AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS,
AMENDING APPENDIX A, ZONING, OF THE CODE OF ORDINANCES
BY AMENDING SECTION lOB, GWY DISTRICT, BY AMENDING 10B-
300, BOUNDARIES OF THE GWY DISTRICT, BY ADDING A
SUBSECTION (C) TO PROVIDE FOR THE INCORPORATION OF THE
PROPERTY LOCATED ATA 4800 SOUTH COLONY BOULEVARD
INTO THE GATEWAY OVERLAY DISTRICT, AS DEPICTED ON
ATTACHMENT "I" AND DEFINED ON ATTACHMENT "2," WHICH
ARE ATTACHED HERETO AND INCORPORATED HEREIN;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALER
CLAUSE; PROVIDING A PENALTY OF A FINE NOT TO EXCEED FIVE
HUNDRED DOLLARS ($500) FOR EACH AND EVERY VIOLATION;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the current boundaries for the Gateway Overlay District ("GWY") only
incorporates S.H.121 Corridor and the Main Street Corridor which is depicted as the "Current Area"
on Attachment "1," which is attached hereto and incorporated herein for all purposes; and
WHEREAS, recommendation has been made to the City Council to consider amending
Section lOB, 10B-300, Boundaries of the GWY District, and the map referenced hereinabove by
expanding the boundaries to incorporate the property located at 4800 South Colony Boulevard into
the GWY, which is depicted as "Proposed Area" on Attachment "1" and defined on Attachment
"2," which are attached hereto and incorporated herein for all purposes; and
WHEREAS, after discussion and consideration the city council has determined that it
would be in the best interest of the City to amend the Code of Ordinances, Appendix A, Zoning,
Section 1 OB, GWY District, by amending 10B-300, Boundaries of the GWY District, and the map
depicting said boundaries by expanding the boundaries to incorporate the property located at 4800
South Colony Boulevard into the GWY;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
THE COLONY, TEXAS:
SECTION 1. That the Code of Ordinances of the City of The Colony, Texas be, and the
same is, hereby amended by amending Appendix A, Zoning, by amending 10B-300, Boundaries of
the GWY District, and the map depicting said boundaries by reformatting and adding subsection (B)
to provide for the expansion of the boundaries to incorporate the property located at 4800 South
Colony Boulevard into the GWY, which shall read as follows:

"SECTION lOB. GWY DISTRICT
10B-300. Boundaries of the GWY District.
A. S.H 121 Corridor.
The GWY District incorporates. . . . .
B. Main Street Corridor.
The GWY District incorporates. . . . .
C. 4800 South Colony Boulevard
The GWY District incorporates the property located at 4800 South Colony
Boulevard, The Colony, Texas."
SECTION 2. If any section, article paragraph, sentence, clause, phrase or word in this
ordinance, or application thereto any persons or circumstances is held invalid or unconstitutional by
a Court of competent jurisdiction, such holding shall not affect the validity ofthe remaining portions
of this ordinance; and the City Council hereby declares it would have passed such remaining
portions of this Ordinance despite such invalidity, which remaining portions shall remain in full
force and effect.
SECTION 3: That all provisions of the Ordinances of the City of The Colony, Texas, in
conflict with the provisions of this ordinance be, and the same are hereby amended, repealed, and all
other provisions of the Ordinances of the City not in conflict with the provisions of this ordinance
shall remain in full force and effect.
SECTION 4. That all provisions of the Ordinances of the City of The Colony, Texas, in
conflict with the provisions of this ordinance be, and the same are hereby amended, repealed, and
all other provisions of the Ordinances of the City not in conflict with the provisions of this
ordinance shall remain in full force and effect.
SECTION 5. Any person, firm, or corporation violating any of the provisions of this
ordinance shall be deemed guilty of a misdemeanor and, upon conviction in the municipal court
of the City of The Colony, Texas, shall be punished by a fine not to exceed the sum of Five
Hundred Dollars ($500.00) for each offense. Every day a violation occurs shall constitute a
separate offense.
SECTION 6. This Ordinance shall become effective from and after its date of passage in
'accordance with law.
