OCTOBER 27, 2005
MINUTES
II Attendance
Present: Chris Italia, Richard Kuether, Ruby Lawrence, Rita Webster, Robert
Taylor, and John Fowler
Presen. from staff: Iris Browder, Donna Bateman, Beverly Sligar, Mark Jones,
Sheron Riney and Joe Gorfida

Agenda Item II
Consider minutes from the September 15, 2005 meeting.
Meeting was called to order by Chris Italia. The minutes from the September 15,
2005 meeting were approved. Motion to to accept minutes was made by John
Fowler and a second was made by Rita Webster.

I Agenda Item '"
Receive citizen input
Resident Vicki Gomez was in attendance to discuss the Junked Vehicle
Ordinance. She has a car in her driveway that has been tagged as a junk vehicle
and she feels that she should have not received a notice. Ms. Gomez said that
even though the vehicle doesn't have current stickers it isn't a junked vehicle.
There was discussion by the board members and the attorney as what state and
local law constitute as a junked vehicle. It was noted that Code Enforcement
does work with the citizens when possible.
Agenda Item IV
Receive a report from staff regarding 2004 and 2005 Code Enforcement data.
Iris Browder gave a report comparing violations from 2004 and 2005. She
discussed the most common violations and explained what happens when
property owners do not comply. Iris also explained the current collection process
and what happens when invoices are not paid. Ruby wanted to know if it would
be beneficial to let the public know what the fines for various offenses would be.
Iris stated that she would try to get the fines placed on the back of the utility bills.
It was also discussed what percentage comply and what percentage receive
citations.
Right of Way obstructions were discussed and it was decided to add the topic to
November's agenda.

Agenda Item V
Receive a report from staff regarding current court procedures.
Iris Browder gave a report on the cities current court procedures. Iris stated that
a majority of the citations written are for junk vehicles. Iris explained that our
current process only allows us to issue citations for non compliant residents, but
starting January 2005 the code enforcement department will begin towing
vehicles.

The city attorney discussed the difference between criminal violations and civil
violations. He also gave an over view of the warrant process.
Agenda Item VI
Receive a report from staff regarding previous ordinances recommended by the
Code Enforcement Advisory Committee and approved by City Council.
Iris gave an overview of the ordinances that were recommended by the Code
Enforcement Advisory Committee and were approved by the City Council. There
was some discussion regarding the obstruction of right of way ordinance.
Joel Marks brought up car covers on junk vehicles. He thought we might want to
discuss possibly changing this in the ordinance. It was decided the issue of junk
vehicles would be revisited at a later date.
Agenda Item VII
Review a draft resolution regarding the condition of city owned property.
Joe Gorfida discussed a draft resolution regarding condition of city owned
property and why this is important. Donna Bateman asked for clarification as to
the board's intent for this resolution. Everyone agreed it was a much needed
resolution and Joel Marks discussed putting it on the City Council Agenda. Joe
Gorfida explained how this process would work.

Joel Marks stated that Code Enforcement is doing a good job and the people are
cleaning up.
There VI. as discussion that the next meeting would be held on December 1,2005
because of the Thanksgiving Holidays.

Rita Webster made a motion to adjourn and Ruby Lawrence 2nd the motion.
**Minutes were not signed by the Chairman, but they were
approved at the December 1, 2005 Code Enforcement Advisory
Board meeting.
