HomeMy WebLinkAbout03/28/06 P&Z CITY OF THE COLONY MINUTES OF THE PLANNING AND ZONING COMMISSION Meeting held on Tuesday, March 28, 2006 I After determining that a quorum was present, the Planning and Zoning Commission of the City of The Colony, Texas convened into Regular Session which was held on Tuesday, March 28, 2006 at 6:00 p.m. in the City Council Chambers located in City Hall, 6800 Main Street, The Colony, Texas, at which time the following items were addressed: PRESENT: Brian Wade, DeVille Hubbard, Debbie Morrison and Karen Hames, Marlene Milsak (arrived late) ABSENT: Mike Barrett One vacancy on the Commission. 11.0 I CALL REGULAR SESSION TO ORDER 12.0 I DISPOSITION OF MINUTES 2.1 I 2.2 2.3 Consider approval of the minutes of the February 28,2006 work session. Commissioner Hames moved to approve the minutes. Seconded by Commissioner Hubbard. Motion carried 4-0 Consider approval of the minutes of the February 28,2006 regular session Commissioner Hubbard moved to approve the minutes. Seconded by Commissioner Morrison. Motion carried 4-0 Consider approval of the minutes of the March 7, 2006 regular session. Commissioner Morrison moved to approve the minutes. Seconded by Commissioner Hames. Motion carried 4-0 Commissioner Milsak arrived. 13.0 3.1 I 1 PUBLIC HEARING Hold a public hearing and consider making a recommendation to the City Council regarding rezoning a 428 acre tract from an Agricultural (A) zoning district to Planned Development - 21 (PD- 21) zoning district and the proposed concept plan. The tract is located off Hackberry Creek Road in the northwest portion of the city. A marina, RV park, campsites, hotel with conference center and restaurant are proposed for Hidden Cove Park. (Z06-0001, Hidden Cove Park Concept Plan). Ms. Odell presented a staff report regarding making a recommendation to the City Council regarding rezoning a 428 acre tract from an Agricultural (A) zoning district to Planned Development-21 (PD-21) zoning district and the proposed concept plan. The tract is located off Hackberry Creek Road in the northwest portion of the city. Commissioner Hubbard asked if this would have to come back to the Planning and Zoning Commission if changes wanted to be made. Ms. Odell stated that it would have to come back if they wanted to make changes to the concept plan. Commissioner Hubbard asked if there was a facility for interior paint / motor repaIr . Costa Mazdiji, Carter and Burgess, stated that the 3 storage buildings shown can be used for that. Chris, Carter and Burgess, stated that the dry stack storage area and the ship store can be used for that. Commissioner Hubbard asked if the facility would have limited access after 10 p.m. I Travis Patterson, Marine Quest, stated that there would be limited access thru the front gates all day, and then access codes would be given to the people staying in the park and there will also be night watchmen. Commissioner Hubbard asked if irrigation would apply to the landscaping around the conference center. Ms. Bateman stated that can be put in as a condition on the development plan but not on the concept plan. Commissioner Hubbard asked if there would be a fire sprinkler system required in the conference center that is going to be three stories Ms. Odell stated yes. Ms. Bateman stated that City code requires anything over 6,000 square feet be sprinkled. Commissioner Hubbard asked if the current asphalt roads would remain and who would maintain them. Pam Nelson, Director of Parks and Recreation, stated that the roads would be the responsibility of Marine Quest I Commissioner Hames asked if an environmental study was done to see how this project would impact the area. Chris, Carter and Burgess, stated that they are currently working on an environmental impact assessment with the Army Corps of Engineers. Planning and Zoning Commission March 28, 2006 I Commissioner Hames asked how Parks and Recreation would be impacted as far as pools and amenities. Ms. Nelson stated that everything would be maintained by Marine Quest. Commissioner Hames asked if fees would be assessed. Ms. Nelson stated that the fees would be reviewed annually and Parks and Recreation would coordinate with Marine Quest. No one came forth to speak in favor or opposition. Commissioner Hubbard moved to approve Z06-0001 as recommended by staff. Seconded by Commissioner Milsak. Motion carried 5-0 3.2 Hold a public hearing and consider making a recommendation to the City Council regarding an amendment to Appendix B, of the Code of Ordinances, relating to dormant project expiration. This is statutory language related to The Local Government Code Chapter 245. (8106-0026, Dormant Projects) I Ms. Odell presented a staff report regarding making a recommendation to the City Council regarding an amendment to Appendix B, of the Code of Ordinances, relating to dormant project expiration. This is statutory language related to The Local Government Code Chapter 245. Commissioner Milsak asked if this would apply to residential homes that have burned to the ground. Ms. Bateman stated that the permit is good for 180 days, and a home that had burned to the ground falls under property maintenance not this topic. No one came forth to speak in favor or opposition.
