located in City Hall, 6800 Main Street, The Colony, Texas, at which time the following items were addressed: All Commissioners resent CALL WORK SESSION TO ORDER 1 W2.0 1 WORK SESSION W2.1 Receive a report and hold a discussion on consent agenda items After determining that a quorum was present, the Planning and Zoning Commission of the City of The Colony, Texas convened into regular session which was held on November 14, 2006 at 6:30 p.m. in the City Council Chambers located in City Hall, 6800 Main Street, The Colony, Texas, at which time the following items were addressed: I 11.0 12.0 2.1 I CALL REGULAR SESSION TO ORDER 1 DISPOSITION OF MINUTES KH / DM 7-0 Consider approval of the minutes of the October 24, 2006 Regular Session. Commissioner Hames moved to approve the minutes. Seconded by Commissioner Morrison. Motion carried (7-0) 13.0 3.1 3.2 I CONSENT AGENDA DH / MM 7-0 Consider approval of a preliminary plat for Vassar Court. The 30.2 acre tract is located in Austin Ranch at the northeast comer of Davidson Street and Arbor Hills Way (PP06-0009, Vassar Court). The above item was withdrawn from consideration at the request of the applicant. Consider approval of a Final Plat of Lots 8 - 15 Block B, Lots 6 - 9 Block C, Lots 16 - 22 & 43 Block D, Lots 1 -21 Block E, Lots 1-14 Block F, and Lots 1-9 Block G for Balmerino at Tribute Phase 1. The 28.1 acre tract is located in the northwest portion of the city west of Main Street and south of future Lebanon Road (FP06-0012, Balmerino at Tribute). Commissioner Hubbard moved to approve item 3.2. Seconded by Commissioner Milsak. Motion carried (7-0) I Planning and Zoning Commission November 14,2006 I 14.0 1 ITEMS FOR CONSIDERATION 4.1 Discuss and consider making a recommendation to the City Council on a site plan for the Cascades at the Legends Amenity Center. The 0.53-acre tract is located at southwest comer of Clearwater Drive and Stone Mountain Road (SP06-0014, Cascades at the Legends Amenity Center). Commissioner Villarreal asked what this property was originally. Ms. Bateman explained that this was originally platted for 5 town homes. Commissioner Villarreal asked if we need to recommend open space. Ms. Bateman said that they meet all open space requirements. Commissioner Hames moved to approve item 4.1. Seconded by Commissioner Barrett. Motion carried (7-0) 15.0 5.1 5.2 1 PUBLIC HEARING Conduct a public hearing and consider approval of a Replat for Lot 47R, Block G, Stewart Peninsula, Cottonwood Springs, Phase I. The 0.3207-acre tract is located at 5901 Cypress Cove Drive (RP06-0003, Replat of Lots 47 and 48, Block G, Cottonwood Springs, Phase I). Commissioner Hubbard asked if the applicant is t the same as the owner of the property. Ms. Bateman stated that they are two different people. The applicant is Doug Connelly. Shelly Lavender - 5904 Cypress Cove, The Colony, requested that the commission disapprove the replat. Wayne Terrell, property owner - 5909 Cypress Cove, The Colony, requested the commission approve the replat. Commissioner Barrett asked for staff to clarify the HOA requirements because he heard two conflicting stories. Mr. Dodd stated that we can not restrict the HOA requirements. The replat meet state law and city ordinances which means we have to pass it. Commissioner Hubbard moved to approve the replat as presented by staff. Seconded by Commissioner Milsak. Motion carried (7-0) Conduct a public hearing and consider making a recommendation to the City Council on amendments to Planned Development 18, "PD-18". The 420.39- acre tract is located at Boyd Rd, west FM 423 (future Lebanon Road) (Z06- 0011, Tribute Subdivision PD Amendment). Commissioner Hubbard asked where he could find examples of 175 watt and 100 watt lights throughout the City. I I Planning and Zoning Commission November 14,2006 I Mr. Eubanks, Director of Public Works stated that examples of 175 watt lights can be found on S. Colony and Paige and in Austin Ranch. He stated he was not aware oflocations withl00 watt lights. Commissioner Barrett asked if the Fire Marshal is in agreement with the roof height request. Ms. Bateman stated yes. Commissioner Milsak stated she would like to have the lights closer and the wattage higher. Frank Abbott, Kimley Horn and Assoc, 9300 Wade Blvd, Frisco, stated that they are trying to keep up with the Tribute golf course theme. Mr. Abbott explained the following: 1. Rezoning request - The rezoning request is constant with the General Development Plan that was labeled "future zoning request." 2. Encroachment request - Weare asking the developers to add outside chimneys which requires a two foot encroachment. 3. Height request - We are asking for the 40 ft standard height being used throughout the metroplex. 4. Temporary batch plant request- This will help facilitate construction on site and will cut down on the number of trucks on the road. 5. Street signs request - This item has been pulled due to consulting with a sign firm. 6. Lighting request - The theory is to try to keep consistency with the Scottish theme. Commissioner Barrett stated that he is against the lighting request due to safety Issues. I Commissioner Morrison asked what the hours of batch plants would be and if they would be close to residents. Mr. Abbott stated that he is not sure of the hours but the batch plants will be located in future phases. I Commissioner Villarreal moved to recommend approval of: 1. The rezoning of 25 acres from MF/Retail to Single Family; 2. Rewording of maximum building height to allow homes to be 2 Y2 stories or 40 feet; 3. Encroachment of side and front yard setbacks to allow for chimneys and bay windows; and 4. Two locations for temporary batch plants during the construction of the roads within the development. Commissioner Villarreal recommended the variation to the street lighting request remain as the code currently allows. The code requires 400 foot spacing and 175 watts. Seconded by Commissioner Barrett. Motion carried (7-0) Planning and Zoning Commission November 14, 2006 I 5.3 Conduct a public hearing and consider making a recommendation to the City Council on an amendment to Appendix A, Section 10-200, of the Code of Ordinances relating to permitted uses in districts zoned Planned Development (PD) (SI06-0056, Uses in Planned Development). Commissioner Hubbard moved to approve item 5.3 as presented by staff. Seconded by Commissioner Villarreal.
