HomeMy WebLinkAboutResolution No. 06-014 RESOLUTION NO. 06- ~/l.f A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF THE DESIGN SERVICES CONTRACT BY AND BETWEEN THE CITY OF THE COLONY AND DUNKIN, SIMS, STOFFELS, INC. FOR BASIC DESIGN SERVICES AND CONSTRUCTION DOCUMENTS, WHICH IS ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City and Consultant have entered into an agreement such that the Consultant is to provide the following services: Basic Design Services and Construction Documents for the construction plans of the hike and bike trail and landscape features within the gas easement corridor from The Legends Homeowners Association northern boundary at Slay/Baker to N. Colony Blvd.; and WHEREAS, the City has determined that it is in the best interest of the City to enter into the Contract with Dunkin, Sims, Stoffels, Inc., which is attached hereto and incorporated herein by reference as Exhibit "A," under the terms and conditions provided therein. WHEREAS, with this Design Services Contract the City of The Colony is agreeing to pay the sum of $20,000.00 for such work. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS THAT: Section 1. The Design Services Contract, which is attached and incorporated hereto as Exhibit "A", having been reviewed by the City Council of the City of The Colony, Texas, and found to be acceptable and in the best interest of the City and its citizens, be, and the same is hereby, in all things approved, and the City Manager is hereby authorized to execute the Agreement on behalf of the City of The Colony, Texas. Section 2. That this Resolution shall take effect immediately from and after its adoption and it is so resolved. Colony The Colony, Texas 75056 Dear Mr.Fitzgerald: We appreciate the opportunity to submit this Scope of Services for design and construction plans for the hike and bike trail and landscape features within the trail corridor from The Legends Homeowners Association's northern boundary to North Colony Boulevard. Dunkin Sims Stoffels, Inc., (DSS) will serve as the prime Consultant to the City of The Colony (Client) on the trail project. The following Scope of Services outlines the professional services to be performed in association with the design and construction documentation of The Hike & Bike Trail and associated amenities within the Atmos Energy right-of-way as it runs from the northern boundary of the Legends Residential Development to North Colony Boulevard. SCOPE OF SERVICES Existing Conditions/Base Map DSS will obtain information concerning the existing site conditions, existing infrastructure, proposed infrastructure improvements, city topographical maps, as well as, any other pertinent data readily available through the various City Departments. Upon retrieval of the above outlined information a base map will be prepared. If both parties determine that it is essential for development of the trail, an on-site survey of the trail corridor will be conducted by a Registered Public Land Surveyor. This survey will delineate accurate data reflecting the elevational and spatial position of the existing conditions and topographic contours. Preparation of the on-site survey is an additional service and the fee for preparation of the survey is delineated within the Additional Services section of this proposal. Schematic Design DSS will prepare schematic plans illustrating alignment alternatives for the incorporation of the trail; as discussed with the Client. The schematic alignments for the trail will 9603 White Rock Trail, Suite 210 Dallas, Texas 75238 (214) 553-5778 illustrate trail placement and the location of site amenities. The schematic designs along with a preliminary Opinion of Probable Cost for each design will be presented to the Client for review and comment. Final Design DSS will incorporate City Staff comments and further develop the chosen schematic design or combination of designs. An opinion of probable cost will be prepared for this final trail design. The resulting final design and opinion of probable cost will be presented to City Staff for their review and comments. The final design will be refined and Client comments will be incorporated to the full extent practicable. Design Development Phase DSS will begin preparation of the construction documents by further analyzing the design elements of the Hike and Bike Trail and proposing refined design recommendations and solutions for additional review and comment by the City. A detailed opinion of probable cost for the construction of the proposed elements will be prepared. This opinion of probable cost will be used to determine the scope of the proposed Hike & Bike Trail construction and possible add or deduct alternates which may be incorporated. Construction Documents and Specifications Construction documents and specifications will be prepared for the development of the Hike & Bike Trail. The construction plans and specifications willi be submitted for review. Following review, the construction documents shall be refined to address any comments and concerns noted by the City. A final opinion of probable cost will be prepared for submission with the construction documents. Bidding Phase DSS will perform the following services relative to project bidding: . Prepare addenda, as necessary, to interpret and clarify the bidding documents. Consult with the Client to make determinations regarding the acceptability of substitute materials and equipment proposed by bidders, when substitution prior to the award of contracts is allowed by the bid documents. Assist the City in receiving bids. Analyze the bids and make recommendations to the Client regarding the bids. . . . Construction Review The Consultants will perform the following professional services during construction of the facilities: \\Server.pdc\DSS_data\RcceptiOllist\city\Tbe Colony\LeUer to Sam Fitzgerald 11.30-05 TG.doc · Consult and provide advice. · Preparation of elementary and supplementary sketches required to resolve field conditions. · Approval of submittals and shop drawings submitted by the Contractor for conformance with the design concept. · The Consultant shall make periodic site visits (one per month, minimum) to determine if the project is proceeding in accordance with the contract documents. This shall not involve exhaustive or continuous on-site inspections to check the quality or quantity of work or materials, DSS shall not be responsible or liable for the Contractor's failure to perform the construction work in accordance with the contract documents. · Review all certificates for payment submitted by the Contractor and make appropriate recommendations for approval of pay requests. · Consult with the City regarding change order items. · Provide punch list of incomplete and incorrect items for the Contractor to complete the project. Compensation to Consultant The Consultant's fees for the services outlined within this proposal are as follows: Desiqn The Consultant's fees for schematic and final design services are $1,000.00. Desion Develooment The professional fee for design development services for the hike & bike trail is $1,250.00. Construction Documents The professional service fee for the preparation of construction documents, bidding and construction observation as outlined in this proposal is $7,100.00. A detailed breakdown of the Consultants fees is included within this proposal as Attachment 'A'. Billing for professional services will be submitted monthly and will be due within thirty (30) days of receipt. Reimbursable Expenses Reimbursable expenses include, but are not limited to, the following: Printing/reproduction and photocopying charges, delivery/courier and mailing expenses. DSS will bill direct reimbursable expenses to the City at their actual incurred cost. We propose that additional services be provided on an hourly rate basis with a mutually agreed "not to exceed" total. For additional services the following hourly rates shall be used: Principal Landscape Architect CADD Technician Technical Support Clerical Support $105.00 per hour $ 90.00 per hour $ 75.00 per hour $ 50.00 per hour $ 25.00 per hour Such additional services might include the following: · Desian Additional design services beyond those identified in this Scope of Services. Any design changes following the preparation of the construction documents will also be considered an additional service and DSS will bill the City for the resultant changes to the construction documents and for increased services at the hourly rates outlined above. · Construction Preparation of Change Orders as required which expand the original Scope of Services. Additional Services If the Consultant and the Client agree that it is desirable to have accurate data reflecting the elevational and spatial position of the existing elements and conditions, DSS will hire a professional Public Land Surveyor for that purpose. The on-site survey will be conducted on an hourly rate basis not to exceed $6,500.00. If the surveyor is allowed to use controls established by the surveyor of the Legends HOA segment the maximum could be reduced to $5,500 or less. Insurance Coverage DSS will furnish a certificate(s) of insurance indicating the coverage maintained. The certificate(s) for each insurance policy will be signed by a person authorized by that insurer to bind coverage on its behalf. Certificate of Insurance shall be in a format similar to the ACCORD form. \\Scrver-pdc\DSS_datll\Receptionist~ity\Thc Colony\Letter to Sam Fitzgerald 11.30-05 TG.doc Indemnification DSS covenants to save, defend, keep harmless and indemnify the City, its officers, officials, employees, or volunteers from and against any and all claims, loss, damage, injury, cost (including court costs and attorney fees), charges, liability or exposure, however caused, resulting from or arising out of or in any way connected to DSS's actions, performance, or operations relating to professional services rendered.
