HomeMy WebLinkAboutResolution No. 06-044 RESOLUTION NO. 06-J2~~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF THE ENGINEERING SERVICES CONTRACT BY AND BETWEEN THE CITY OF THE COLONY AND FREESE AND NICHOLS, INC. FOR PREPARATION OF A WATER DISTRIBUTION SYSTEM SPECIFIC STUDY TO MEET THE STAGE 2 DISINFECTION BY-PRODUCCTS RULE, WHICH IS ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City and Consultant have entered into an agreement such that the Consultant is to provide the following services: PREP ARA TION OF A WATER DISTRIBUTION SYSTEM SPECIFIC STUDY TO MEET THE STAGE 2 DISINFECTION BY-PRODUCCTS RULE; and WHEREAS, the City has determined that it is in the best interest of the City to enter into the Contract with FREESE AND NICHOLS, INC., which is attached hereto and incorporated herein by reference as Exhibit "A," under the terms and conditions provided therein. WHEREAS, with this Contract the City of The Colony is agreeing to pay the sum not to exceed $79,810.00 for such work. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS THAT: Section 1. The Engineering Services Contract, which is attached and incorporated hereto as Exhibit "A", having been reviewed by the City Council of the City of The Colony, Texas, and found to be acceptable and in the best interest of the City and its citizens, be, and the same is hereby, in all things approved in the amount of $79,810.00 as the base amount, plus a $-0- contingency amount for a total not to exceed $79,810.00, and the City Manager is hereby authorized to execute the Contract on behalf of the City of The Colony, Texas. Engineering Manager 6800 Main Street The Colony, TX 75056 Dear Mr. Scruggs: In response to your request, we are pleased to submit this proposal for providing professional engineering/planning services to the City of The Colony for the evaluation and preparation of a System Specific Study (SSS) for the City's water system. We understand that the System Specific Study is needed to meet the requirements of the Stage 2 Disinfectants and Disinfection By-Products Rule (Stage 2 DBPR), and we will utilize information obtained in the City's previous water master plan in performing our services. SCOPE OF SERVICES Freese and Nichols will render the following professional services in connection with the development of the Project: City of The Colony System Specific Study The proposed scope and hours as described below, and as shown on the attached spreadsheet, correspond to the development of a System Specific Study, the first step in meeting the requirements of the Stage 2 DBPR. Task 1.01 - Project Kick-Off Meeting FNI will provide project description and background information on Stage 2 DBPR, SSS, and Initial Distribution System Evaluation (IDSE) requirements. Discussion of existing water system model and any other water infrastructure updates to be incorporated into model. Review of the conversion of the existing water model from KYPipe 2000 to H20Map Water. Task 1.02 - Review of Historical Water Sampling Data FNI to evaluate Stage 1 DBPR monitoring data and develop a water distribution system schematic indicating Stage 1 DBPR monitoring locations. FNI to coordinate with the City of Dallas on water quality data and their IDSE study efforts. Task 1.03 - Evaluate and Edit Existing Water Modelfor Stage 2 DBPR Criteria FNI to convert existing KYPipe 2000 model to H20Map Water. FNI to inventory existing water system model information for determination of adequacy for Stage 2 DBPR criteria and expand coverage of model to meet the criteria. FNI to edit existing model with new water system infrastructure and future infrastructure anticipated to be in service by September 2008. Task 1.04 - Conduct Water Model Calibration and A nalysis for Stage 2 Criteria FNI to assist City in conducting pressure testing at up to six (6) locations over a one week period Page 2 for model calibration along with City-provided SCADA data. FNI to develop diurnal curve for City using SCADA data. FNI to calibrate water system model for a 24 hour period and run analyses for extended period simulation during time of peak total trihalomethanes (TTHM) formation. FNI to identify SSS monitoring locations for future additional one time sampling during the month of high TTHMs. Task 1.05 - Prepare Technical Memorandum (TM) FNI to coordinate and prepare a technical memorandum outlining the methodologies and approach used during water system modeling and determination of SSS monitoring locations. Task 1.06 - Prepare SSS Modeling Study Plan FNI to prepare required SSS Modeling Study schematics and submittal forms. Task 1.07 - QA/QC TM and SSS Study Plan FNI to prepare TM and SSS Study Plan documents for internal QA/QC review. Address any comments received from internal QA/QC review. Task 1.08 - Meeting with City to Discuss TM and SSS Study Plan FNI to coordinate review and discussion ofTM and SSS Study Plan with City. Task 1.09 - Revise and Finalize TM and SSS Study Plan and Submittal to TCEQ FNI to finalize TM and SSS Study Plan based on City comments and submit final SSS Study Plan to TCEQ by October 1, 2006. TIME OF COMPLETION Freese and Nichols is authorized to commence work on the Project upon execution of this Agreement and agrees to complete the services by October 1, 2006. If Freese and Nichols services are delayed through no fault of Freese and Nichols, Freese and Nichols shall be entitled to equitable adjustment of compensation and Freese and Nichols shall be entitled to adjust contract schedule consistent with the number of days of delay. RESPONSIBILITIES OF THE COLONY The Colony shall perform the following in a timely manner so as not to delay the services of Freese and Nichols: A. Designate in writing a person to act as The Colony's representative with respect to the services to be rendered under this Agreement. Such person shall have contract authority to transmit instructions, receive information, interpret and define The Colony's policies and decisions with respect to Freese and Nichols' services for the Project. B. Provide all criteria and full information as to The Colony's requirements for the Project, including design objectives and constraints, space, capacity and performance requirements, flexibility and expandability, and any budgetary limitations; and furnish copies of all design and construction standards which The Colony will require to be included in the plans and specifications. Page 3 C. Assist Freese and Nichols by placing at Freese and Nichols' disposal all available information pertinent to the Project including previous reports and any other data relative to the Project. D. Arrange for access to and make all provisions for Freese and Nichols to enter upon public and private property as required for Freese and Nichols to perform services under this Agreement. E. Examine all studies, reports, sketches, drawings, specifications, proposals and other documents presented by Freese and Nichols, obtain advice of an attorney, insurance counselor and other consultants as The Colony deems appropriate for such examination and render in writing decisions pertaining thereto within a reasonable time so as not to delay the services of Freese and Nichols. F. Provide such accounting, independent cost estimating and insurance counseling services as may be required for the Project, such legal services as The Colony may require or Freese and Nichols may reasonably request with regard to legal issues pertaining to the Project. The total fee for Basic Services shall be computed on the basis of Attachment CO but shall be the lump sum fee of$79,81 0.00. IfFNI sees the Scope of Services changing so that additional services are needed, FNI will notify the City for the City's approval before proceeding. Additional services shall be computed based on the Schedule of Charges found in Attachment CO. Payment of the services shall be due and payable upon submission of a statement for services. Statements for services shall not be submitted more frequently than monthly. TERMS AND CONDITIONS OF AGREEMENT We propose to furnish our services as described in our General Agreement for Professional Services dated November 6,2001. (Salary Cost is equal to 1.5851 times payroll. This factor is adjusted annually.)
