HomeMy WebLinkAboutResolution No. 06-089 RESOLUTION NO. 06- 0 ~?1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF THE ENGINEERING SERVICES CONTRACT BY AND BETWEEN THE CITY OF THE COLONY AND KIMLEY-HORN FOR DESIGN OF A ROADWAY CONNECTING THE WAL-MART PARKING LOT AND MEMORIAL DRIVE, WHICH IS ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City and Consultant have entered into an agreement such that the Consultant is to provide the following services: DESIGN OF A ROADWAY CONNECTING THE WAL-MART PARKING LOT AND MEMORIAL DRIVE; and WHEREAS, the City has determined that it is in the best interest of the City to enter into the Contract with KIM LEY-HORN, which is attached hereto and incorporated herein by reference as Exhibit "A," under the terms and conditions provided therein. WHEREAS, with this Contract the City of The Colony is agreeing to pay the sum not to exceed $25,300.00 for such work. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS THAT: Section 1. The Engineering Services Contract, which is attached and incorporated hereto as Exhibit "A", having been reviewed by the City Council ofthe City of The Colony, Texas, and found to be acceptable and in the best interest of the City and its citizens, be, and the same is hereby, in all things approved in the amount of $23,000.00 as the base amount, plus a $2,300.00 contingency amount for a total not to exceed $25,300.00, and the City Manager is hereby authorized to execute the Contract on behalf ofthe City of The Colony, Texas. Section 2. That this Resolution shall take effect immediately from and after its adoption and it is so resolved. PASSED, APPROVED and EFFECTIVE this 16th day of October, 2006. PREAMBLE Describing a specific agreement between KIMLEY-HORN AND ASSOCIATES, INC. (hereinafter, "the Consultant"), and The City of The Colony, Texas (hereinafter "the Client") in accordance with the terms of the Master Agreement for Continuing Professional Services dated September 9, 2002, which is incorporated herein by reference. SECTION 1 Identification of Project: Professional Engineering Services for the design of a right turn lane and driveway along Memorial Drive. Bidding and Construction Contract Administration are also included. SECTION 2 General Category of Services: Prepare construction plans, specifications, and OpInIOn of probable construction costs for a right turn lane and driveway along Memorial Drive. Project tasks include Survey, ROW/Easement Instruments of Conveyance, Design, Bidding Phase Services, and Construction Contract Administration. SECTION 3 Specific Scope of Basic Services: The Consultant will perform the following basic scope of services under this IPO. Task 1 - Survey 1. Perform a field survey to identify and locate existing topographic elements within the improvement limits 2. Establish horizontal control points 3. Establish a vertical control benchmark circuit as needed 4. Coordinate with DIG TESS to locate and mark existing franchise and public utilities prior to performing the field survey 5. Prepare a final topographic drawing in ACAD format (including contours and breaklines) showing the features located in the field, an ASCII coordinate file of the points located in the field, and a hard copy of the coordinates and feature descriptions Task 2 - ROW / Easement Instruments of Conveyance 1. Preparation of up to two (2) right-of-way exhibits and narratives 2. P:\06/ J /7. 01 7\PPPlipo _1017 _memorial_turn_/anes_FJNAL-09-J9_06.doc PAGE 1 OF4 Task 3 - Desie:n KHA will provide professional services required for the design and preparation of plans, details, technical specifications, and an opinion of probable construction cost. This task includes: 1. Prepare for and attend project kick-off meeting and project coordination meetings (up to two (2)) with City staff to discuss the project requirements and special design or coordination needs. 2. Data Collection a) City record drawings and utility maps b) Existing plats c) Existing property owner and record information d) Roadway, Storm Drainage, and Utility Design Criteria 3. Compile applicable TxDOT standard details for traffic control. Detailed traffic control plan sheets will not be provided. 4. Prepare final plans, specification books, and details pertaining to paving, drainage, pavement markings, and erosion control plan. Pedestrian facilities will not be designed as part of this project. 5. Plans shall consist of 11 "x 17" sheets at a scale of 1 "=40' horizontal. Spot elevations will be provided. Vertical profiles will not be required. 6. Submit three (3) sets of plans, specification books, and an opinion of probable construction cost to the City for review and comment at the 90% milestone. 7. Upon City approval of the 90% plans, KHA will complete the final construction documents, and submit (3) sets to the City. Task 4 - Biddine: Phase Services (Additional Services) KHA will provide professional services required for the Bidding Phase Services if authorized by the Client. This task includes: 1. Assist the City in the placement of the advertisement for bids (advertisement to be paid for directly by the City), issue contract documents to prospective bidders and maintain a list of bidders to whom bidding documents have been issued. 2. Print up to thirty (30) sets for bidder distribution (11 "xI7") 3. Issue addenda as appropriate to interpret, clarify, or expand the bidding documents 4. Attend the bid opening 5. Tabulate the bids received and evaluate the compliance of the bids received with the bidding documents. Prepare a written summary of the bid tabulation. 6. Check references of apparent low bidder and prepare bid summary letter. Task 5 - Construction Contract Administration KHA will provide professional services required for Construction Contract Administration. This task includes: 1. Attend the pre-construction conference. 2. Visit the project site at appropriate intervals (up to three (3) including the final walk-thru) as construction proceeds to observe and report on the progress of the executed work and general compliance with the contract documents. Attend periodic construction meetings at the jobsite to discuss schedule, key events, and coordination issues. 4. Issue necessary interpretations and clarifications of contract documents, and make recommendations regarding the acceptability of the work. 5. Participate in the final walk-thru and report on the completion of the project. SECTION 4 Additional Services: Additional services to be performed if authorized by the Client, but which are not included in the above- described Scope of Services, are as follows: 1. Preparing for or attending any additional meetings not identified within the Scope of Services. 2. Furnishing additional copies of review and/or final documents in excess of the number of the same identified in the Scope of Services. 3. Coordination with franchise utility companies 4. Sanitary sewer / water line design 5. Retaining wall design 6. Pedestrian facility design 7. Construction Staking 8. ROWand/or easement negotiation and acquisition 9. Redesign to reflect project scope changes requested by the Client, required to address changed conditions or change in direction previously approved by the Client, mandated by changing governmental laws, or necessitated by the Client's acceptance of substitutions proposed by the contractor. 10. Geotechnical Services 11. Review shop drawings submitted by the contractor for general compliance with the intent of the design. 12. Preparation of Record Drawings SECTION 5 Special Terms of Compensation: Consultant will perform the tasks described in the Scope of Services for the lump sum fee of $23,000. A major task breakdown is provided below. All permitting, application, and similar project fees will be paid directly by the Client. . KHA reserves the right to reallocate the budget amount among tasks as determined necessary by KHA. The lump sum fee includes labor costs and direct expenses identified in this contract, as well as items such as in-house duplicating, printing, facsimile, local mileage, telephone, postage, and computer expense. Consultant will perform the tasks described in Additional Services on a reimbursable basis at the hourly rates in effect at the time of the service plus 6% to cover certain direct expenses for the project which would include in-house duplicating, facsimile, postage, local mileage, telephone, and word processing. Other direct expenses will be invoiced at cost plus 15%. Technical use of computers for design, analysis, and graphics, etc., will be billed at $25.00 per hour.
