HomeMy WebLinkAboutResolution No. 06-018 CITY OF THE COLONY~ T~XAS RESOLUTION 06- " A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, APPROVING THE FACILITY USE AGREEMENT BETWEEN THE AMERICAN RED CROSS - DALLAS AREA CHAPTER AND THE CITY OF THE COLONY, WHICH IS ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "A"; AUTHORIZING THE DIRECTOR OF COMMUNITY SERVICES TO EXECUTE THE SAME; PROVIDING A REPEALER CLAUSE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City of The Colony ("City") has a responsibility to protect the public and to preserve life and property through specific disaster preparedness activities and by conduction and coordinating actual disaster relief operations; and WHEREAS, the American Red Cross ("Red Cross"), through its preparedness program, maintains capability to take immediate action to provide emergency assistance to people affected by disaster or threat of disaster; and WHEREAS, the City Council has determined that it would be in the best interest of the City to protect the health, safety and welfare of its citizens, to enter into Facility Use Agreement, which is attached hereto and incorporated herein as Exhibit "A", with the American Red Cross for the purpose of authorizing use of the Colony Recreation Center, located at 5151 North Colony Boulevard, as an emergency shelter, feeding center, service center, storage center, and/or office headquarters for the operational staff supporting victims in the event of a disaster or threat of disaster situation. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS THAT: Section 1. The City Council hereby approves the Facility Use Agreement by and between the City and the Red Cross, which is attached hereto and incorporated herein by reference as Exhibit "A." Section 2. That the Community Services Director is hereby authorized to execute all appropriate documents to enter into said Agreement as provided for herein. Section 3. That all provisions of any resolution of the City Council of the City of The Colony in conflict with the provisions of this resolution be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this resolution shall remain in full force and effect. V..,JI + American Red Cross FACILITY USE AGREEMENT Disaster Services FOR THE USE OF FACILITIES AS MASS CARE SHELTERS This agreement is made aDd entered into between the governing board of . - The Colony Recreation Center Tbe Colony, State of Texas, and the Amtrican Red Cross - Dallas Area Chapter. RECITALS Pursuant to the terms of federal statutes, the American Red Cross provides emergency relief services to individuals and families who arc victims of disaster. Pam Nelson is authorized to permit the Amencan Red Cross to use The Colony Recreation Center buildings, grounds and equipmel1t for alternate headquarters, service centers, feeding facilities and/or m.ass care shelters required in the conduct ofthe American Red Cross Disaster Services activities, and wishes to cooperate with the American Red Cross for such purposes. The parties hereto mutually desire to reach an understanding that will result in making the aforesaid facilities of The Colony Recreation Center available to the American. Red Cross for the aforesaid use. Now, therefore, it is mutually agreed between the parties as follows: 1. The Colony Recreation Center agrees that, after meetin.g it's responsibilities to it's members, it will permit, to the extent of its abi Ilty and upon request from the American Red Cross, the use of its physical facilities'by the Ametiean Red Cross as mass shelters/feeding centers/service centers/warehouses for bulk items llsed for the victims of disaster and/or office headquarters for the operational staff supporting the victims of disaster. 2. The American Red Cross agrees that it shall exerc.ise reasonable care in the cO.nduct of its activities in such facilities and further agrees to replace or reimburse The Colony Recreation Center for any items, materials, equipment, or supplies that may be used by the American Red Cross in the cond.uct of its relief activities in said facilities. (See specific items on facility survey. List specific items of potential. cost there.) 3. Notwithstand.ing any other agreements, the American Red Cross - DalJas Area Chapter agrees to defend, ho.ld harmless, and indemni.fy The Colony Recreation Center against any legal liability in respect to bodily injury, death, and property damage arising from negligence of the said chapter or disaster operation during its use of the property belonging to the said Colony Recreation Center. 02/05/2006 13:47 9403840884 AMERICAN RED CROSS PAGE 04 ,.
